LOUIS PARK ORDINANCE CODE IN SECTIONS 1:124, 1:125 AND 1:126, ENTITLED "PLANNING COMMISSION"," MEMBERSHIP AND TERMS", "ORGANIZATION", RELATING TO MEMBERS AND THEIR APPOINTMENT TO -111-1E PLANNING COMMISSION THE CITY OF ST. LOUIS PP_RK DOES ORDAIN: Section 1. That Sections 1:124, 1:125 and 1:126 of the St. Louis Park Ordinance Code, entitled Planning Commission "Membership and Terms", "Organization", "Powers and Duties" respectively are hereby amended to read as follows: Section 1:124. Planning Commission. Membership and Terms. Subd. 1. The Planning Commission shall be an Advisory Commission and shall consist of thirteen members, ten regular members and three ex officio members, all appointed as hereinafter set forth: Subd. 2. Ten regular members of the Commission shall be appointed for terms of three years each by the City Council. Their terms shall run until the 31st day of December of the year in which their terms expire.. and until a successor is appointed and qualified. The term of office of the present six regular members of the Commission shall remain unchanged, 3 terms expiring December 31, 1969 and 3 expiring December 31, 1970. The initial appointment of four additional regular members shall be for one year ending Dec ember 31, 1968 and until their successors are appointed and qualify. Subsequent appointments shall be for three year terms. In the event of a vacancy, the Council shall appoint a person to complete the unexpired term. A member of the Commission may be removed with or without cause by the City Council.' Subd. 3. One ex officio voting member and one alternate shall be appointed, for a term of three years and until their successors shall be appointed and qualify, both of whom shall be members of the Board of Independent School District No. 283 of St. Louis Park. Both the member and alternate shall be selected and appointed by said School Board. Failure of said School Board to appoint its member or alternate to serve on the - Planning Commission shall in no way affect the validity of the proceedings of the Planning Commission. The initial terms of such member and alternate shall commence in January, 1968, and such member and alternate shall be appointed as soon as practicable after the 1st day of January, 1968. Subd. 4. Two ex officio voting members, who shall be members of the City Council, shall be appointed by the City Council for one year terms. No Council member shall serve as an ex officio member for more than two consecutive years: Such members shall be appointed as soon as practicable after the 1st day of January of each year to serve until the 3lst day of December of that year and until their successors shall qualify. Section 1:125. Organization. The Commission shall elect its own chairman, vice-chairman, and secretary and shall provide its own rules and procedure, determine the date and time of meetings and upon whatever notice it deems best shall call public hearings when necessary and desirable. No member of the Commission shall pass upon any question in which he is directly or indirectly interested. Section 1:126, Powers and Duties. The Planning Commission shall have the following powers and duties: Subd. 1. To prepare a Comprehensive Plan for the future development of the City to be submitted to the City Council for implementation and to maintain said plan, and recommend amendment thereof to the City Council, as may become necessary. Subd. 2. To initiate, direct, and review, from time to time, a study of the provisions of the Zoning Ordinance and the subdivision regulations and to report to the City Council its advice and recommendations with respect thereto. Subd. 3. To study applications and proposals for amendments to the Zoning Ordinance and applications for special permits and to advise the City Council of its recommendations thereon. Subd. 4. To study preliminary and final plats and to advise the City Council of its recommendations thereon. Subd. 5. To act in an advisory capacity to the City Council in all matters wherein powers are assigned to the City Council by State Law or City -Charter, concerning comprehensive planning, zoning, platting, changes in streets, and other matters of a general planning nature. JOHN BERTRAM, being duly sworn, on oath says he is and during all the times herein stated has been the general snanager and printer of the newspaper known as The St Louis Park Dispatch and has full knowledge of the facts herein stated as follows• (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements (4) Said newspaper is circulated in and near the munrcipahty which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park in the County of Hennepin and it has its known office of issue in the City of Hopkins in said county, established and open during regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and main- tained by the managing officer or persons in its employ and subject to his direction and con- trol during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto (6) Said news- paper files a copy of each issue immediately with the State Historical Society (7) Said news- paper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the publisher of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
