LOUIS PARK ZONING ORDINANCE, " SECTION 6:122.6 RELATING TO OPEN SALES AND RENTAL LOTS THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. That Section 6:122.6 of Ordinance No. 730, passed December 28, 1959, entitled "St. Louis Park Zoning Ordinance" is hereby amended to read as follows: Section 6. 122.6 Open sale or rental lots for motor vehicles (used or new), furniture, trailers, airplanes, boats, monuments, machinery, garden hardware, concrete work and any other items sold from an open lot, subject to the following conditions: Subd. 1 No open sales lots shall sell or trade exclusively in used merchandise, but shall have on the site at least one-third (1/3) of its stock in new, unused merchandise except that for motor vehicles a franchised selling agreement for the sale of new cars on the St. Louis Park site for which the permit is requested shall be presented in lieu of the one-third (1/3) requirement. Subd. 2 A11 open sales or rental lots shall be operated in conjunction with a building or buildings containing the same or similar materials as displayed on the open sales or rental lot. Subd. 3 Subd. 4 Any sales or rental lot and building shall be on one contiguous site except that a portion or portions of said site may be separated by an alley or public street of a width not to exceed sixty (60) feet. A solid fence or wall and shrubbery of six (6) feet in height shall be erected and planted along all property lines of the site to be used for the open sales lot which abut an R -District. Subd. 5 The entire site other than the portion used for building or landscaped yard area shall be surfaced in blacktop or paving according to a plan approved by the City Engineer. Subd. 6 All paved areas shall be separated from all landscaped areas by curbs no less than six (6) inches in height of portland cement or asphaltic concrete, according to a plan approved by the City Planning Director. Subd. 7 All outdoor illumination shall be accomplished in such a way as to permit no direct rays of light to penetrate beyond the property line. Subd. 8 String lighting shall not be permitted. Subd. 9 The area of open sales or rental lot used for storage and display of merchandise shall not exceed two (2) square feet for every one (1) square foot of building on the site devoted to the same or any similar or accessory use. Section 2. This ordinance shall take effect fifteen days after its publication. Adopted by the City Council January 8, 1968. Attest: LSIL. JOHN BERTRAM, being duly sworn, on oath says he is and during all the times herein stated has been the general manager and printer of the newspaper known as The St Louis Park Dispatch and has full knowledge of the facts herein stated as follows. (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements (4) Said newspaper is circulated m and near the municipality which It purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office (5) Said newspaper purports to serve the City of St Louis Park in the County of Hennepin and it has its known office of issue in the City of Hopkins in said county, established and open during regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and main- tained by the managing officer or persons in its employ and subject to his direction and con- trol during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto (6) Said news- paper files a copy of each issue immediately with the State Historical Society (7) Said news- paper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1. 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the publisher of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
