AN ORDINANCE AMENDING ORDINANCE NO. 775 PASSED'
FEBRUARY 27, .1961 ENTITLED "AN ORDINANCE PROHIBITING
THE THROWING OR DEPOSITING OF LITTER IN PUBLIC PLACES'
'IN THE CITY OF ST. LOUIS PARK; REGULATING THE DISTRIBU-
TION OF COMMERCIAL AND NON-COMMERCIAL HANDBILLS;
CONTROLLING THE DEPOSITING OF LITTER ON PRIVATE
PREMISES; PROVIDING A LIEN FOR CITY CLEARANCE; -AND
PRESCRIBING PENALTIES FOR THE VIOLATION OF ITS PRO-
VISIONS`" REQUIRING THAT ALL RECEPTACLES CONTAINING
LITTER, INCLUDING BUT NOT LIMITED TO GARBAGE AND
REFUSE TO BE KEPT COVERED.
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. That Section 4:538 of Ordinance No. 775, passed February ;
27, 1961 entitled "An Ordinance Prohibiting the Throwing or.Depositing of -
Litter in Public Places in the City of St. Louis Park; Regulating the Distribu
tion of Commercial and Non -Commercial Handbills; Controlliag_theDeposit- s ,
ing of Litter on Private Premises; Providing a. Lien for City Clearance; and b
Prescribing Penalties for the Violation of its Provisions," is hereby_•amended;•
to read as follows: - -
• Section 4:538. Owner to Maintain Premises Free, of';Litter;

The owner or person in control of any private property,whether
occupied or vacant, shall at all times maintain the preinises;free
of litter, provided. however, that this section shall not prohibit
the storage of litter in authorized private receptacles for collection;.
and provided, further, that the ow-ier or person in control of.any 5{,
private property shall keep all receptacles tightly covered when
such receptacles have any. litter stored therein.
Section 2. This Ordinance shall take effect fifteen day`s`;after its pub- ,
lication.

JOHN E. TILTON. being duly sworn. on oath says he is and daring all the times herein stated
has been the publisher and printer of the newspaper !mown as The St. Louie Park Dispatch
and has cull knowledge of the facts herein stated an follows: (1) Said newspaper is printed
to the English language in newspaper format and fn oo)umn and sheet form equivalent in
printed space to at least 900 square inches. (2) Se(O newspaper is a weekly and is distributed
at least once each week. (3) Said newspaper has 80% of its news columns devoted to news
of local interest to the community which It purports to serve and does not whafy duplicate
ani other publication and is not made up entirely of patents, piste matter and advertisements.
(4) Sald newspaper is circulated in and near the mtmfelpelity which ft purports to terse. has at
least 500 copses regularly delivered to payhtg subscribers, has an average of at least 78% of
i's total circulation currently paid or no more than three monists in arrears and has entry as
second-class matter in Its local post•c ce. (8) Said newspaper purports to serve the
City of St. lams Park in the County of Hennepin and it has its known office of Issue in the City
of Hopkins in said coun'y. established and open during its regular business hour° for the
gathering of news. sale of advertisements and sale of subscriptions and maintained by the
publisher of said newspaper and subject to his direction and control daring all such regular
business hours and at which said newspaper Is printed. (8) Said newspaper flies a copy of
each issue Immediately with the State Historical Society. (7) Said newspaper has complied
with all the foregoing conditions for at least two years preceding the day or dates of
publication mentioned below. (8) Said newspaper Sae flied `with the Secretary of State of
Minnesota prior to January 1, 1968 and each January 1 thereafter an affidavit its the
form prescribed by the Secretary of State and signed by the publisher of said newspaper and
sworn to before a notary public stating that the newspaper m a legal newspaper.
