HomeMy WebLinkAbout974 - ADMIN Ordinance - City Council - 1966/07/05e • Original ORDINANCE NO. 974 AN ORDINANCE AUTHORIZING SALE BY THE CITY OF HOUSFSAT 4545 AND 4531 WEST 33TH STREET AND THE CITY OWNED PROPERTY BETWEEN QUEBEC AND RHODE ISLAND ON MINNETONKA BOULEVARD THE CITY CF ST. LOUIS :MARX DOES CRDAIN: Section 1. The City Council hereby declares that the emergency herein- after defined exists and that an emergency ordinance is necessary for the immediate preservation of the public peace, health, morals, safety or wel- fare in accordance with Section 3. 05, 3.06 and 3. 08 of the Charter of St. Louis Park. Section 2. The City Council hereby finds and determines the following facts and defines and declares the existence of an emergency as follows: 1. The houses and the land at 4531 and 4545 West 38th Street were purchased by the City of St. Louis Park for the purpose of constructing a municipal parking lot on said property. 2. The City has advertised on May 26, 1966 the sale of the hereinafter mentioned houses upon condition that • said houses would be removed from the site by July 16, 1966. No bids were received. IIP 3. The contract for construction of a municipal parking on said property, City Project No. 60-12, was awarded by Council on June 20, 1966. This contract provided that the aforementioned houses are to be removed by the City on or before July 15, 1966 to permit the con- struction of the parking lot, it being anticipated that the houses would be demolished or removed at city expense. 4. Garrison House Movers, Incorporated has subsequent to the letting of the parking lot contract, offered to purchase said houses and Lots 11 and 12, Block 2 of East Texa Tonka Addition for $7,000.00 and to remove said houses, thereby saving expense and loss of money to the City. 4. The sale of the aforementioned property pursuant to regular ordinance procedures as set forth in the City Charter, requiring two readings, publication and a period of fifteen days after publication before the ordinance became effective, would result in loss of revenue to the City for the houses, as it would delay the completion of City Project No. 50-1Z, and would cause the City the expense of wrecking said houses or removing them from the site. . 6. The City Council hereby declares that an emergency exists justifying and -equirine that this ordinance upon passage on the date • hereof and, publication thereof shall become effective immediately upon such publication to avoid loss of revenue and undue expense and hardship upon the City. Section -3. It i hereby determined that the reasonable market value of said property is Seven Thousand Dollars ($7, 000. 00). Section 4. The iv, ayor and City Nonage"- are hereby authorized in behalf of the City to execute a warranty deed for the sale and conveyance of said property to Garrison House Niovers, Incorporated for the sum of Seven Thousand Dollars ($7, 000. 00) to be delivered upon receipt of said purchase price in full. Section 5. This ordinance shall take effect immediately upon its publication after its adoption on the date hereof.
