AN ORDINANCE RELATING TO MOTOR VEHICLE, AGRICULTURAL,
AND CONSTRUCTION MAC'-iINERY JUNK YARDS, PROVIDING REGU-
LATIONS FOR THE OPERATION THEREOF AND PROVIDING PENALTIES
THE CITY OF ST. LOUIS PARK DOES ORDAIN:
Section 1. Section 4:225. 1. Legislative findings and purpose. It is
hereby found that the operation of unsightly motor vehicle, agricultural or,con-
struction machinery junk yards adjacent to the trunk highways on which motor
vehicles are operated at high speed is a distracting influence on drivers, there-
by impairing the public safety. It is hereby found and declared that in the inter-
est of and to promote the public safety it is necessary to regulate the operation of
motor.vehicle or agricultural or construction machinery junk yards on lands
adjacent to the trunk highways of the city pursuant to Section 1. 02 of the Charter
of the City of St. Louis Park.
Section 4:225. 2. Definitions. For the purposes of this ordinance,
the terms defined in this ordinance shall have the meanings given them in this
section: Junk yard means motor vehicle, agricultural machinery or construction
machinery junk yard used as a place of storage or deposit, within one half mile of
any right-of-way of any state trunk highway, including the interstate highways,
whether maintained in connection with another ausiness or not, where the waste,
body, or discarded material stored is equal in bulk to five or more motor vehicles
and which are to be resold for used parts or old iron, metal, glass, or other dis-
carded material. Dealer means any person, partnership, or corporation engaged
in the operation of a motor vehicle, agricultural or construction machinery junk
;yard. A highway is a trunk highway within the corporate limits of the City of St.
:.ouis Park, including interstate highways.
Section 4:225. 3. Unauthorized junk yards prohibited. No dealer nor
other person shall operate or cause to be operated any junk yard unless it be
screened so as to effectively conceal it from the view of motorists using the high-
way. The screening required by this section may be effected by trees, shrubs,
or foliage at least eight feet high at maturity which affords a sufficient screen.
None of the articles commonly—found-in junk yards as -defined-herein shall be
allowed to remain on the grounds for more than 24 hours unless within the buildings
or the properly screened arca as provided herein.
Section 4:225. 4. Declaration of Public Nuisance. Any junk yard
operated in violation of this ordinance 3s hereby declared to be a public nuisance.
Each day such a condition exists is a separate offense.

Section 2. Penalty. Any person violating the provisions of this ordinance
shall be guilty of a misdemeanor and upon conviction shall be punished by a fine
of not more than one hundred dollars or by imprisonment for not to exceed 90
days.
Section 3. Effective Date. This ordinance shall take effect fifteen days
after its publication.
