LOUIS PARK DOES ORDAIN: Section 1. That the City has title to a drainage easement running in an easterly and westerly direction in Lot 12, Block 1 L, McNair Park, according to the plat thereof on file and of record in the Office of the Register of Deeds in and for Hennepin County, Minnesota, and that subsequent to the acquisition of said easement storm sewer has been installed in the public street lying to the south of said tract of land. Section 2. That it is hereby determined that the public necessity and public need for storm sewer and drainage easement with respect to this particular property and its adjacent lands has changed, and that the existing easement running in an easterly and westerly direction through said Lot 12 is no longer needed for such purposes if there is substituted for it an ease- ment across the rear ten (10) feet of said Lot 12 and abutting Lot 13, as here- inafter set forth for drainage purposes of a more restricted nature and that upon the conveyance to the City by the owners of said prem si es of an ease- ment across the westerly ten (10) feet of said Lots 12 aid 13, that no public need will exist for the aforesaid public easement and the same may be released by proper conveyance. Section 3. That Morris Goldman and May M. Goldman, husband and wife, present owners of the said Lots 12 and 13 have proposed the exchange of their deed to such storm water and drainage easement across the rear ten (10) feet of their said lots in exchange for the release of the east -west storm sewer and drainage easement upon exchange of deeds, vit.hout a cash consid- eration. Section 4. The 1::ayor and City Manager are he reby authorized on behalf of the City to execute and deliver a Quit Claim De ed on behalf of the City%conveying and releasing to the said Maurice Goldman and May M. Goldman, husband and wife, Lot 12 upon the delivery to the City o:' a proper quit claim deed, in form of and execution approved by the City Attorney, conveyirg to the City a drainage and storm sewer easement in the westerly ten (10) feet of said Lots 12 and 13. • s •• Section 5.
