LOUIS PARK ZONING OR DINT' NCE;' DEFINING AND DECLARING AN EMERGENCY AND REPEALING SECTION 6:176.1 AND 6:177 RELATINC TO SPECIAL PERMITS FOR RESIDENTIAL UNITS . ND COMMUNITY UNIT PLANS THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. The City Council hereby declares that the emergency hereinafter defined exists and that an emergency ordinance is necessary for the immediate preservation of the public peace, health, morals, safety or welfare in accordance with Sections 3. 05, 3.06 and 3.08 of the Charter of the City of St. Louis Park. Section 2. The City Council hereby finds and determines the following facts and defines and declares the existence of an emergency as follows: 1. That Section 6:176.1 relating to Residential Units and Section 6:177 relating to Community Unit Plans in that certain ordinance numbered 730, passed December 28, 1959, entitled St. Louis Park Zoning Ordinance, contained provisions authorizing the special development of land uses pursuant to special pe:•mits for Residential Units and Community Unit Plans. 2. That at the time of the adoption of said St. Louis Park Zoning Ordinance these sections contained new and untried concepts of zoning, experimental in nature, which seemed to give promise of better and more flexible use of lands. 3. The City of St. Louis Park has had a n.imber of applications for special permits under these sections and has had enough exper- ience to evaluate the provisions and their workability. 4. Experience of the City of St. Louis Pa::k has demonstrated that in their present form such sections present difficulties of admin- istration, interpretation, legality, and planning, and this experience has further demonstrated that these sections have intrinsic merit and that it is possible through re -study, changes, and additions, to develop in a useful way the planning concepts contained in these two sections. 5. Continuation of operation under the present wording presents hazards to the public peace, health, morals, safety and welfare in that it provides incomplete and inadequate regulation and allows inaccurate and improper land uses and fails to lend adequate pro- tection to the owners of lands directly affected by owners applying under these two sections as well as adjacent ar.d abutting neighbor- ing land owners. • • • t 6. That the existence of these two section 3 in their present form poses a threat to and has an adverse affect cn comprehensive plan of the City. 7. That a repeal of these two sections pursuant to regular pro- cedures requiring two readings, publications, and a period of fifteen days before becoming effective would permit the filing of applications during a period of approximately- two months which could allow persons through error and inadvertence or through un- scrupulous motives to acquire vested rights in land uses under these sections to the detriment of land owners themselves, other landowners, and the City's comprehensive plan. 8. The City Council hereby declares that an emergency exists justifying and requiring that this ordinance become immediately effective as of the time of passage in order to prevent the filing of any applications for special permits under said sections. Section 3. That sections 6:176.1 entitled'Residential Development Unit"and Section 6:177 entitled "Community Unit Pla z'bf Ordinance No. 730, passed December 28, 1959, entitled "St. Louis Par]. Zoning Ordinance" are hereby repealed in their entirety. Section 4. This ordinance shall take effect immediately upon its passage by the City Council in accordance with Sections 3.05, 3.06, and 3.08, of the Charter of the City of St. Louis Park and shall be signed and published in accordance with Section 3.07 of the City Charter of the City of St. Louis Park.
