HomeMy WebLinkAbout866 - ADMIN Ordinance - City Council - 1962/12/261 ORIGLYAL L =.CEMBER 26, 19u2 ORDINANCE NO. 866 7F AN ORDINANCE DEFINING AND PUNISHING DIS- ORDERLY CONDUCT, BREACHES OF THE PEACE, BEGGING, LURKING, DRUNKENNESS, PROSTITUTION, PANDERING, INDECENT AND IMMORAL, CONDUCT, DISTURBANCES, AND DISORDERLY HOUSES THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. Certain Acts Prohibited. The doing of any of the following acts without authority of law by any person or persons is hereby prohibited: A Section 4:230. Begging. No person in any public or private place shall beg from strangers for money or other property, other than solicitation for recog- nized charities. Section 4:231. Public Drunkenness. No person shall be in any public place while obviously or hel?lessly under the influence of alcohol. Section 4:232. Making Unnecessary Noise. No person, in any public or private place, shall make, or assist in making, by any mariner or means, any loud, unpleasant or raucous noise or odor disturbing to others unless the same be reasot}- ably necessary to the preservation of life, health, safety or property. Section 4:233. Disturbing in a Theater. No person, during the performatice of the program in a theater, auditorium, or place of amusement, shall conduct him- self or herself in a manner which interferes unreasonably with the view or enjoy- ment of another person of the state or screen or place of activity, nor shall any person operating such theater, auditorium, or place of amusement permit such conduct. Section 4:234. Lurking. No person in any public or private place, shall lurk, lie in wait or be concealed with intent to do any mischief or to commit any crime or unlawful act. Secttun 4:235. Breach of the Peace. No person, in any public or private - place, shall engage in, or prepare, attempt, offer, or threaten to engage in, or assist or conspire with another to engage in or congregate because of, any riot, fight, brawl, tumultuous conduct, act of violence, or any other conduct which disturbs the peace and quiet of another save for participating -In a recognized athletic contest. Secticn 4:236. Exhibiting Obscene Matter. No person in any public or private place, shall prepare, exhibit, or transfer in any manner to another. or offer to so prepare, exhibit, or transfer to another, whether or not for a consider- ation, any obscene or indecent writing, picture, phot graph, drawing, design, model, or object, or have any thereof in possession with intent to transfer or exhibit. • 1 Section 4:237. Pandering. No person in any public or private place, shall secure, or offer to secure, or entice or attempt to entice, another to engage in un- lawful sexual intercourse, prostitution, or any lewd, lascivious, or indecent act; nor shall any perscn accept knowingly any part of the earnings of a female from prostitution. Section 4:238. Prostitution. No female, in any public or private place, shall offer or submit her body indiscriminately for sexual intercourse, whether or not for a consideration. Section 4:239, Indecent Conduct. No person, in any public or private place, shall engage in, or offer or attempt to engage in, or congregate because of (a) lewd, lascivious or immoral conduct, (b) the use of slanderous, foul, obscene or indecent languagci, (c) the indecent or lascivious exposure or use of the human body, or any part thereof, or (d) behaviour, whether by words or acts, of a nature to corrupt the public morals or to outrage the sense of public decency. Section 4:240. Participating in a Disorderly House. No person shall own, lease, operate, maintain, reside in, visit or entice or attempt to entice another to reside in or visit, any building, or place with knowledge that unlawful sexual intercourse, • prostitution, lewd, lascivious or indecent acts, gambling, or the unlawful sale of in- toxicating liquor or non -intoxicating malt liquor occurs therein. Evidence of the 0 general reputation of such a building or placeras one where any of the foregoing occurs shall be prima facie evidence of such knowledge. Section 4:241. Profanity and Obscenity in Public Places. No person shall in any public place use any profane or obscene language or gestures to or in the pre- sence of another or to the annoyance of other persons in such public places. r Section 4:242. Definitions. Where used in this ordinance, the following words shall have the following meanings: a. Public Place. The words "public place" shall include streets, alleys and sidewalks dedicated to public use and shall also include such parts of buildings and other premises whether publicly or privately owned which are used by the general public, or to which the general public is invited commercially, for a fee, or otherwise, or in or on whi&i the 3eneral public is permitted without speci:ic invitation. b. Person. The word "person" shall include individuals, firms partnerships, corporations, clubs, associations, and organizations, and shall further include officers, agents, and employees thereof. Section 2. If any part or section of this ordinance shall be held invalid by a court of competent jurisdiction, such judgment or declaration of the court shall not invalidate or affect any other portion or section of the ordinance. -2- ei Section 3. Any person violating the provisions of this ordinance shall be guilty Sof a misdemeanor and upon conviction shall be punished by a fine of not more than one huadred dollars and costs of prosectuion or by imprisonment for not to exceed ninety days. Section 4. Effective Date. This ordinance shall take effect fifteen days after its publication. Adopted by the City Council December 26x,962.
