LOUIS PARK ORDINANCE CODE RE- LATING TO FOOD ESTABLISHMENTS WHICH SECTIONS ARE NUMBERED AND ENTITLED "RESTAURANTS, CAFES, AND LUNCH ROOMS, SECTION 2:1801 DEFINITIONS, Si;CTION 2:1802 LICENSE REQUIRED, SECTION 2.1803 APPLICATION, SECTION 2:1804 FEES, SECTION -2:1805 EXAMIN- ATION AND CONDEMNATION OF UNWHOLESOME OR ADULTERATED FOOD OR DRINK, SECTION 2:1806 INSPECTION OF RESTAURANTS, SECTION 2:1807 SANITATION REQUIREMENTS, SECTION 2:1808 DISEASE CONTROL, VECTION 2.1809 PROCEDURE WHEN INFECTION SUSPECTED, SECTION 2:1810 ENFORCEMENT INTERPRETATION" THE CITY OF ST. LOUIS PARK DOES ORDAIN: SECTION 2:1800 - DEFINITIONS Section 2:1800. 01. Definitions. The following definitions shall apply ini the into rnretation and enforcement of this Ordinance and the following words and terms Arlie reeve r they occur in this Ordinance are defined as follows: Section 2:1800. 03. Adt.lterated Food shall mean any food which consists in whole or in part of any filthy, putrid, decayed, or decomposed substance, or consist:; in whole or in p:.rt of the product of a diseased animal which -has died by ace:: cnt. disease, or otherwise than by slaughter; contained in an immediate package° which is composed of any poisonous or deleterious substance which may ender the contents injurious •o health; bears or contains any poisonous or de- cte rious substance which may be injurious to health, provided, however, if such food bears or contains poisonous or deleterious substance added thereto or found therein for which a safe tolerance or standard has been established by lawful regu- lation, or lay., such food shall not be adulterated food if such deleterious substances are :ot in excess of such tolerance or standard. Section 2:1800. 05. Bakery Food Vehicle shall mean any food vehicle used to transport bakery goods about the streets of the City for the purpose of sale of slicli tools from door to door. Section 2:1800. 07. Catering Food Vehicle shall mean any food vehicle us. d to transport any food from its point of preparation to a point where the food s sc rv;; ' from the vehicle to she consumer, or any food vehicle wherein food is pr_narc:: for sale or service tD the consumer. Section 2:1800.09. Clean shall mean free from physical, chemical, and zic rob�al substance :lisce rnible by ordinary sight or touch, by ultra -violet light, by artificial lsght, and the 321ra-cane-o dye test and free from insects, vermin, and zeD r:s. SLcti:n 2:1800. 11. Emoloycc shall mean any person who renders a per - s anal sz rvic.:. with or without compensation, within a food establishment. Section 2:1800. 13. Food shalt mean any raw, cooked, or processed sub- stanc::, beverage, or ingredic A used or intended for use in whole, or in part, for humin consumption. The tem "food" shall further include, but not be limited to, ice :tn:1 water. Section 2:1800. 15. Food Contact Surfaces shall mean those surfaces ol the equipment and utensils with which food normally comes into contact and surfaces .with which fool may come in contact, except by spill, and sur- faces •.vhich drain back onto s.irfaces in contact with food. Section 2:1800. 17. 'ood Establishment shall mea_ any building, room, stand, enclosure, veh• cle, space, area, or other place wherein food is s-orcd, prepared, manufactured, processed, wrapped, canned, packed, bo::led, transported, distributed, sold or offered for sale or served in any ‘‘al- w_:h or without charge, except private homes. Section 2:1800. 19. Food Vehicle shall mean any food establishment cons:cting of a mobile vehic1: which hauls any food for the purpose of delivery or salc. Section 2:1800.21. Health Authority shall mean the City Health Officer of the City of St. L•o•:xs Park, or his authorized renresentative. Section 2:1800. 23. Horne Prepared Food shall mean any food which has b -eh processed or prepa red in a private home not licensed under this Ordinance. Sec:)un 2:1800.25. Itinerant Food Establishment shall mean a food cs�:bl:Sh Hent operating for a temporary period, including, but not limited to, fa:r, carnival, circus, church supper, or public exhibition. Section 2:1800.27. Misbranding shall mean the use of any written, pr•:,tcc' cr graphic matter upon or accompanying products or containers of foot!, •.01- :1, violates any applicable local, State, or Federal labeling require - Section 2:1800.29. Perishable Food shall mean food such as b... lands, oran•ys, grapefruit, lettuce, carrots, beans, radishes, onions, pc:atoes, and otht.r foods which will decompose in the absence of refrigera- ::�•:. The enumeration herein of specific items shall be for purposes of :llu.tra tion, rind shall not he deemed to be a limitation upon the meaning of the term il!c,trated thereby. Sec:ton 2:1800. 31. Person shall mean any individual, firm, partner - sl -:r., corporation, trustee. or association and with respect to acts prohibited o: requirc,c1 herein, shall .nclude employees and licensees. Section 2:1800. 33. Readily -Perishable Food shall mean any perish- b1c.:roc: consisting in whole or in part of milk, milk products, eggs, meat, fisi•, poultry, or any other food capable of supporting rapid and progressive crow trof micro-organisms which can cause food infection or food intoxication. Section 2:1800. 37. Readily -Perishable Food Vehicles shall mean any food vehicle, except gate rir g food vehicles and bakery food vehicles, which is used to transport readily-pl:rishable foods as herein defined within or into the City of St. Louis Park for celivery therein. Section 2:1800. 39. Retail Candy Shop shall mean a food establishment where unwrapped candy, not manufactured therein, is sold or offered for sale to :he consumer. Section 2:1800. 41. Retail Candy Outlet shall mean a food establish- ment where wrapped candy is sold or offered for sale, not through a vending machine, to the consumer. Section 2:1800.43. Safe Water shall mean water which is not adulter- ate 1 and which is free from pathogens and coliform organisms. lection 2:1800. 45. Safe Water Supply shall mean a source of safe ..:ter from either the muni.:ipal water system or a source of water, the oper- ation, location, and construction of which have been approved by the Minnesota St; `e, uard of Health. Section 2:1800.47. Single -Service Utensils shall mean all utensils •wh_ch arc meant to be used only once and then discarded. Section 2:1800. 49. Smooth shall mean having an even surface free of chips, open seams rust, corrosion, breaks, pits, checks, and ridges. Section 2:1800.51. SECTION 2:1804 - LICENSE AND FEE EXEMPTIONS :.cction 2:1804.01. Fee Exemptions, License Required. Food services in governmental subdivision:, charitable institutions, Houses of Worship, homes for thz aged, child-care-horr:es, schools, charitable and non-profit hospitals, and er^_^l=yee coffee shops, shall be required to apply for and obtain a license, but shall :-ct be charged a fee th4:refore, but shall be subject to all other requirements of this Ordinance. SECTI N 2:1806 - LICENSE PEE:. acctzon 2 1806.01. Liccnsc 7eus. Fees for licenses issued hereunder forth herein. S...cticn 2 1806. 03. Feed : stablishment License Fees. The annual license ee for each food establishm.:nt, except catering food vehicles, bakery food Pace 6 vehicles, readily -perishable food vehicles, retail candy outlets, and retail candy shops, shall be $25.00, provided, however, that if more than one facility, such as, but not limited to, kitchen, bar, bakery, meat market, grocery store, delicatessen, which would require food establishment licenses if operated separ- ately-, shall be located on the same premises, the license fee shall be an additional $. 00 fcr each such facility in addition to the $25.00 for the first such facility. Scction 2:1806. 05. itinerant Food Establishment. The license fee for each itinerant food establishment shall be $15.00. ection 2:1806.07. Retail Candy Shop License. The annual 'license fe fcr retail candy shop shall be $15.00, provided, further, that if the candy shop is cperatcd in conjunction with another facility, as provided in Section 2 1l0G. 3, the retail candy shop shall be an extra facility and a charge of $5,-00 be added to the basic cost of the food establishment license. Section 2:1806.09. Retail Candy Outlet License. The annual fee for _ a retail candy outlet shall ie $5.00, provided, further, that if -the retail candy outlet is operated in conjunction with another facility requiring licensing under this Ordinance, the retail sandy outlet shall not be required to obtain a license. is)Section2 1806. 11. Readily -Perishable Fcod Vehicles. The annual lic�nsc fee for each readily -perishable food vehicle shall be '$5.00 per vehicle fcr such vehicles not licensed under Section 2:1806. 13, fleet vehicles. Section 2.1806. 13. Readily Perishable.Food'Vehicles. - Fleet License. Thi annual license fee for a fleet of one or more readily -perishable food vehicles shall be S15.00. Section 2.1806. 15. Bakery Food Vehicle License Fee. The annual lac=nse fee fcr each bakery food vehicle shall be $15.00 per bakery food vehicle. Section 2:1806. 17. Catering Food Vehicle License Fee. The _annual license fii:: for catering food vehicles shall be $100.00 for each vehicle owned or operated by the licensee in the City of St. Louis Park. SECTION 2:1808 - E.DMINICTRATION Section 2:1808. 01. Application, Issuance, Maintenance, and Administration. The application for such licenses shall be made on forms furnished by the City via nager :incl shall srt forth the general nature of the business, the location, and such other information as the City Manager shall require, and such application and issuance of such licenses and their maintenance, termination, and admini- stration shall be in accor.iancc with and subject to all conditions of Section 2:1 0 thrr:trh Section 2:17, both inclusive of the St. Lour Park Ordinance Code relative to general requirements for issuance of licenses of the City of St„ Louie Par:-.. • • • • .t Page 7 SECTION 2:1810 - INSPECTION AND CORRECTION Section 2:1810.01. Inspections Outside the Corporate Limits of the City of St. Louis Park. The Health Authority may inspect food establish- n:itnts situated outside the: corporate limits of the City of St. Louis Park which s, 11 cr offer for sale, or distribute any food to persons licensed under this Ordinance by the City of St. Louis Park. The fees for such inspections shall be equal to the total of the actual cost of salary paid the Health Authority by the City of St. Louis Park for the number of hours necessarily spent in each such inspection, and the cost of transportation incurred or expended by the Health Authority for milez:ge at the rate of 7 cents per mile actually traveled from the City Hall or last place of inspection, whichever is less, and returning to the City Health Department at the St. Louis Park City Hall. The City Health Authority shall report cost of such inspections to the Director of Finance who shall render statemerts for such inspection costs to the licensee who ob- tains food from such source outside the City limits and the licensee shall within ten days pay the amount claimed in the statement to the City of St. Louis Park. Such inspections shall not be made unless authorized by the City Manager. In • lieu of making inspections beyond the corporate limits of St. Louis Park, the Health Authority may acce?t the reports of other governmental food inspection agencies. Section 2.1810.03. Inspection of Food Establishments. The Health Authority shall inspect every food establishment as frequently as he may deem necessary to insure compliance with this Ordinance. a.:ction 2:1810.05. Posting. Each inspection report shall be posted by the Health Authority upon an inside wall of the food establishment, not in a public arca, and such inspection z epc.rt shall not be defaced or removed by any person, ;;xccpt the Health Authority. The posting of the inspection report upon the inside wall of th.: food establishment shall constitute service of an official notification of the. inspection by the Health Authority. The Health Authority may, in lieu of post - such report, deliver it .:o tho licensee or his authorized agent. Another copy of the inspection report shall be. filed with the records of the Health Department. Section 2.1810.07. Access to Premises and Records. The person operating the food establishment shall, upon request of the Health Authority, per- mit .:cC.. ss to all parts of ti-.: establishment at ar.y reasonable time for purpose of in .pectior. and shall exhibit and allow copying of any records necessary to aseer- t :i,i .ourcc.s of foods. The length of time for the correction or r;.nioval of each such violat: on shall be noted on the inspection report. The failure to remove or correct each such violation within the time period noted on the inspection report shall constitute a separate violation of this Ordinance. SECTION 2 1812 - EMBARGO, EXAMINATION, CONDEMNATION AND TAGGING Section 2:1812.01. Embargc, Examination, Condemnation and Tagging. Samples of food may be emtargoed and examined by the Health Authority as cft2n as may be necessary fir the detection of unwholesomeness or adulteration. Equipment and utensils, which do not meet the requirements of this Ordinance, may be embargoed, provided, that such equipment and utensils shall be released from the embargo upon notification of the Health Authority by the licensee and after inspection of such utensils and equipment by the Health Authority. The Health Authority may condemn and forbid the sale of, or cause to be removed or destroyed, any food which is unwholesome or adulterated, unfit for human" consumption, or otherwise prohibited by the City Ordinance or State or Federal Law. The Health t.uthority may condemn and cause to be removed any equip- ment, clothing or utensils f,)und in a food establishment, the use of which would not comply with this Ordina-ice, or which is being used in violation of this Ordinance; and also may co -idemn and cause to be removed any equipment, clothinn, or utensils which bf reacon of dirt, filth, extraneous matter, insects, corrosion, open seams, or chipped or cracked surfaces is unfit for use. The Health Authority may place a tag to indicate the embargo or the condemnation upon such food, equipment, utensils, or clothing. No person shall remove such tag,except under the direction of the Health Authority. Section 2:1812. 03. Transport or Sale, Unhealthful Food Prohibited. No person shall transport vtithin or into the City of St. Louis Park, sell or off::r for sale or hold in att,!mpt to sell in the City of St. Louis Park any food which is not wholesome or •x•hich is adulterated. Suction 2.1812.05. Transport or Salc, Noise Prohibited. No per- son, licensed under this Ordinance, shall call attention to his business or to his ;roc.);';,, wares, or merelandise, by crying them out, by blowing a horn, by ringing a bell, or by any load or unusual noise. SECTION 2:1814 - ITINERANT FOOD ESTABLISHMENTS .S,ction 2 1814.01. Itinerant Food Establishments. Itinerant food 0 .:st2b11shm. nts shall comply with all the applicable provisions of this Ordinance, anv shall be constructed and operated in an approved manner, provided, that 0 s-:..cific requirements for physical facilities may be waived by the Health Page 9 Authcrity when suitable substitutes, which, in his opinion, will not result in an imminent health hazard, ht:ve bccn provided. Before commencing operations of any kind, the licensee hereunder shall notify the Health Authority that such food establishment is read' for final inspection, and the Health Authority shall immediately make an inspection and issue a report thereon, and no itinerant food .establishment shall commence operations until the requirements of this Ordi- nance have been met in accordance. with the Health Authority's final inspection reports. SEC I'ION 2:1816 - FOOD SOURCES :Section 2-1816.01. Sources of Food - General. All food in all food establishments shall be clean, wholesome, free from spoilage, adulteration, and misbranding, and shal. be prepared, processed, handled, packaged, trans- ported, and stored so as to bc protected from contamination and spoilage and shall be safe for human consumption. No home -prepared foods shall be kept or used in any food establishment, except that home prepared foods other than readily-per- ishablc foods may be kept Dr used in schools and Houses of Worship. All food received or used in all food establishments shall be from sources approved by the Health Authority. Section 2.1816.03. Source. of Dairy Products. Milk ,and fluid milk products shall be Grade "A" and shall be served to the consumer in the indi- vidual unopened original containers in which they were received from the dis- tributor, or served from 2_ bulk container equipped with a sanitary dispensing device, provided, howevez, that cream, whipped cream, or half and half may be poured from an opened original container for use or service on the premises, provided, further, that milk served at hospitals and -institutions may be served from one -quart or two-qua.rt containers packaged at a milk plant, and mixed mill: drinks requiring less than onc-half pint'of milk may be poured from one - quart or two -quart containers packaged at a milk plant. The dipping or ladling of 1-rilk is prohibited, except for immediate cooking purposes, provided, further, that this section shall not apply to manufacturing or processing food establish- ments which make no sale; at retail nor direct sales to consumers. Zection 2:1816.05. Source of Shellfish. No person shall have or keep in any food establishment any oysters, clams, mussels, or other shellfish from a source v.hich has not been approved by the Minnesota State Board of Health or if th, source is outside the state, from a shipper whose name is not on the current list of State Certified Shippers, issued by the Public Health Service, and such ap- proval shall be evidenced by official stamp on the container. Shucked shellfish shall bc kept .n the origin.:1 container until used. Oysters, clams, mussels, and other shellfish, if served on the .shell, must be served in the original shell. Section 2:1816. 07. Source of Meat. All meat and meat products received, kept, or used in any manner in any food establishment shall be offictalrly identified as having bccn inspected for wholesomeness under the super- vision of a licensed veterinarian, and any such products upon which any such offic tal identification is lcst by reason of the processing thereof shall be iden- tified by the name and location of the processor thereon. Pat;c 10 - Section 2:1816.09. Source of Poultry. All poultry and poultry meat pro- ducts shall be clean, wheler.ome, free from spoilage and adulteration, and shall b; processed in a food establi:,hm::nt meeting the requirements established by state laws, rules and regulations, and shall be approved by the Health Authority. .action 2:1816. 11. Source of Frozen Dairy Foods. All frozen dairy foods, such as, but not limited to, ice cream, frozen custards, ice milk, milk sherbet, fruit or ice sherbet, and frozen malted rntlk, shall meet applicable stat:. laws, rules and regulations. SECTION 2:1818 - FOOD PROTECTION Section 2:1818.01. Food Protection. After delivery and while being stored, prepared, displayec., served, or sold in food establishments, transport- i.C: between such establishments, all foods shall be protected against contamina- tion from work surfaces which are. not clean, utensils which have not been given bactericidal treatment, unni:cessary handling, flooding by sewage or drainage, cou3hs, sneezes, overhead leakage, dust, flies, insects, rodents, and other . crmin, cr any other sourct: of contamination. All perishable food shall be stored at such temperatures as will protect against spoilage, and all readily - perishable foods shall be kept at or below 40 degrees F. or at or above 150 zlc:;rees F., except during reparation. Frozen food shall be kept at or below G 'agrees F. Poultry and pork shall be thoroughly cooked before being served. Inc��vi��ual porticns of food once served to the customer shall not be served again, provided, that wrapped folds, which have not been unwrapped and are still whole- some, may be re -served. The requirements for temperature, for the storage, for the display, and for the food protection against contamination as contained in this Ordinance shall apply in the transporting of food from a food establishment or other location to another focd establishment or other location for delivery, ser- vice, c.r catering operation:. :.ection 2:1818.03. Toxic iviaterials. Poisonous polishing materials ar; specifically prohibited in all arias used in connection with food establish- rn,:nt operations, and only such other toxic materials as are, required for sani- ta rs r aticns may be pre _ant in such areas. Toxic - materials shall be obtain - c -1, identified, stored, and used only in such manner and under such conditions as v'111 not contaminate food or constitute any other hazard to man. SECTION 2:1820 - PERSONNEL S. stun 2 1820.01. Health and Disease Control. If the man- aner, ,'wner, or operator of the establishment suspects that any employee has contracted any disease in a communicably_ form, or has become a carrier of tscasc, he shall no::ify the Health Authority immediately. Section 2:1820.03. Cleanliness. All persons shall wear clean outer ga rincnts, maintain a high degree of personal cleanliness, and conform to hygienic practices during all periods of duty. Hair nets, head bands, caps, or other hair restraints shall be used to keep hair from food, utensils, and equip- ment. All persons shall wash their hands thoroughly in an approved handwash- Inr• facility before. starting work, and as often as may be necessary to remove soil and contamination. No person shall resume work after visiting the toilet room without first washing his hands. Section 2:1820.05. Tobacco. The use of tobacco in any form by per3ons engaged in handling, preparing, or serving food, or cleaning utensils and equipment, in a food. establishment is prohibited at all times when such person:, arc on duty for such work, provided, that, designated locations may be approved by the Heal:h Authority for smoking. SECTION 2:1822 - EQUIPMENT AND FACILITIES PROVIDED Section 2:1822.01. Required Equipment. Every food establishment shall he provided with Equipment, applicable to the operation therein conducted, which is so designed, constructed, installed, located, and maintained as to per- mit full compliance win the previsions of this Ordinance. All equipment instated on or after the passage of this Ordinance shall com- ply with Standards 1, 2, 3. 4, 5, 6, and C-1 of the National Sanitation Foundation when applicable, which numbered standards are hereby adopted and incorporated herein by reference and three marked official copies of said numbered standards shall be kept on file by the City Clerk. Equipment not covered by such standards shall not be installed befo:-e it has been approved by the Health Authority. Single -service utensils shall have been manufactured, packaged, trans- port,:_?, stored, and handled in a sanitary manner. SECTION 2:1826 - CLEANING, BACTERICIDAL TREATMENT AND STOF.AGE OF UTENSILS AND EQUIPMENT Section 2:1826.01. dept Clean - General Requirements. All uten- sils and equipment shall be thoroughly cleaned, and food contact surfaces of utensils and equipment shall be riven bactericidal treatment and shall be stored • in such a manner as to be protected from contamination. Section 2:1826.03. Hot Water Method. This method of bactericidal 111) treatment shall consist of immersion for at least two minutes in clean, hot water at a temperature of at least 170 degrees Fahrenheit or for 1/2 minute in roiling water. A thermometer shall be kept in a convenient place near the facilities, for checking the water temperature. Pouring or spraying water ev.2r washed utensils or squipment is prohibited as a means of bactericidal treatment, except in a spray cabinet or an automatic dishwasher. Water used for bactericidal treatment of utensils and equipment shall at all times during busines; hours be kept at a temperature of at least 170 degrees Fahru h.:it, and at all other times while utensils and equipment are being wash:.:1 and given bacter:cida1 treatment, the water shall be kept at a tempera - tun. cf at least 170 degrees Fahrenheit. A three -compartment sink shall be with the first compartment for washing, the second compartment for rinsing, and the third cempartmcnt for immersion in water at a temperature o< at l;.ast 170 degrees Fahrenheit. Ut,..n;,ils and equipment t hall be placed in racks or on ccnveyors in such a way that all foci' contact surfaces shall be subjected to unobstructed wash and rinse water spraysi, Detergents of a concentration which will render utensils and equipment clean shall be used at al times in the wash water. Wash water temperatures sa-_11 b, at least 140 deg -ccs Fahrenheit, except in single tank conveyor type machines in which the w.:sh water temperature shall be at least 160 degrees Fahrenheit. Flow pressure of rinse water shall be maintained at all times at not less than 15 pounds nor more than 25 pounds per square inch. Recirculated rinse v.atc.r shall be maintained at a temperature of at least 170 degrees Fahrenheit. The tcrnp c rature of the final rinse water shall be at least 180 degrees Fahren- heit at the entrance of the rinse spray arms of all machines while dishes are beim:; washed. A recirculating line shall be provided between the hot water heat_ r and the -automatic dishwasher if the Health :Authority deems it necessary ir: for the licensee to comply with the required water temperatures. Thermometers, which will accurately indicate the temperature of the wash and rise water. shall be 1 r(ivided on all machines. Sccticn 2:1826.09. Oven Utensils and Equipment. Utensils and vqL:;:ment which routinely go into ovens for baking purposes and which are :1 for no c,ther purpose shall not be required to be given bactericidal treat- rn..�t, ;;rc.vic;c d, howeve -, such utensils and equipment must be clean. Sccticn 2:1826. 11. Large equipment and Utensils. Any other procedure or process may be used, provided the licensee shall submit to the Health Authority evi- dence showing in detail -the procedure or process and the effectiveness thereof, and, provided, such methods are approved by the Health Authority. Section 2:1826. 15. Storage. Equipment and utensils after bacteri- ci:' :1 treatment, shall to stored in a clean, dry place protected from flies, ane.other contamination, and shall be handled so ato prevent contamina- tic::. Wet cold -storage of glasses or similar utensils 'is prohibited. All under ceuntcr utensil storage compartments less than 18 inches from the floor shall tc enclosed and shall be kept encicsed except during times of meal service. Enclosed automatic utensil elevators shall be accepted. Cups and glasses stcrc 1 on shelves shall be inverted. -Rack or tray stacking of glasses is accepted. Shelving shall be protected by easily cleanable, non-absorbent materials, paint, varnish, or equivalent. ::cction 2:1826. 17. Storage - Ice Cream Dippers. Running -water di; -;-c r wells connected tc, a safe water supply and to the municipal sewerage system shall be provided for ice cream dippers and scoops at all locations or staticns where bulk ice cream is dispensed. This requirement shall not apply in thosr: situations where ice cream is being served at a temporary location, h. wJer, 3n such cases, containers of water used for ice cream dippers and scor_p s shall have the water therein changed at least every twenty minutes. Ice shall handled and transpor:ed in single -service containers, or in utensils which arc clean and which have been subjected to bactericidal treatment. Buckets, scoops, and ice containers, unless they are single -service utensils, shall be ma:_lti of a smooth, impe:-vious material, and designed to facilitate cleaning. They shall be clean at all times. Canvas containers shall not be used. If ice - crush,. rs are used, they should be easily cleanable. They shall be maintained 1r a clean condition and shall be subject to bactericidal treatment and shall IN.-. covered when not in t.se. SECTION 2:1830 - SEWAGE Secticcn 2:1830.01. Sewage Disposal. All water -carried sewage shall �c disposed of by means of the public sewerage system of the City of St. Lcui ; Park, provided, however, on food vehicles, which dispose of their liquid •c::zt, into receptacles carried on the vehicle for that purpose. This waste ul- tirna tely :.hall be discharged into the public sewerage disposal system. SECTION 2:1832 - PLUMBING S.:ction 2:1832.01. Plumbing shall be so sized and installed and maintained as to carer adequate quantities of water to required locations thrcu3hout thc. establishment: prevent contamination of the water supply; con - sewage and liquid wastes adequately from the: establishment to the sewer - system, and so that it does not constitute a source of contamination of food, ut.::tsils, or equipment, or create an insanitary condition or nuisance. Food service equipment, such as refrigerators, dishwashing machines, ice makers, and steam tables, shill not be directly connected to the sewer. ® Page 16 SECT3.ON 2:1834 - TOILET FACILITIES Section 2:1834.01. Toilet Facilities. Every food establishment with the exception of food vehicles shall be provided with conveniently located and approved water flush toilet facilities which are kept clean and in good re- pair and free from flies, insects, and offensive odors. Toilet fixtures and scats shall be of sanitary design and readily cleanable. The doors of all toilet roor_-is shall be self-closirg. Easily cleanable receptacles shall be provided for waste materials. When toilet facilities are provided for patrons, such facilities shall meet the requirements of this item. , SECTION 2:1836 - LAVATORY FACILITIES Section 2:1836.01. Lavatory - Required Equipment. Every food establishment, other than itinerant food establishments and food vehicles handling only pre-packaged food or which transport meat in the manner pro- vided by state law or regulation, shall be provided with adequate, conveniently located, and approved lavatory facilities with hot and cold running water, 1111 hand cleansing compound, and sanitary towels_or hand -drying devices, provided, that, in all new, or extensively altered food establishments, handwashing • facilities shall be provided within all areas where food is prepared. SECTION 2:3.838 - GARBAGE AND REFUSE DISPOSAL Section 2:1838.01. Garbage and Refuse Disposal. All garbage and refuse shall, prior to disposal, be_:ept in tight non-absorbent containers which shall be kept covered with close -fitting lids when filled, in st^rage, or not in continuous use, provided, that such containers need not be covered when stored in special insect and rodent -proofed roam or enclosure or food waste refriger- ator. All other refuse shall be stored in containers, rooms, or areas in an approved manner. The rooms, enclosures, areas, and containers used should be adequate for the storage of all garbage and refuse accumulating on the prem- ises. Adequate cleaning facilities shall be provided, and each container, room, or area shall be thoroughly cleaned after the emptying or removal of garbage and refuse. Food waste grinders, when installed, shall comply with the,ph:rnb- inc ordinance. All garbage and refuse shall be disposed of with sufficient frequency and in such a manner as to prevent a nuisance. SECTION 2:1840 - INSECT AND RODENT CONTROL Section 2:1840.01. Insect and Rodent Control. Effective measures shall be taken to prevent the entrance, breeding or presence on the premises of flies, roaches, insects, rodents, and all other vermin. • 0 • e. Paas 17 SECTION 2:1812 - FLOORS, WALLS AND CEILINGS Section 2:1842.01. Floors, Walls and Ceilings. The floor sur- faces in kitchens and in all other rooms and areas in which food is stored or prepared, utensils are washed or stored, or garbage or refuse is stored, and in toilet rooms, dressing or locker rooms, and walk-in refrigerators shall be of smooth, non-absorbent materials, and so constructed as to be easily clean- able, provided, that the floors of dry food, non -refrigerated, storage areas nee' not be non-absorbent. All floors shall be kept clean and in good repair, and thL_ use of sawdust and similar material shall not be permitted. These re-' - guir;.rnents do not prevent the use of rugs and carpets in dining rooms and hall strays, provided, that, such floor coverings are 'kept 'clean. Abrasive strips also inay be used wherever deemed necessary to prevent accidents. Floor drains shall be provided in all rooms where floors are subjected to flooding- , typ; cleaning or where normal operations release or discharge water or -other, 1:quid' wastes on the floor. The walking and -driving surfaces of all exterior areas where food is serves shall,be kept clean, properly drained, and finished so as to facilitate maintenance and minimize dust. The walls and ceilings of all rooms shall be kept clearr'and in good re- pair. rill walls of itooms or areas in which food is prepared, or utensils or hands washed, shall have easily cleanable, smooth, light-colored, washable surfaces up to the highest 1.evel reached by splash or spray. SECTION 2:1844-- LIGHTING Section ?:18,I4.01. Lighting. All areas in which food is prepared or stored, or utensils are washed, handwashing areas, locker rooms, toilet rooms, and garbage and refuse storage areas, shall be well lighted. All work- ing surfaces shall be illuminated at not less than 20 foot-candles of light. At least 10 foot-candles of light shall be provided on all other surfaces and equip- ment. In storage areas, a minimum of 5 foot-candles of light, thirty inches from the floor shall be provided. 'Subdued lighting in dining rooms and public access k rens is acceptable, provided, that lighting meeting the above require- ments shall be available di..ring all clean-up periods in dining rooms and access -areas. SECTION 2:1846 - VENTILATION Section 2.1846.01. Ventilation. Dressing rooms or sttch designated areas shall be equipped with lcci:crs. Dressing rooms and lockers shall be kept neat and clean. SECTION 2:1350 - HOUSEK2EPING Section 2:1850.01. Housekeeping. All parts of the food establish- rn_ ::t and its premises shalt: be kept neat, clean, and frca of litter and refuse. Cleaning operations shall b:t conducted in' such a manner as to minimize con- tamination of food and food contact surfaces. , None of the operations connected with a fool establishment shall be conducted in any room used as 'living or sleep- inz quarters. Soiled linen:, coats, and aprons shall be kept in approved con- ta incrs until removed for laundering. No live birds or animals shall be allowed in any area where food is prepared, stored, or served, provided, that, guide `ccs a,ccompanying blind persons may be permitted in food•establishments. SECTION 2:1052 - !ENFORCEMENT PROVISIONS Section 2:1852.01. Procedure When Infection is Suspected. When sus1.icicn arises as to the possibility of disease transmission from a food es- ta::lishment owner or employee, the Health Authority is authorized to require ,any :r all of the following measures: 1. The immediate exclusion of such person from all f r d establishments. 2. The transfer of the services of such person to an the food est tblishment where there would be no danger transmitting :disease. 3. The •:equi rement of adequate medical examinations of such persons an:_ their associates, with such laboratory ex- aminations as may be indicted. 4. The Immediate closing of the food establishment until no further danger c•f disease outbreak exists in the opinion of the Health Authority, is.nd the City Manager. fl - 1 • Page 19 Section 2:1852.03. Industry Self -Inspection. Every food establish- ment shall arrange for a program of sanitation self -inspection conducted by the owner, manager, sanitation supervisor, or an agent. Such inspections shall be kept on file for review by the Health Authority. Section 2:1852.05. Construction - Plan Review. All persons who hereafter construct, extensively remodel or convert buildings or facilities for use as food establishments, shall conform and comply in their construction, erection or alteration wi•:h the requirements of this Ordinance. Plans and specifications for such construction, remodeling or alteration which shall show layout, arrangement and plumbing and construction materials of work areas, and location, size and type of equipment and facilities, shall be filed by its owner in the office of the Health Authority. The St. Louis Park Depart- mant of Protective Inspection shall not issue a building permit for a food'es- tablishment or remodeling or alt3ration permit for such establishment until such permits shall have the approval of the Department of Health -endorsed thereon. Section 2:1852.07. Revocation of License. The license of any food establishment required .finder this Ordinance may be revoked in the manner provided in Sections 2:15 and 2:16 of the Si. Louis Park Ordinance Code on the grounds therein provided upon conviction"of violation of any provision of this Ordinance. Section 2:1852.09. Interference with, or Hinderance of, Health Authority. No person shall interfe-•e with or hinder any Health Authority in the performance of his duties under this Ordinance or the laws of the Ctate of Minnesota, nor prevent his performance thereof. Section 2:1852. 11. Temporary Suspension of License. The Health nathority with the approval of the City'Manager shall immediately suspend the license of any food establishment for the violation of any terms of this Ordinance if such violations constitute an imminent public health hazard. Upon notification by the: Health Authority of a temporary suspension of license by posting of his re- port as set forth in Section 2 ]810.05 at the time of the inspection, the licensee snoll forthwith cease o?eration. The licensee may appeal the temporary suspen- sion :11 writing to the City Council in the manner prescribed in Section 2:15 and Scctior. 2 16 of the St. Louis Par!. Ordinance Code. Upon notification in writing by the license. to the Health Authority that all violations have been corrected, for wr.ich temporary susp: nsion was invoked, the Health Authority shall re -inspect the food c:.tablishmcnt within a reasonable length of time. If all violations con- stituting the grounds fc,r the temporary suspension have been corrected, the Health Authority shall forthwith terminate the suspencien. ti Page 20 The Health Authority and the City Manager shall not suspend a license if the ti iolation or violations wi ich constitute an imminent public health hazard can be eliminated or removed by embargo or condemnation as provided in Section 2:1812.01. SECTION 2:1854 - SEPARABILITY Section 2:1854.01. Separability. Should any section, subdivision, clause.. or other provision of this Ordinance be declared by,a court of competent jurisdiction to be invalid such decision shall not affect the.validity of the Ordinance as a whole nor of any part thereof other than the part so declared to be invalid. - SECTION 2:1856 - REPEALS, PENALTY AND EFFECTIVE DATE Section 2:1856.01., Repeals.
