HomeMy WebLinkAbout743 - ADMIN Ordinance - City Council - 1960/03/28Original 3/17/60 MARCH 21, 1960 01/ ORDINANCE N. 743 ORDINANCE ESTABLISHING CONSTRUCTION CODE ADVISORY COMMISSION AND DEFINING ITS DUTIES THE CITY OF ST. LOUIS PARK DOES ORDAIN: Section 1. The Building Construction Codes Advisory Commission is hereby established as follows and its duties defined as follows: Section 1:135 - Membership and Terms. The Building Construction Codes Advisory Commission shall consist of five members who shall be qualified by training and experience to pass upon matters pertaining to building construction, who shall serve respectively for the following terms, and until their respective successors are appointed and qualified. Initial appointments shall be for terms as follows: one for one year, one for two years, one for three years, one for four years, and one for five years, for the first five appointed, and all subsequent appointments shall be for terms of five years each. They shall be appointed by the Mayor with the approval of the City Council, and their terms shall run until the 31st of December of the year in which their terms expire. In the event of a vacancy the Mayor with the approval of the Council shall appoint a person to complete the unexpired term. A member of the Commission may be removed with or without cause by the Mayor with the approval of the City Council. The Fire Chief of the City of St. Louis Park shall be a non-voting member of the Board. The Building Inspector of the City of St. Louis Park shall be a non-voting member and shall act as Secretary of the Board. Section 1:136 - Organization. The Commission shall elect ite own chairman by vote of its members and shall provide its own rules and procedure, determine date and time of meetings, and call public hearings when necessary and desirable. The Commission shall render all recommendations and findings in writing and shall file the same with the City Manager for reference to the City Council and Building Inspector. No member of the Commission shall pass upon any question in which he is directly or indirectly interested. Section 1:137 The Building Construction Codes Advisory Commission shall have the following powers and duties. (a) To hear and recommend proper action to the City Council on appeals from any order, requirement, permit, decision or refusal or determination made by the Building Inspector, under the Building, Plumbing, Heating, Gas Piping, Electri- cal Code Ordinances, and from any interpretation of the text of the said Ordinances, made by the Building Inspector. es 0 Page 2. DJ. 7 '3 (b) To study and review new types of materials, methods and construction, and to advise the Building Inspector and the City Council as to the suitability of alternate materials and types of construction to assist in progressive development of the provisions of the Building, Plumbing, Heating, Gas Piping and Electrical Codes of the City of St. Louis Park, and to make recommendations relative thereto. (c) To study and review from time to time the Building, Plumbing, Heating, Gas Piping and Electrical Codes of the City of St. Louis Park and similar code provisions applicable in communi- ties surrounding the City of St. Louis Park and such other codes as may come to their attention, and to recommend to the City Council such new legislation as to the Commission may seem desirable. (d) To consider matters referred to the Commission by the City Council or by the Building Inspector and make recommendations relative thereto. (e) To consider and review special exceptions to the terms of the Building, Plumbing, Heating, Gas Piping and Electrical Code Ordinances wherever the terms are indefinite, and when the same shall require an amendment, supplement, or change in the Building, Plumbing, Heating, Gas Piping and Electrical Codes, to report the same to the City Council for action. (f) To act in advisory capacity to the City Council in all matters pertaining to the formation, enforcement, amendment, supple- ment, or change in the Building, Plumbing, Heating, Gas Piping and Electrical Codes, or any Resolution, rule or regu- lation covering powers assigned to the City Council by the City Charter and legislature of the State, concerning Building Construction Codes matters. Section 2. This ordinance shall take effect fifteen days after its publication.
