HomeMy WebLinkAbout686 - ADMIN Ordinance - City Council - 1959/05/04Original 4/30/59 ORDINANCE NO. j686_ AN ORDINANCE AUTHORIZING CONVEYANCE OF TITLE TO DRAINAGE EASEMENT IN EXCHANGE FOR ACQUISITION OF TITLE TO NEW DRAINAGE EASEMENT The City of St. Louis Park does ordain: Section 1. It is hereby determined that upon the acquisition of the proposed easement from Belt Line Industrial Center, Inc. by the City of St. Louis Park across the following land: A strip of land 30 feet in width, said strip of land comprising all those parts of the North Half of the Southwest Quarter (Na of SW*) of Section 6, Township 28 North, Range 24 West and of Salem Avenue, as said avenue is now laid out and established in said NI of SW* and of the 20 foot railroad easement in said NZ of SW4, which 20 foot railroad easement is Southerly of, parallel with and immediately adjacent to the Southerly line of the Bass Lake Yard of the Chicago, Milwaukee, St. Paul and Pacific Railroad in said NZ of SW*: said 30 foot strip of land being 15 feet on each side of the following described center line to -wit: Com- mencing at the point of intersection of the Southerly line of the Bass Lake Yard of the Chicago, Milwaukee St. Paul and Pacific Railroad and a line running parallel with and distant 75 feet East, measured at right angles, from the West line off Salem Avenue; thence Southerly on last mentioned parallel line a distance of 428. 99 feet to a point distant 15 feet Northerly, measured at right angles, from the North- erly line of West 35th Street; thence Northeasterly deflecting to the left from the last mentioned course at an angle of 85 degrees and 46 minutes along a line parallel with the Northerly line of West 35th Street a distance of 292. 13 feet; thence in a general Northerly direction along a tangential curve to the left, having a radius of 65 feet, delta angle of 74 degrees and 55 minutes, a distance of 84. 99 feet; thence in a general Northeasterly direction along a tangential curve to the right, having a radius of 165. 17 feet delta angle of 72 degrees, 22 minutes and 40 seconds, a distance of 208. 65 feet; thence Northeasterly on a line tangent to the last mentioned curve a distance of 595. 88 feet; thence in a general Easterly direction along a tangential curve to the MAY 4 1959 71 o right, having a radius of 145 feet, delta angle of 47 degrees, 08 minutes and 50 seconds, a distance of 119. 32 feet; thence Southeasterly on a line tan- gent to the last mentioned curve a distance of 465.91 feet; thence Easterly deflecting to the left at an angle of 29 degrees, 29 minutes and 30 seconds, a distance of 160. 64 feet, more or less to a point in the East line of said Ni of SW-} distant 446.53 feet South, measured along said East line, from the Northeast corner of said Ni of SW 1 and terminating thereat. in exchange for the existing undeveloped drainage easement now owned by the City, described in deed filed for record January 18, 1957 and recorded in Book 2120 of Deeds, page 383 et seq. , in the office of the Register of Deeds in and for Hennepin County, Minnesota, that no public need will exist and the existing drainage easement will not be needed for the public purposes for which it was acquired; that the beat interests of the City will be served by the exchange of said easement sites; and that no purchase price was paid by the City for its acquisition of the existing easement, the same having been donated by said Belt Line Industrial Center, Inc. to the City. Section 2. The Mayor and City Manager are hereby authorized in be- half of the City to execute and deliver a quit claim deed on behalf of the City! conveying and releasing to the Belt Line Industrial Center, Inc. said existing drainage easement above described, upon the delivery to the City of a proper quit claim deed , in form approved by the City Attorney, conveying to the City a drainage easement in the property proposed for the new drainage easement above described. Section 3. This Ordinance shall take effect fifteen days after its passage and publication. Adopted by the City Council Atte et: 4, 1959.
