Call to Order Mayor Dorfman called the meeting to order at 7 30 p m. 2 Presentations Mayor Dorfman presented the proclamation of Adye Davis Day 3. Roll Call The following Councilmembers were present Jeff Jacobs, Chris Nelson, Sue Sanger, Ron Latz, Robert Young, Jim Brimeyer and Mayor Gail Dorfinan Also present were Deputy City Manager(Ms Kutzler), City Attorney(Mr Scott), Director of Community Development (Mr Harmening), Director of Inspections (Mr Peterson), Zoning Administrator(Mr Moore), Finance Director(Ms McBride) and City Clerk(Ms Larsen). 4. Approval of Minutes City Council meeting of December 1, 1997 minutes were approved as presented City Council Study Session of October 27, 1997 minutes were approved as presented Special City Council meeting of November 24, 1997 minutes were approved as presented. City Council Study Session meeting of December 8, 1997• pending correction of Commissioner Sanger comments of Item 7, minutes were approved as presented 5 Approval of Agendas It was moved by Councilmember Jacobs, seconded by Councilmember Sanger to approve the consent agenda The motion passed 7-0 It was moved by Councilmember Jacobs, seconded by Councilmember Nelson to approve the agenda The motion passed 7-0 c. Resolutions and Ordinances By consent, Council waived reading of resolutions and ordinances 6. Public Hearing a. Case Number 97-27-ZA Zoning Code Text Amendment Mr Harmening briefly clarified the reasons for allowing the new recreational lighting to exceed the 60 foot height stating that the 80 foot poles produce less"spill-over" of light to surrounding areas Mayor Gail Dorfman also commented on the advantages of 80' high light poles have over the older 60' high poles There being no further discussion, the Mayor closed the hearing with the right of Council to thereafter reopen it It was moved by Commissioner Young and seconded by Commissioner Jacobs to approve the first reading of the Zoning Ordinance amendment relating to Recreational Light Poles and set the second reading for January 5, 1998 7. Petitions, Requests, Communications a. Variance Appeal, 6200 Minnetonka Boulevard Timothy Manthey of 6200 Minnetonka Boulevard requested a variance from Section 12.4- 4(2) of the Zoning Ordinance to permit a fence located in the front yard with a height of six feet instead of the maximum 2 5 feet for property located in the"F-2" Single Family District 111 at 6200 Minnetonka Boulevard Mr Manthey made a presentation which emphasized the chronology of events leading up to the completion of the fence, the hardship of dealing with the increased bus, car, train and pedestrian traffic, the support of his neighbors and mentioned the effects possible future plans by CP Railway and MN Department of Transportation may have on the neighborhood Mayor Gail Dorfman commented on Mr Manthey's neighborhood safety concerns as they relate to livable community principles Director of Inspections, Ernie Peterson stated that his staff does not recall any specific conversations with Mr Manthey and described the standard procedures of the inspections office at the time of building request He stated that he believed all fences shown as examples in Mr Manthey's presentation were legal and in compliance with the zoning ordinance Commissioner Sanger asked for confirmation that upon arrival at the site, only the posts were installed, and nothing else. Zoning Administrator, Scott Moore confirmed this information Commissioner Sanger asked if Scott Moore told Mr. Manthey to stop fence construction at that point Mr. Moore stated that he told Mr Manthey that the fence was being constructed at an illegal height and not permitted in the front yard and if it were, Mr. Manthey would have to bring the fence into compliance by trying to obtain a variance, or lowering its height Commissioner Nelson asked the Director of Inspections, Ernie Peterson if he was aware of 11 MN Department of Transportation's future plans for that area. Mr Peterson stated that he did not have any information about future plans of MN DOT. Commissioner Nelson stated that he would like to see the issue of increased noise and traffic on the collectors and highways addressed Mayor Dorfman responded to Commissioner Nelson's concerns and suggested discussing this issue at a future study session. Commissioner Sanger stated that although Mr Manthey raised many important concerns, he was not in compliance with the ordinance and if the Council were to overturn the variance, the Council would be condoning other such illegal uses She also indicated that she felt Mr Manthey had shown great disrespect for the operations of the City of St. Louis Park by not honoring the request of Zoning Administrator, Scott Moore Commissioner Sanger emphasized that the high fence was not in accord with the livable communities principles It was moved by Councilmember Sanger, seconded by Councilmember Brimeyer to uphold the Board of Zoning Appeals' decision to deny the variance request The motion passed 7-0. 8. Resolutions and Ordinances a. Gambling Premise Renewal Application Resolution #97-173 By consent, Council approved the resolution renewing the Gambling Premises License Permit for VFW Post 5632 b. Second Reading of the Ordinance Amending the 1997 Budget It was moved by Councilmember Jacobs, seconded by Councilmember Brimeyer to waive second reading, adopt the ordinance and approve the summary for publication. The motion passed 7-0 c. Resolution Approving the Property Tax Levy for 1998 Resolution #97-174 It was moved by Councilmember Jacobs, seconded by Councilmember Sanger to approve the resolution which establishes the tax levy for the fiscal year beginning January 1, 1998 The motion passed 7-0. d. Second Reading of the Ordinance Adopting the 1998 Budget It was moved by Councilmember Jacobs, seconded by Councilmember Young to waive second reading, adopt the ordinance and approve the summary for publication. The motion passed 7-0 9 Reports from Officers, Boards, Committees a. Neighborhood Revitalization Commission Minutes of November 18, 1997 By consent, Council received report for filing 111 b. Human Rights Commission Minutes of November 19, 1997 By consent, Council received report for filing 10. Unfinished Business-None 11 New Business a. Police Uniform Contract By consent, Council authorized the Mayor and City Manager to execute a contract with Uniforms Unlimited for police uniforms for a two-year period from January 1, 1998 through December 31, 1999 12 Miscellaneous 13 Claims, Appropriations, Contract Payments a. Verified claims 11, By consent, Council approved claims and authorized payments 14 Communications a. From the Mayor- None b. From the Deputy City Manager- None 15 Adjournment A motion to adjourn was made by Councilmember Jacobs and seconded by Mayor Dorfman. The meeting adjourned at 8 15 p m The motion passed 7-0.
