111 ST. LOUIS SPECIAL CITY COUNCIL MEETING
PARK ST. LOUIS PARK, MINNESOTA
November 17, 1997
1. Call to Order
Mayor Doifinan called the meeting to order at 6:45 p.m.
2. Roll Call
The following Councilmembers were present at roll call: Jeff Jacobs, Chris Nelson, Sue Sanger,
Ron Latz, Robert Young, Jim Brimeyer and Mayor Gail Dorfman.
Also present were the City Manager(Mr. Meyer); Deputy City Manager (Ms. Kutzler) and City
Clerk (Ms. Larsen).
3. Tobacco appeal hearing for Wooddale Automotive at 6407 West Lake Street
City Manager, Charles Meyer gave a brief summary of the administrative hearing held with
Bruce E. Johnson, business owner of Wooddale Automotive.
Captain Walker of the St. Louis Police Department was present to answer any questions.
Mr. Johnson informed the Council about his struggle with the City Tobacco Ordinance and
expressed his belief that a merchant is not responsible for an individual employee's action.
Councilmember Latz, who had recently visited Wooddale Automotive, reported that he recently
received some calls from concerned constituents regarding the sale of cigarettes to minors and
stated that historically Wooddale Automotive had been a source of cigarettes for minors. He
stated that in his opinion, the merchant is ultimately responsible for the legal compliance of the
employee. He reported statistics from the Minnesota Department of Health to highlight the
importance of the issue as it relates to this policy.
It was moved by Councilmember Latz and seconded by Councilmember Sanger to close the
appeal hearing and uphold the $250.00 administrative penalty. Mayor Dorfman closed the public
hearing with the right of Council to thereafter reopen it. The motion passed 6-0
In response to the Council's decision, Mr. Johnson said he would withdraw his support of
community programs for children which he has been supportive of in the past.
4. Adjournment
A motion to adjourn was made by Councilmember Sanger and seconded by Councilmember
Jacobs. The meeting adjourned at 7:06 p.m. The motion passed 6-0.
