LOUIS PARK, MINNESOTA January 2, 1996 1 Call to order The meeting was called to order by Mayor Hanks at 7.30 p.m. 2. Presentations None 3 Roll call • The following Councilmembers were present at roll call Jeff Jacobs, George Haun, Sue Sanger, Ron Latz, and Gail Dorfman Also present were the City Manager(Mr Meyer); City Attorney(Mr Steilen), Dir. of Community Development (Mr Harmening), Dir. of Public Works (Mr Rardin), Dir. of Inspections (Mr Petersen); Planning Coordinator(Ms Jeremiah). 4. Approval of minutes It was moved by Councilmember Jacobs, seconded by Councilmember Dorfman, to approve the minutes of the December 18, 1995 meeting The motion passed 5-0-1 (Councilmember Haun abstained). Mayor Hanks took a few minutes to thank the Council and staff for their efforts over the years. He then introduced Judge Allen Oleisky who swore in Mayor Gail Dorfman, First Ward Councilmember Sue Sanger; Councilmember at Large(A) Jeff Jacobs; and Councilmember at Large (B) Jim Brimeyer. Each in turn addressed remarks to the remainder of the Council, staff and the audience Mayor Dorfman presented a plaque on behalf of the City Council to Lyle Hanks. 5 Approval of the agenda It was moved by Councilmember Jacobs, seconded by Councilmember Haun, to approve the consent agenda for January 2. The motion passed 6-0 It was moved by Councilmember Sanger, seconded by Councilmember Haun, to approve the agenda for January 2 The motion passed 6-0. Y 1 City Council meeting minutes January 2, 1996 PUBLIC HEARINGS 6a. Amendment to Zoning Map. Cl to C2. 5101 Minnetonka Blvd Councilmember Haun said he had spoken to the applicant who needs additional time to complete her research. It was moved by Councilmember Haun, seconded by Councilmember Jacobs, to continue the public hearing to February 5, 1996 The motion passed 6-0. 6b Amendment to Zoning Ordinance-PUD section There being no one wishing to speak, the Mayor closed the hearing with the right of Council to reopen and continue it at a future date. Councilmember Sanger thought it a good idea to streamline the process. She was not quite clear as to what was a minor amendment and what was not. Also it was not clear to her what the review process would be in the event someone wanted to challenge whether or not it was a minor amendment. . With regard to the timeframe for approval, Ms. Jeremiah said staff would like it in place prior to . potential approval of the Ryan PUD. Councilmember Sanger asked if minor amendments could be characterized as those that perhaps would not be visible to adjacent property owners or passersby Ms. Meremiah felt that was basically a factual statement as in most cases it was unlikely someone would notice such things as reductions in size/height of a building, for example Mr. Meyer wanted to clarify that this particular proposal is not related to the Ryan development, per se. Councilmember Jacobs said he'd like to see first reading this evening with an opportunity to ask questions and clarify at a study session, if necessary, prior to second reading It was moved by Councilmember Jacobs, seconded by Councilmember Latz, to approve first reading and set second reading for January 16, 1996 The motion passed 6-0 2 111 City Council meeting minutes January 2, 1996 PETITIONS, REQUESTS, COMMUNICATIONS None. RESOLUTIONS AND ORDINANCES 8a Resolution designating official City newspaper Resolution 96-01 It was moved by Councilmember Jacobs, seconded by Councilmember Sanger to adopt Resolution 96-01 entitled "A resolution designating official St Louis Park newspaper for calendar year 1996." The motion passed 6-0. i 8b. Tax-forfeit property- 3017 Natchez Ave Resolution 96-02 Mr. Petersen presented background on this property The County would not remove the dilapadated structure on the property, but told the City it would be reimbursed should the latter do so. Reimbursement would come after the property is sold. It was moved by Councilmember Jacobs, seconded by Councilmember Sanger, to adopt Resolution 96-02 entitled "Resolution approving designation of non-conservation land shown on Classification List 844-NC by Board of County Commissioners of Hennepin County, 3017 Natchez Ave. So." The motion passed 6-0. REPORTS FROM OFFICERS, BOARDS, COMMITTEES 9a. Traffic Study 507• Traffic controls at W 37th St , Knollwood Village Shopping Center Resolution 96-06 Mr. Rardin said the property owner was looking for a 4-way stop at this location because of safety concerns following reconstruction of the intersection 3 City Council meeting minutes January 2, 1996 It was moved by Councilmember Latz, seconded by Councilmember Jacobs, to adopt Resolution 96-06 entitled "Resolution authorizing installation of stop signs on W. 37th St. at Knollwood Village Shopping Center." The motion passed 6-0 9b Traffic Study No 508 Temporary No Parking on Cedarwood Rd and Parkwoods Rd Resolution 96-03 Councilmember Sanger asked for clarification as to whether the trucks will be working night and day. She was wondering if the no parking could be limited to just those times when the trucks , would be hauling. Mr. Meyer said Council would have to take action again in order to change the no parking ban to longer hours. Councilmember Sanger asked how late the hauling would go on at night and will it go on during the weekends. Mr. Rardin responded options are available at this point, depending on the weather The contractor may be forced into 6 days a week, 20 hours a day to get this job done. Councilmember Sanger said she would be willing to go along with the ban as she realized it was important to this project; however, she would prefer to see some limits being put on the hours allowing residents to park on their street at other times Mayor Dorfinan's concern was that there was so little parking on the street anyway, and there would clearly be a need if, for example, a resident wanted to have a party. She would hate to tell someone they couldn't have a function at their home. Could some sort of provision be made? Mr. Rardin said the contractor can't work past March 1. He didn't see why arrangements couldn't be made on a Sunday, for example, or some evening, to accommodate a function. It was moved by Councilmember Jacobs, seconded by Councilmember Haun, to adopt Resolution 96-03 entitled "Resolution authorizing parking restrictions along Cedarwood Rd and Parkwoods Rd." Staff was asked to prepare some sort of notification to the residents The motion passed 6-0 4 City Council meeting minutes January 2, 1996 UNFINISHED BUSINESS 10a. Boards and commissions No business. NEW BUSINESS None MISCELLANEOUS 12a Claims Donald Clark vs. City et al By consent, claim referred to City Clerk and City Manager 12b Communications from the Mayor None 12c. Communications from the City Manager Mr Meyer reported the entrance sign to the City at the east end of Minnetonka/Lake was in place. Unfortunately it is covered at this time to allow the mortar to dry CLAIMS,APPROPRIATIONS, CONTRACT PAYMENTS 13a Vendor claims By consent, approve and authorize payment in the following amounts- Vendor claims- $1,014,786.90 and payroll claims $19,297 13 13b. Contract payments Final 1. Ettel &Franz Roofing- Reroofing of water treatment plant.
