CITY COUNCIL MEETING
ST. LOUIS PARR CITY COUNCIL
August 16, 1993
1 . Call to order
Mayor Hanks called the meeting to order at 7 :30 p.m.
2 . Presentations - None
3 . Roll call
The following Councilmembers were present at roll call : Jeff
Jacobs , George Haun, Allen Friedman, Larry Mitchell , Keith
Meland, Gail Dorfman, Lyle Hanks.
Also present were the City Manager (Mr . Meyer) , Deputy City
Attorney (Ms . Pace) ; Director of Community Development (Mr .
Hagen) ; Engineering Supervisor (Mr. Moore) ; and Assistant to the
City Manager (Mr. Larson) .
4 . Approval of minutes
It was moved by Councilmember Jacobs, seconded by Councilmember
Mitchell , to approve the minutes of the August 2 , 1993 City
Council meeting. The motion passed 6-0-1 (Councilmember Meland
abstained) .
5 . Approval of agenda
It was moved by Councilmember Jacobs, seconded by Councilmember
Haun, to approve the consent agenda for August 16 , 1993 . The
motion passed 7-0 .
It was moved by Councilmember Jacobs, seconded by Councilmember
Dorfman, to approve the agenda for August 16, 1993 . The motion
passed 7-0 .
PUBLIC HEARINGS
6a. James Barber Application for an off-sale liquor
license at 8916 Hwy. 7
There being no one wishing to speak, the Mayor closed the hearing
with the right of Council to thereafter reopen and continue it at
a future date .
It was moved by Councilmember Meland, seconded by Councilmember
Jacobs, to accept Mr. Barber' s withdrawal of his request , to
return his application fee and reimburse him for his expenses .

II6b. Vacation of a portion of W. 34th St . Deborah Klein
Thomas Owens, attorney for Ms . Klein, addressed Council on his
client ' s behalf . Ms . Klein seeks a vacation in order to build a
garage .
Mr. Hagen noted one of the concerns of the Planning Commission
when `it reviewed this request for vacation of the entire width of
34th St . was access to the George Haun Trail from Huntington and
34th . He said there was access from that location but it was
quite circuitous . Staff and the Planning Commission believed
there should be a preservation of an easement of about 15 ft . in
the event the City should someday want to provide an access
across W . 34th . It was felt this was needed for emergency
purposes to fight a fire or get a rescue vehicle into the area.
Staff would propose that the 15 ft . -wide easement actually
straddle the lot line going back as far as possible and
proceeding to the north half of W. 34th.
Maria Haft , 3400 Huntington, preferred vacation of the whole
street .
There being no one further wishing to speak, the Mayor closed the
hearing with the right of Council to thereafter reopen and
continue it at a future date.
The City Attorney said they would like to have an opportunity to
review the legal description. Mayor Hanks said second reading of
the ordinance of approval would come back to Council on Sept . 7
so there was ample time for such review.
It was moved by Councilmember Haun, seconded by Councilmember
Jacobs, to approve first reading, set second for Sept . 7, 1993
and authorize summary publication.
The motion passed 7-0 .
6c. Park Nicollet vacations
There being no one wishing to speak, the Mayor closed the hearing
with the right of Council to reopen and continue it at a future
date.

It was moved by Councilmember Meland, seconded by Councilmember
Jacobs, to approve first reading, set second for Sept . 7, 1993

PETITIONS, REQUESTS, COMMUNICATIONS
7a. W. 38th St . traffic reduction program
The Minikanda Vista Neighborhood Association has requested that
the City Council and staff address traffic concerns in their
neighborhood.
It was moved by Councilmember Haun, seconded by Councilmember
Jacobs, to direct staff to hold a neighborhood meeting.
Mayor Hanks noted that Hennepin County had approved the
installation of a temporary traffic signal at Monterey Blvd. and
Excelsior Blvd. to be placed in 1993 .
The motion passed 7-0 .
7b. Stop sign: Kipling/26th St.
Resolution 93-131
Councilmember Friedman noted a petition had been received from
the neighborhood requesting placement of two additional stop
signs.
It was moved by Councilmember Friedman, seconded by Councilmember
Meland, to adopt Resolution 93 - 131 entitled "Resolution
authorizing stop sign placement along W. 26th St . at Kipling
Ave. "
The motion passed 7-0 .

8a. Lighting section of ordinance Second reading of ordinance
Ordinance No. 93-1920
It was moved by Councilmember Meland, seconded by Councilmember
Jacobs, to adopt Ordinance No. 93 -1920 entitled "An ordinance
amending the St . Louis Park Ordinance Code relating to zoning by
amending Section 14 :6-3 . 3 . "
The motion passed 7-0 .
8b. SPS Companies EDA redevelopment matters
1 . Second reading of ordinance vacating public streets/alleys
2 . Second reading of ordinance conveying land from City to EDA
It was moved by Councilmember Meland, seconded by Councilmember
Jacobs, to defer second reading of both ordinances to Sept . 20
and bring back to the Council earlier if financing conditions of
conveyance are finalized before that date.
The motion passed 7-0 .
8c. Emergency pre-emption system Cedar Lake Rd. /Park
Resolution 93-125 Blvd. ; Minnetonka
Blvd. /Ottawa Ave.
III It was moved by Councilmember Jacobs, seconded by Councilmember
Mitchell , to adopt Resolution 93 - 125 entitled "Resolution
requesting MnDOT authorization to appropriate Municipal State Aid
funds for the installation of emergency vehicle premption at
Cedar Lake Rd. and Park Place Blvd. and at Minnetonka Blvd. and
Ottawa Ave. "
The motion passed 7-0 .
8d. Ordinance re residential picketing First reading
It was moved by Councilmember Friedman, seconded by Councilmember
Jacobs, to approve first reading, set second for Sept . 7, 1993
and authorize summary publication.

8f. Bond refunding West Wind Apartments
Resolution 93-126
It was moved by Councilmember Meland, seconded by Councilmember
Jacobs, to adopt Resolution 93-126 entitled "Resolution relating
to the issuance of multifamily revenue refunding bonds; calling a
public hearing and authorizing an agreement as to indemnity and
payment of expenses in connection with the refunding. "
The motion passed 7-0 .
REPORTS FROM OFFICERS, BOARDS, COMMITTEES
9a. Variance appeal : Richard Boyd 3904 Zarthan
Mr. Boyd addressed the Council . He was requesting to extend an
existing garage on his property. His contention was that at one
time he was told he could get a permit for expansion. His plans
changed and when he returned six months later to pursue the
permit, he was told the ordinance had been changed. He said none
of the neighbors touching his property or overlooking the
property had objections to the expansion.
It was moved by Councilmember Meland, seconded by Councilmember
Haun, to authorize preparation of a resolution of approval .
Councilmember Haun noted that if the garage were out in the open,
he would probably vote against it; however, it is shielded from
view and his property is very well maintained and he wants to
store antique autos in it . He believed in getting things off the
streets and keeping neighborhoods well maintained.
Mayor Hanks said he was not in support strictly because it is
precedent-setting and that the Board of Zoning Appeals was doing
its job within the parameters of the new zoning ordinance in
denying his request .
The motion passed 6-1 (Mayor Hanks opposed) .
