IIICITY COUNCIL MEETING
ST. LOUIS PARK, MINNESOTA
February 16, 1993
1 . Call to order
Councilmember Allen Friedman, presiding officer, called the meeting to
order at 7:30 p.m.
2. Presentations
Senator Ted Mondale gave a presentation entitled "Trouble at the Core."
3. Roll call
Councilmembers present were Jeff Jacobs, Allen Friedman, Larry Mitchell
and Gail Dorfman.
Also present were the Interim City Manager (Mr. Pires) , Deputy City Attorney
(Ms. Pace) ; Director of Planning (Mr. Hagen) ; and Dir. of Public Works
(Mr. Grube) .
III 4. Approval of minutes
It was moved by Councilmember Jacobs, seconded by Councilmember Mitchell ,
to approve the minutes of the Feb. 1 , 1993 study session. The motion passed
4-0.

to approve the minutes of the special City Council meeting of Feb. 1 ,
1993. The motion passed 4-0.

motion passed 4-0.
5. Approval of agenda
It was moved by Councilmember Mitchell , seconded by Councilmember Jacobs,
to approve the consent agenda with the removal of lla to the agenda. The
motion passed 4-0.
It was moved by Councilmember Jacobs, seconded by Councilmember Mitchell ,
to approve the agenda for Feb. 16, 1993. The motion passed 4-0.

7a. Railroad activities resolution Resolution 93-12

Mr. Savaiano referenced the resolution passed by the Council on Feb. 1 ,
1993. He felt the resolution, as worded, did not address the train activity
in his neighborhood. That was what the three petitions were concerned
with, the activity during the days as well as throughout the night. What he
was asking was for additional consideration of all the time, study and
complaints since the Twin City & Western Railroad has begun operations
and that the word "switching" be removed from the resolution so that
pass-through activity will also be eliminated during the 8 hours between
10 p.m. and 6 a.m.
Councilmember Jacobs was not sure the Legislature had the power to regulate
train activity because of interstate commerce rules and regulations.
He didn't know if the Council even had the power to ask.
The City Attorney provided language to address Councilmember Jacobs'
concerns, i .e. if the resolution were to explain the inconvenience and
the problems resulting from train traffic between 10 p.m. and 6 a.m.
and recommend to the Legislature that they, to the maximum extent of
the law, regulate this train traffic. That would leave it to the Legislature
and their attorneys to determine the interstate commerce clause issue.
She concurred that local government doesn't have the jurisdiction to
regulate interstate commerce. Whether the State has a higher power is
a constitutional question that needs examination.
Councilmember Dorfman said both ex-Representative Segal and Senator Mondale
were supportive of legislative involvement and review.
It was moved by Councilmember Jacobs, seconded by Councilmember Dorfman,
to edit the proposed resolution as suggested by the City Attorney.
The motion passed 4-0.
RESOLUTIONS AND ORDINANCES
8a. Deferred compensation Administrative service agreement
Resolution 93-9
It was moved by Councilmember Jacobs, seconded by Councilmember Mitchell ,
to adopt Resolution 93-9 entitled "Resolution adopting the International
City Management Association Retirement Corp. (ICMA RC) administrative
services agreement."
Councilmember Mitchell asked if the City had the authority to review
and concur on the trustee.
Mr. Pires responded that the City does not, that the ICMA RC is the appointing
authority.
Councilmember Mitchell felt the City should have such authority. Councilmem-
ber Friedman said he understood that individuals working within the City
can opt to do this or not so that the City in no way gets involved.
The motion passed 4-0.

REPORTS FROM OFFICERS, BOARDS, COMMITTEES
9a. Watermain looping Hwy. 169 from W. 22nd St. to
Resolution 93-10 1200 ft. north
It was moved by Councilmember Mitchell , seconded by Councilmember Dorfman,
to adopt Resolution 93-10 entitled "Resolution accepting City Engineer' s
report establishing Project 90-29, ordering Project 90-29, approving
plans and specifications and authorizing receipt of bids for Project
90-29, watermain construction along the east side of T.H. 169 from W.
22nd St. north approximately 1200 ft."
Councilmember Dorfman asked how the neighborhood is notified of the street
closure for one day to accomplish this project.
Mr. Pires said the neighborhood would be notified by letter that it is
a watermain looping project and the date/length of closure.
The motion passed 4-0.

9f. Variance request State Aid rules, Cedar Lake
Resolution 93-11 Road
It was moved by Councilmember Mitchell , seconded by Councilmember Jacobs,
to adopt Resolution 93-11 entitled "Resolution requesting variance from
MnDOT rules for State Aid operations requiring a four-lane road on Cedar
Lake Road and the associated lane widths."
The motion passed 4-0.
UNFINISHED BUSINESS
10a. Boards and commissions
It was moved by Councilmember Jacobs, seconded by Councilmember Mitchell ,
to appoint Deb Bohn and Ron Latz to the Community Education Advisory
Council . The motion passed 4-0.
NEW BUSINESS
lla. Children' s Miracle Network Request to hold raffle
It was moved by Councilmember Jacobs, seconded by Councilmember Dorfman
to approve the license exemption and waive the 30-day waiting period.

City Council meeting minutes
Feb. 16, 1993
The City Attorney noted the dates on which they propose to hold the raffles
are not specified, just the periods between which they have them. The
ordinance allows exemption for these types of raffles if they are held
on five or fewer dates. She suggested Council might want to consider
contitioning its approval on the applicant agreeing it would be no more
than five days or specify the dates on which they intend to hold raffles.
This was agreeable to the maker of the motion and second.
The motion passed 4-0.

By consent, designate Calgon Carbon as the lowest responsible bidder
and authorize execution of a contract in the amount of $38,360.
