Councilmember Friedman asked if there was a deadline by which Council had to pass the tax levy or the State will levy it for the City. The City Manager said the levy has to be certified to the State by Dec. 28. Councilmember Tschida withdrew her motion. It was moved by Councilmember Friedman, seconded by Councilmember Haun, to adopt the tax levy. The motion passed 4-0. PETITIONS, COMMUNICATIONS, REQUESTS None. RESOLUTIONS AND ORDINANCES 8a. Vacation Second reading of ordinance vacating a portion of Old Minnetonka Blvd. west of Independence- Ave. and east of State Hwy. 169 It was moved by Councilmember Friedman, seconded by Councilmember Haun, to defer the item to Dec. 17, 1990. The motion passed 4-0. 8b. Minor amendment Special permit to convert store Resolution 90-177 room to game room at Classic, 4700 Excelsior Blvd. It was moved by Councilmember Haun, seconded by Councilmember Friedman, to adopt Resolution 90-177 entitled "A resolution rescinding Resolution 90-66 adopted on May 21 , 1990 and granting special permit under Section 14-124. 101 (2) of the St. Louis Park Ordinance Code relating to zoning to allow a Class I restaurant at 4700 Excelsior Blvd." The motion passed 4-0. In answer to a question from Councilmember Tschida, the City Manager said the remaining special permit concerns have either been taken care of or are in the final stages of being resolved. 8c. Minor amendment Special permit to modify building Resolution 90-178 elevation and site plan to include . processing equipment: Control Data Corp. , 3965 Meadowbrook Rd. -192- City Council meeting minutes December 3, 1990 It was moved by Councilmember Haun, seconded by Councilmember Friedman, to adopt Resolution 90-178 entitled "A resolution rescinding Resolution 111 89-188 adopted on Dec. 4, 1989 and granting special permit under Sections 14-123. 100(2) and 14-107(2) of the St. Louis Park Ordinance Code relating to zoning to allow construction of a groundwater treatment center and construction of an industrial building within 200 ft. of the F-1 floodway district at 3965 Meadowbrook Rd." The motion passed 4-0. 8d. Vacation of utility easement 4043 Excelsior Blvd. It was moved by Councilmember Friedman, seconded by Councilmember Tschida, to set public hearing for Jan. 7, 1991 . The motion passed 4-0. 8e. Policy on nepotism Item removed from agenda at the request of the City Manager. 8f. 1990/1991 budget It was moved by Councilmember Friedman, seconded by Councilmember Tschida, to defer the item until a full Council is present. Councilmember Tschida again asked if this delay would cause any problems. The Director of Finance stated the Truth in Taxation law requires that the tax levy and budget must be adopted at a public hearing. Therefore a hearing would have to be republicized and scheduled for another date. Councilmember Tschida withdrew her second. It was pointed out this was not a public hearing. It was moved by Councilmember Friedman to table while the City Attorney researched the Charter. The City Attorney said Section 6.05 of the Charter requires the budget to be approved by ordinance. He read from State statutes wherein a public hearing must be held on the tax levy and budget sometime between Nov. 15 and Dec. 20. It was noted the public hearing was held on Nov. 20, 1990 and continued to that evening. Councilmember Haun asked if republishing was necessary. The Director of Finance responded it was not. It was moved by Councilmember Friedman, seconded by Councilmember Haun, to approve first reading, set second reading for December 17, 1990 and authorize summary publication. It was moved by Councilmember Friedman, seconded by Councilmember Tschida, to defer this item to Dec. 17, 1990 The motion passed 4-0. 8h. Water/sewer rates First reading of ordinance It was moved by Councilmember Friedman, seconded by Councilmember Haun, to defer this item to Dec. 17, 1990 with staff directed to bring back a senior citizen discount proposal for consideration. The motion passed 4-0. REPORTS FROM OFFICERS, BOARDS, COMMITTEES 9a. Legislative contact Appointment for 1991 It was moved by Councilmember Friedman, seconded by Councilmember Tschida, to appoint Bruce Battaglia as legislative contact for 1991 . The motion passed 4-0. 9b. Traffic study 436 Stop signs on Idaho at W. 27th St. By consent, staff directed to hold a neighborhood meeting. 9c. Traffic study 437 Stop signs on W. 16th/Jersey By consent, motion to direct staff to hold a neighborhood meeting. 9d. Board of Zoning Appeals minutes Oct. 25 9e. Cystic Fibrosis Application for renewal of State pulltab license at Ambassador and issuance of premises permit It was moved by Councilmember Tschida to approve. The motion died for lack of a second. Methodist Hospital Application to conduct raffle I r It was moved by Councilmember Tschida, seconded by Councilmember Haun, to approve. The motion passed 4-0. llc. Intoxicating liquor licenses 1991 The City Manager noted Al 's Liquors license not be granted as they were in arrears in their property taxes. David Payne, Al 's Liquors, addressed Council to explain why the taxes were not current. Because the redevelopment proposed for the corner fell through, their business has suffered financially and it has taken some three years to build it back up. He said they intend to have the taxes paid in full by January 31 , 1991 . Councilmember Friedman said he would not have a problem approving Al 's license subject to the taxes being paid by Jan. 31 , 1991 . If not paid by then, the license would be revoked. The City Attorney suggested issuing the license to a date certain so the City doesn't get into a revocation issue. It was moved by Councilmember Friedman, seconded by Councilmember Haun to approve all the licenses with Al ' s license approved to Feb. III 20, 1991 with the opportunity for them to apply through Dec. 15, 1991 should their property taxes be paid in full . Councilmember Tschida alluded to the disproportinate number of police calls from the Classic. She felt the City should take note of that upon the reissuing of liquor licenses. The City Manager said he would check with the Police Department. The motion passed 4-0. lld. Non-intoxicating liquor licenses It was moved by Councilmember Friedman, seconded by Council- member Tschida, to renew non-intoxicating liquor licenses for 1991 . The motion passed 4-0. 9e. 1991 Police uniform contract By consent designate Uniforms Unlimited as lowest responsible bidder and authorize execution of a contract. -195III - City Council meeting minutes r December 3, 1990 llf. Redistricting Councilmember Friedman said he would like to plan ahead on the redistrict- ing, Ill matter. He was requesting that the City Manager and staff prepare a plan of action for Council 's consideration in re redistricting so that by the time the Legislature meets, the City will have its house in order and ready to move. Councilmember Friedman so moved the above with Councilmember Haun seconding. The motionpassed 4-0. MISCELLANEOUS 12a. Damage claims None 12b. Communications from Mayor None 12c. Communications from City Manager None CLAIMS, APPROPRIATIONS, CONTRACT PAYMENTS 13a. Claims By consent the claims as prepared by the Director of Finance dated December 3, 1990 were approved in the following amounts and staff directed to distribute checks in the appropriate amounts: Vendor claims: $746,927.34; Payroll claims: $32,619.08. 13b. Contract payments: 1 . Final payment: Bituminous Consulting and Contracting: grading/paving. Amount: $21 ,348.76 Councilmember Friedman noted this was the new roadway coming from Cityscape Apartments. He was concerned that this roadway was being paid for out of City funds, tax increment finance fund to be specific. He suggested the item be deferred. It was moved by Councilmember Haun, seconded by Councilmember Friedman, to defer to Dec. 17, 1990 The motion passed 4-0. 2. Final payment, GL Contracting, sanitary/storm sewer. Amount: $17,467.40 By consent, adopt Resolution 90-179 entitled "Resolution approving final payment: Contract No. 1980, Project Nos. 90-19 and 90-20: Storm sewer/sanitary sewer repair." 14.
