Call to order _ Mayor Hanks called the meeting to order at 6:30 p.m. 2. Roll call The following were present: Len Thiel , Dudley Moylan (HRA) , Tom Duffy, David Strand, Larry Mitchell , Bruce Battaglia, Allen Friedman and Lyle Hanks (City Council ) . Also present were the attorney for the HRA, the Executive Director of the HRA, the City Attorney, the City Manager, the Assistant City Manager and Assistant to the City Manager. The attorney for the HRA provided a status report on the Excelsior Blvd. redevelopment project. He indicated that the HRA is the owner of all property except that which is owned by the City. He stated that as a result of additional soil samples, one of the borings indicated contamination' in the groundwater. The HRA put a halt on further action until a series of thorough and complex testing could be undertaken. He stated that the 411 problem was not emanating from the site, but rather the dump site. He indicated that the test results did not identify a significant problem and added that the contamination is not in the drinking water. The engineering firm has determined it is not a health hazard. He stated that the MPCA issued a no action letter which allows for construction on the site. The MPCA also commented on the dump site and indicated that it would be placed on a "watch list." He added that the developer is having difficulty in securing financing. He explained that the HRA decided to renew efforts to create a situation to allow development. The HRA and the developer agreed not to sue each other over a six-month time period. Councilmember Mitchell inquired as to what would the nature of the litigation . be. The HRA attorney explained that the developer feels the City and HRA had an obligation to inform the developer of the previous dump site and previous construction projects in which hazardous wastes were discovered. Councilmember Mitchell asked who was responsible for securing the financing. The HRA attorney responded the developer. He added that the developer has asked the HRA attorney to meet with potential lenders. Councilmember Friedman asked where the dump site is located. The HRA _ attorney stated it was a privately owned dump site located where AAA and Park Nicollet Med Center are presently located. He added that the City never had any ownership of the property. Councilmember Friedman asked whether or not the HRA conducted any tests - before the HRA purchased the property. The HRA attorney stated that the HRA relied on a developer's tests and at that time, no problem was evident. There was discussion on the type of development. The ,HRA attorney stated that $8 million has been invested by the HRA and developer. Given that the MPCA process would take two years, there is incentive for both parties to complete the proposal . Th re being no further discussion, the meeting adjourned at 7:20 p.m. rmen KaplanIlt Recording Secretary MINUTES • II Joint Meeting Housing and Redevelopment Authority and City Council June 6, 1988 - 6:30 p.m. Third Floor Conference Room HRA MEMBERS PRESENT: Thomas Duffy, Dudley Moylan, David Strand and Leonard Thiel COUNCILMEMBERS PRESENT: Larry Mitchell, Keith Meland, Bruce Battaglia, Allen Friedman and Mayor Hanks STAFF PRESENT: Bill Thibault, Jim Steilen - the Authority's attorney, Jim Brimeyer, Sharon Klumpp and Carmen Kaplan The meeting was called to order at 6:30 p.m. The Authority met as a committee to discuss the status of the Excelsior Boulevard Redevelopment project and to provide the Council with information related to the Third Amendment and the procedures, 4 steps and issues being discussed.
