Call to Order The meeting was called to order at 7:30 by Mayor Lyle Hanks. 2. Presentations Mayor Hanks read a proclamation to Min Li , an American Field Service Exchange Student, from the Peoples' Republic of China who has been a resource teacher at the senior high this academic year. 3. Roll- Call The following Council members were present at roll call : Thomas Duffy Larry Mitchell Keith Meland David Strand Lyle Hanks Also present were the City Manager, City Attorney, Director of Planning, Director of Public Works and the City Assessor. 1111 4. Approval of minutes It was moved by Councilman Meland, seconded by Councilman Strand, to approve the minutes of the April 27, 1987 study session. The motion passed 4-0-1 --Councilman Mitchell abstained) . It was moved by Councilman Strand, seconded by Councilman Duffy, to approve the minutes of the May 4, 1987 City Council meeting. The motion passed 5-0. It was moved by Councilman Mitchell , seconded by Councilman Strand, to approve the minutes of the May 6, 1987 study session. The motion passed 5-0. 5. Approval of Agenda It was moved by Councilman Duffy, seconded by Councilman Mitchell , to approve the consent agenda for May 18, 1987. Ill, The motion passed 5-0. It was moved by Councilman Meland, seconded by Councilman Duffy, to approve the agenda for May 18 with the following additions: 10a. Appointment to Board of Zoning Appeals. Project 87-06 Improvement hearing, Project 87-06, paving of Natchez Ave. from Minnetonka Blvd. to W. 29th St. It was moved by Councilman Strand, seconded by Councilman Duffy, to continue the hearing to June 1 , 1987. The motion passed 5-0. 6b. Project 87-08 Improvement hearing, Project 87-08, paving of Idaho Ave. from Minnetonka Blvd. to W. 29th St. It was moved by Councilman Strand, seconded by Councilman Meland, to continue the hearing to June 1, 1987. The motion passed 5-0. 6c. Evangelical Free Church First reading of an ordinance vacating a portion of alley between Hampshire and Idaho Ave. south of Minnetonka Blvd. Martin Warskow, Evangelical Free Church, briefly explained the church's expansion project. He alluded to a condition put forth by the Planning Commission prohibiting access from the parking lot to the dedicated alley which would cause the church some problem. He said he understood the intent of the condition which was to keep parkers from fr_eely__using__the -alley, potentially bothering the residents. He said the church was proposing to place signs at the alley entrances ,to read something like "For use of residents only" and then remind the church's parishoners through the church bulletin of the limits on alley usage. He believed this would be an adequate solution, thereby saving them 12 parking spaces. Councilman Mitchell asked who had been notified about the hearing. The Director of Planning said every resident on the block received notice. It was moved by Councilman Meland, seconded by C.ounci loran JDuff_y., xo-wa-i-ve -first reading, set second reading for June 1 , 1987 and authorize summary publication. The motion passed 5-0. It was moved by Councilman Meland, seconded by Councilman Strand, to go forward with the agreement with the church as developed by staff using conditions 1 , 2 and 3, keeping the recommendation of the Planning Commission (prohibition of access from the parking lot to the dedicated alley) as an option in case it might have to be looked at in the future. The motion passed 5-0. 41111 -96- City Council meeting minutes May 18, 1987 REQUESTS, PETITIONS, COMMUNICATIONS 7a. Motec Transmission Request of Motec Transmission for amendment to ordinance It was moved by Councilman Meland, seconded by Councilman Duffy, to refer this matter to the Planning Commission. The motion passed 5-0. 7b. Driveway variance McCourtney's Plastics, 7309 W. 27th St. It was moved by Councilman Meland, seconded by Councilman Strand, to approve a variance from Ordinance 6-123 to allow for construction of 36.5 ft. and 45 ft. wide driveways at 7309 W. 27th St. and that staff be directed to contact the adjacent affected property owners to enact parking restrictions along W. 27th St. to provide for the successful operation of the site plan. The motion passed 5-0. RESOLUTIONS AND ORDINANCES 110 8a. MSA funds Variance from Minnesota rules for Resolution 87-55A additional Municipal State Aid street maintenance funds It was moved by Councilman Duffy, seconded by Councilman Mitchell , to waive reading and adopt Resolution 87-55A entitled "Resolution holding the State of Minnesota harmless for issuance of a variance relative to the distribution of Municipal State Aid maintenance funds." The motion passed 5-0. REPORTS FROM OFFICERS, BOARDS, COMMITTEES 9a. Zoning ordinance Informational meetings It was moved by Councilman Strand, seconded by Councilman Mitchell , to direct the Planning Commission to continue its schedule of -informational meetings relative to proposed changes in the zoning ordinance. The motion passed 5-0. 9b. Variance: 2708 Vernon Ave. Phyllis Strand presented background 11110 information relative to her request for a variance at 2708 Vernon Ave. It was moved by Councilman Meland to authorize preparation of a resolution granting the variance. The motion died for lack of a second. -47- City Council meeting minutes May 18, 1987 It was moved by Councilman Strand, seconded by Councilman Duffy, to receive the City Attorney's memo for filing. The motion passed 5-0. 9c. Consultant: RAP Consultant selection for enactment of Remedial Action Plan It was moved by Councilman Meland, seconded by Councilman Strand, to enter into an agreement with ERT, Inc. not to exceed $7,500. The motion passed 5-0. 9d. PER: Paving, Belt Line Blvd. Preliminary engineering report, Resolution 87-56 Project 86-06: paving of W. 35th St. , 300 ft. west of Belt Line Blvd. It was moved by Councilman Strand, seconded by Councilman Duffy, to waive reading and adopt Resolution 87-56 entitled "Resolution ordering improvement, ordering preparation of plans, specifications and authorizing advertisement for bids for improvement No. 86-06: paving, curb and gutter on W. 35th St. , 320 feet west of Belt Line Blvd." The motion passed 5-0. 41111 9e. Paving: Wyoming, Xylon, Yukon Preliminary engineering report, Project 86-30, paving of 3300 blocks of Wyoming, Xylon and Yukon Avenues. Councilman Meland said he presumed side street assessments were done when 33rd and 34th Streets were constructed several years ago. The City Manager said that was correct. Councilman Meland asked if the approximate one-third assessment against the City was because of Sunset Park, and the City Manager said that was correct. It was moved by Councilman -Mel-and, sec-onded -by Counci- man---Du-f-f_y_,_te approve the preliminary engineering report and set the public hearing for June ' 15, 1987. The motion passed 5-0. 9f. Paving: Jordan Ave. Preliminary engineering report, Project 87-04, paving of Jordan Ave. from W. 16th to the cul-de-sac. It was moved by Councilman Mitchell , seconded by Councilman Meland, to approve the preliminary engineering report and set the public hearing for June 15. 4111/ The motion passed 5-0. -98- City Council meeting minutes May 18, 1987 1111 9g. Paving, Drew Ave. Preliminary engineering report, Project 87-05: paving of Drew Ave. from W. 24th St. to east City limits. Councilman Meland asked what Drew Ave. was like east of the City limits, i .e. is Minneapolis planning to do anything. The Director of Public Works said staff had not contacted Minneapolis about its intentions, but would certainly be willing to do so at Council 's direction. Councilman Meland felt it might be of value to the residents to hear what is planned prior to the public hearing. It was moved by Councilman Strand, seconded by Councilman Meland, to approve the preliminary engineering report and set the public hearing for June 15, 1987. The motion passed 5-0. 9h. Planning Commission minutes May 6 9i . April financial report 110 9j. Cable TV Commission minutes Minutes received for filing by consent. UNFINISHED BUSINESS 10a. Boards and Commissions It was moved by _Councilman _Meland, seconded by Councilman Mitchell , that members on the Building Codes Advisory Commission be appointed to a new term. The motion passed 5-0. It was moved by Councilman Duffy, seconded by Councilman Strand, to appoint John Ralles to the Board of Zoning Appeals. The motion passed 5-0. NEW BUSINESS None. MISCELLANEOUS 12a. Communications from City Manager None CLAIMS, APPROPRIATIONS, CONTRACT PAYMENTS 13. Verified claims It was moved by Councilman Meland, seconded by Councilman Duffy, to approve the list of verified claims prepared by the Director of Finance, dated May 18, 1987 in the amount of $1 ,211,440.22 for vendor claims and $10,581 .25 for payroll claims and that the City Manager and City Treasurer be authorized to issue checks in the appropriate amounts. 14.
