Ca.l to order - The administrative hearing was called to order by Mayor Hanks a p.m. 2. Roll Call - The following members of the City Council were present at roll —call: Ronald Backes Thomas Duffy Jerrold Martin Keith Meland Larry Mitchell Lyle Hanks Also present were the City Manager and City Attorney. 3. Administrative hearing - The Mayor stated that the purpose of the hearing was o consider revocation or suspension of an on-sale/Sunday sale intoxi- cating liquor license held by Northern Franchises, Inc. doing business as The Leaning Post. The City Attorney reviewed the facts surrounding a January 12, 1985 incident at the Leaning Post in which employees were discovered drinking liquor on the premises after hours in violation of M.S.A. 340.13 and Section 13-329 of the City code. All five individuals who were issued citations pled guilty to the charges in Hennepin County Municipal Court and were fined $25 each. The City Attorney noted that this hearing did not constitute a judicial proceeding. He offered the following documents as exhibits: the notice Of hearing, police reports, subpoenas, transcript from the Municipal Court proceedings and City records regarding previous years' operation of the Leaning Post. Phil Eder of the Learning Post appeared and said there were no mitigating circumstances surrounding the violation. Mayor Hanks closed the hearing. Councilman Strohl entered the chambers. It was moved by Councilman Martin, seconded by Councilman Meland that no penalty be assessed against the Leaning Post. The Leaning Post's past record and the fact that had been The motionmposed passed 7-0. the Hennepin County Municipal Court were acknowledged. 4.
