SPECIAL CITY COUNCIL MEETING
ST. LOUIS PARK, MINNESOTA
March 5, 1984
Call to Order A special meeting of the City Council was
called to order by Mayor Hanks at 7:05 p.m.
Roll Call The following Councilmen were present at roll
call:
Ronald Backes
Keith Meland
Richard Strohl
Jerrold Martin
Larry Mitchell
Lyle Hanks
Also present were the City Manager, City Attorney and Chief of
Police.
HEARING
3. Sol's Consideration of revocation or suspension of
Superette off -sale nonintoxicating liquor license as
described in Notice of Hearing delivered on
February 9, 1984.
The City Attorney explained the incident occurred September 16, 1983,
involving an 17 -year-old juvenile who identified the employee of the
licensee who sold him one six-pack of beer. The employee was charged
with illegal sale to a minor and entered a plea of guilty in municipal
court on January 19, 1984, and was convicted of selling an alcoholic
beverage to a minor.
Sentence was stayed until January 18, 1985, and if the employee has
no similar charges, the charge will be vacated and dismissed. The
juvenile also pleaded guilty and his five-day sentence began in the
Hennepin County workhouse on December 22, 1983 (his 18th birthday).
The City Attorney continued that the record includes the notice of
hearing, the police department report and the transcript of the
municipal court proceedings, and the purpose of the hearing is the
status of the liquor license issued by the City; it would be appropriate
for the licensee to make a statement relating to any mitigating cir-
cumstances.

Gerald Bukstein, 4430 Independence Avenue North, owner of the
establishment, explained the sale to a minor was an honest error.
He said the importance of checking identification is stressed to
all employees, but in this instance the crime was an error in
judgement.
There being no one further wishing to speak, the Mayor declared
the hearing closed.
Following brief discussion, it was moved by Councilman Backes,
seconded by Councilman Martin, to not assess a penalty against
Sol's Supermarket for the sale of an alcoholic beverage to a minor.
The motion passed 6-0.
4. Adjournment By motion of Councilman Mitchell, seconded
by Councilman Meland, the meeting was
adjourned at 7:15 p.m.
