CITY COUNCIL STUDY SESSION •
ST. LOUIS PARK, MINNESOTA
January 25 , 1982

1 . Call to Order Mayor McQuaid called the meeting to
order at 8:20 p.m. The following Council -
members were present:
Ronald Backes Keith Meland
Lyle Hanks John Ralles
Jerrold Martin Phyllis McQuaid
Also present were the City Manager, Director of Public Works , Director
of Planning, Director of Parks and Recreation and the Personnel Director.

2. Resolution for Camille Councilman Ralles moved and Councilman
Andre: Resolution No. 7054 Hanks seconded that the City Council
adopt Resolution No. 7054 commending former
City Manager and Mayor Camille Andre for his many years of public service.
The resolution will be read and presented to Mr. Andre by Councilman
Meland at the appreciation dinner to be held January 26 for Mr. Andre 's
retirement as executive director of the Metropolitan Transit Commission.
3. Injury on Duty The City Manager briefly summarized the
staff report.
Councilman Martin related that his discussions with four attorneys , in-
cluding the City Attorney, gave credence to an interpretation that the
statute in question could allow the use of injury on duty if one con-
sidered the maximum allotment of hours of this compensation to be
included in the pool of possible sick leave hours to which an employee
is entitled.
What is needed is a determination if IOD is sick leave. . Councilman Martin
pointed out that an Attorney General 's opinion is merely an opinion.
There has been no court ruling that payment of IOD benefits as contained
in the City's union contract is unlawful.
The City Manager noted that the City has discontinued IOD compensation
based on the Attorney General and City Attorney opinions.
Councilman Martin wanted the Council to support proposed State legislation
which would grandfather existing IOD provisions. He also wished to
change the current policy not to pay IOD and to reinstate these benefits.
Councilman Backes stated that Attorney General opinions are .not given out
lightly. On another point, he noted that contractual provisions which
are not in accordance with law are severed from the contract and do not
affect the rest of the contract. He believed that the City should remain
neutral regarding the proposed legislation.

Councilman Hanks could not support Councilman Martin's evaluation of
the Attorney General 's opinion.
Councilman tieland stated the City Attorney said that I00 benefits could be
within the confines of the law if a Charter amendment were adopted to
allow this benefit.
Councilman Martin moved, seconded by Councilman Cleland, to support the
proposed legislation , that staff prepare a resolution to this effect
for the February 1 Council neetino , and that staff inform the State
Legislators about the City's position.
The motion passed 4-0-2 (Councilmen Backes and Hanks abstained) .
4. Capital_Improvement Program: The following changes were made to the
19113rT- 936 draft of the Capital Improvement Program
for the .years 1983-1986:
Streets
a. Remove the Cedar Lake Road extension from 1985 and not reschedule it.
b. Remove the Louisiana Avenue/Highway 7 intersection from 1985 and
not reschedule it.
c. Remove the Texas Avenue/W. 36th St. to Highway 7 project from 1985
and reschedule it only when the General Growth Corporation requests
it.
Bus Plazas
a. Remove the W. 39th St./Wooddale Ave. plaza from 1984.
Walks and Trails
a. Remove the Highway 12/Colorado Avenue sidewalk project from 1984 be-
cause 1 -394 construction would make this a waste of funds .
b. Add sidewalk on Minnetonka Blvd. from Aquila Ave. to the west
City limits for 1982.
c. Councilman Hanks would not support pedestrian bridges which required
the use of City funds. The following changes in this program were made:
1 . Remove Highway 7/Quebec Avenue bridge from 1984.
2. Remove Louisiana Ave./Franklin Ave. bridge from 1986.
3. Reschedule CSAH 18/W. 15th St. bridge from 1984 to 1986.
Water Utilities
a. Add construction of a well to the Mt. Simon-Hinckley formation for
1981 at a cost of S'iOO,000.

Streetli hting
Councilman Meland said the public safety element of streetlighting
projects should not be overlooked. Councilman Martin said that
streetlinhting should be included automatically in any tax increment
district.
Traffic Signals
a. Reschedule the Cedar Lake Road/Zarthan Avenue signal from 1985
to 1983
b. Remove the Louisiana Ave./Highway 7 signal from 1985
c. Remove the Flag Avenue/Cedar Lake Rd. signal from 1985.
d. Remove the W. Lake St. and Wooddale signal from 1983
e. Remove the Louisiana/Oxford signal from 1983
f. Remove the Louisiana/Walker signal from 1984
q. Remove the Louisiana/Lake St. signal from 1984
h. Remove the Texas Ave./28th St. signal from 1985
Landscaoinn

a. Remove landscaping at W. 36th St. and Oxford St, from 1984
All the above changes were made by motions and seconds by several Council -
men. All of these changes were approved unanimously.
5. Standby Snow Emergency Ordinance It was moved by Councilman Meland, sec-
onded—_-- --
by Councilman Hanks , that staff
prepare a draft of an ordinance to declare snow emergencies and that
would outline parking arrangements to he followed. This ordinance would
serve as a standby in the event that the Council would need to adopt an
emergency ordinance.
The motion passed 6-0.
6. Adjournment At 9:40 p.m. it was moved by Councilman
Meland, seconded by Councilman Hanks , to
adjourn the meeting. The motion passed 6-0.
