violation which had occurred at A1's
Liquor. She asked the City Attorney to
Th� City Attorney stated the facts of the matter as follows:
1. The liquor violation occurred on October 30, 1981 at A1's Liquor
located at 3912 Excelsior Blvd.
2. The sale of liquor m�de to Jay Tollefson was in violation of Section
13.365 of the City's general code which prohibits the sale of liquor
to a minor. �
3. The liquor was sold to Jay Tollefson, 17 years of age, by Scott
Bakke, an employee of A1's Liquor.
4. Mr. Bakke pled guilty to the charqe on November 30, 1981.
5. No petition was filed on behalf of the juvenile.
The City Attorney concluded by stating that the pertinent exhibits for
this hearing were the Notice of Nearing, the.police report, the subpoenss
serveA upon Mr. Bakke and Jay Tollefson, the transcript of the Hennepin
County Municlpal Court, the�birth certificate'and the probation officer's
report.
The C1ty Attorney noted that this was nat a judicial hearing but rather a�
oDPortunity for the Council to review the liquor license issued by the
C1ty. He said that it would be appropriate for a representative of
A1's l.iquor to make a statement to the City Council,
f3uzz Grlffin, owner of A1's Liquor, addressecl the City Council. Fle ���
that h1s partner, David Payne, was also present. Mr. Griffin 1ndlcdted
thet Scott Bakke had worked at Al's Liquor for three years. Mr. Grlffin
explained that it is the policy of A1's Liquor to conduct extensive tre�^�"`

with its employees. He said that this traininq was done in conjunction
with the Police Department.
Mr. Griffin said that A1's Liquor has developed a reputation for being
tough on minors who present them with false identifications. He said
whenever a fal.se identification is found, the Police Department is im-
mediately contacted.
t4r. Griffin said that the reason that the sale was made to Jay Tollefson
vras because Mr. 6akke had mistaken Jay for his older brother, Mark, who
had been carded on numerous occasions. He thanked Mark Tollefson for
accompanying his brother so that Council could see where confusion might
occu�.
Councilman t•leland asked Chief Setter if A1's Liquor had been conductinq
regular training sessions. Chief Setter replied that Al's Liquor has one
of .the most aggressive training programs and that they have participated
regularly in Police Department training sessions during the last five
years.
Councilman Hanks asked if this violation was the first violation that
A1's Liquor had had since going under new ownership. Chief Setter replied
that it was the first violation for these owners.
It was moved by Councilrnan Nanks, seconded by Councilman Meland, that no
penalty be issued regarding this matter. .
The motion passed 4-0.
