3. Review of Cit�r property Various parcel s of 1 and owned by the City

should be considered for sale. The City Manager advised the Council thai
the sale of all public properties must be reviewed by the Planning Com-
mission before Council makes its final determination. He also suggested

The City Council took the followinc� actions on the parcels of City property

2301 Parkwoods Road - It was moved by Councilman ��iartin, seconded by
Councilman Pleland to advise the State that this pa rcel of prope rty no
longer fulfills a public need. The r�otion passed 5-0.

man �1artin to direct staff to conduct an engineerin� study to assist
Council in determininq the feasibility of selling the property. The
r�otion passed 5-0.
Z001 Joppa Avenue South/163� France Avenue South - The City P1anager ex-
plained that this parcel of property �vas important because it could pro-
vide a 1 ink to the Citv's pedestrian trail system. In addition, he said
that a future public need for this land r�iqht arise given the future
development of Highway 12 and possible light rail transit facilities.
It ►,ras moved by Councilr�an Martin, seconded by Councilman Elstrom, to
retain this parcel of property. The motion passed 5-0,

feasibility of retaining an easement for the development of a pedestrian
trail. The motion passed 6-0.
2750 Virginia Avenue South - The City Manager indicated that this parcel

by Councilman fianks, seconded by Councilman Pleland that the sale of this
parcel of land be referred to the Parks & Recreation Commission for study
and that staff conduct a study determining a plan for platting the land.
The motion passed 6-0.
2600 �Jatchez Avenue - It was moved by Councilman Hanks, seconded by
Councilman P�leland, to sell this parcel of land but to retain an easement
for a pedestrian tra'il. The motion passed 6-0.

by Counci r�an E strom, to sell this parcel of land but first to refer
it to the Parks & Recreation Commission for further study. Councilr�an�
Backes noted that although Council had referred certain parcels of
property to the Parks & Recreation Commission, the final disposition of
the property rests with the City Council. The motion passed 6-0.
9200 block Frederick /lvenue - The City Manac�er indicated that sale of
t is land r�ight be conditioned on certain watershed requirements. It
was moved by Councilman Meland, seconded by Councilman Backes, to retain
this parcel of land for further study. The motion passed 6-0.

7101 W. Lake�Street - It was moved by Councilman Pleland, seconded by
Councilman artin, to place the sale of this parcel of land on the open
market but to continue neaotiations tAiith Cardinal Glass. The motion
passed 6-0.
7261 1��. Lake Street - The City Manac�er indicated that the northern portion
of t is site is currently being used for leaf compost but that the southern
portion is available for sale. It was moved by Councilman hleland, sec-
onded by Councilr�an Martin, to retain the northern portion of this prop-
erty for further study.and to sell the southern portion. The motion
passed 6-0.

3100 Oregon Avenue - It was r�oved by Councilman P9artin, seconded by
Councilman Elstrom, to sell the southern part of this pa rcel and to refer
the,balance to the Parks P� Recreation Commission for further study. The
motion passed 6-0.
5525 l�Jayzata Bl vd. - The Ci ty Assessor expl ai ned that i f thi s parcel of
land is needed for the upgrading of Nighway 12, the Commissioner of Trans-
portation can issue an o rder taking this property without compensation
because it is currently in public ownership. He said that if the City
were able to sell the land, it would be able to recoup special assess-
ments that had been incurred at the time this area was developed. The
Planning Director indicated that a possible interim use for this parcel
of 1 and mi ght be a park and ri de faci 1 i ty. The Ci ty t�lanager suc�gested
it might be appropr�ate to involve a hol'ding company in the d�sposition
of this property. Councilman Elstrom suggested that leasinq the property
mi ght al so be a possi bl e v�ay i n whi ch the Ci ty coul d recover some of the
noney spent on special assessments. It was moved bv Councilman Elstrom�
seconded by Councilman rleland, to explore the disposition of this land
through a holding company or the possibility of leasinc� it. ihe motion
passed 6-0.

It was rnoved by Councilman Martin that
staff be directed to write a letter to
the judqe recoc�nizinq his efforts but
essentially rejectinc� his actions.
Councilman Han ks asked what the impact was of the judqe issuing an order
when leqally he did not have the authority to do so. He also questioned
what the City could do since the judae had already taken an action. Ne
said that the 'City Attorney should be prepared to address these questions
at the reqular Council meetinq on March 16, 1�81.
Councilman Martin withdrew his motion.
