LOUIS PARK, February l7, t1EET ING �tIPJNESOTA i 981 A reqular called to meetino of the City Council was order by Mayor Phyllis McQuaid at 7:35 p.m. Mayor McQuaid presented a Pauline Cheleen and read commending her on her 29 plaque to a resolution years of service It was r�oved b,y Councilman Nanks, seconded by Councilman Meland, to waive readinq and adopt Resolution No. G776 entitled, "Resolution Commendina Pauline Cheleen fo r her service to the City of St. Louis Park." The motion passed 7-0. The t�layor read a proclamation in honor of the Rock 'n Roll Jamboree to be held February 27, 1981. The motion passed 7-0. PUBLIC HEARINGS 6a. Zoning chanqe District, for property located at Request of Charl es K. Eckerstrom for a zoning chanqe from R-2, Single Family District, to R-3, Two Family Residence 4918 Old Cedar Lake Road. At the request of a representat.ive of the applicant, it was moved by Council- man Hanks , seconded by Counci lman E1 strom, to conti nue the heari ng to March 16, 19�1. The motion passed 7-0. Gb. Vacation of T-alle,y Toledo Avenue South. Request of John and LaVerne Beckman to vacate the T-alley located between West 28th and 29th Streets and Salem and Bill Husbands, 2815 Toledo Ave. So., addressed the Council to say that a year ago he had presented a petition to Council requesting removal of the fence the Beckman's had erected. Since that time, they have added to the fence encroaching on his property. He said a member of the City Attorney's staff had said the fence would be removed but that it is still standing. He said he has�talked with various members of staff ' no resolution of the prohlem. He said he is opposed to the � . The City ��lanaqer responded that a delay occurred durinq the time the Beck- man's were circulating their petition regarding vacation. Councilman Martin said that there seemed to him to be two issues: (1) In- struct staff to investi�ate the Beckman's fence and if it is on Mr. Hus- bands' aroperty, the fence must be removed; and (2) vacation of th� alley is an entirely separate issue from #1. P�1r. Resinger said he opposed the vacation because that land which is now alley will revert to private property and that the Beckman's can then claim the fence is.on their property. There being no one further wishinc� closed with the right of Council to to speak, the Mayor declared the hearinq reopen the hearing at a future date. It was r�oved by Councilman Martin that the vacation of the alley be approved. The motion died for lack of a second. It was moved by Councilman Backes to reject the request for vacation. He saic� that after vacation, the property lines can be drawn and if the fence is on the wrong property, the City can state that it must be removed. h1r. Husbands' stated he was opposed to the vacation because once the propert,y reverts to private status, his onl,y option to get the fence removed from his proaerty is a civil action. It was moved by Councilman Nanks, seconded by Councilman Backes, to defer this matter until staff has issued a citation to the Beckmans or more�fully i�nvestigates the situation of the fence. The motion passed 7-0. PETITIONS, REQUESTS, COP�MUNICATIONS 7a. Solid Waste Sites Hennepin County solid waste site selection; summary of activities to date. Councilman Ralles complimented Mr. Sweder on the report and thanked him for sharinq it with the Council. It was moved by Councilman Ra11es, seconded by Councilman Martin, to accept the report. It was moved by Councilman Elstrom to set the nublic hearing for P1arch 16 , 1981. The motion died fo r lack of a second. Traffic signal: Lake at Zarthan Traffic signal installation: West Lake Street and Zarthan Ave. Bob Wooden, representing Holy Family church and school, said he was there to indicate their support for the installation of the proposed traffic signal, and to answer any questions Council miqht have. Councilman Hanks said he felt this was a waste of taxpayers' funds. He sai�i he did not see the need of an expensive traffic siqnal r�erely to allow some 25 cars access to Lake Street.
