August 20, 1979
A regular meeting of the City Council was called
to order by President Pro Tem Lyle Hanks at
7:33 p.m.
(a) The President Pro Tem presented a proclamation
of congratulations to Mark Sather, Administrative
Assistant, for his appointment as City Manager of
Waseca, Minnesota.
(b) The President Pro Tem introduced Mayor Frank J. Soward and
relinquished the chair. Mayor Howard assumed the chair and thanked the
Council for the honor of again serving the City.
(c) The Council presented a plaque to Councilman Ly1e Hanks for his
service as President Pro Tem fram June to August, 1979.

comments made on August 6, 1979, opposing the cul-de-sac. He believed
privacy, for�which he purchased the property, would be lost. He said his
driveway exits on Minnetot�ka Boulevard and therefore, the improvement would
not benef it his property. �
The Council was presented a letter dated August 10, 1979, listing four
resiclents approving the project and three in opposition.
John Cannon, 2920 Ensign Avenue, f avored the project including the cul-
de-sac. Responding to Coun�ilman Backes, he stated Mr. John Glassbe�rg

6g. Cedar Improvement Project 79-10, paving, curb and gutter,

Mr. McPherson, 4900 Coun�y Road 16, asked a definition of Cedar Lake Road.
The Director of Public Works exhibited a map and explained the project
would include paving, curb, gutter and a bicycle trail on County Road 16
from Quentin Avenue to �he Burlington Northern track; the street is
referred to as Cedar Lake Road. He explained a segment of the street
lies to the north which is referred to as old Cedar Lake Road.
Jeff Stewart, 4637 Cedar Lake Road, favored the projec t but requested
a traffic study to determine if a reduction in the speed limit on
Cedar Lake Road is warranted. He also requested that parking be allowed
on the north side of the street.

Councilman Meland explained that in 1976, prior
to�the purchase of 3252 Dakota Avenue by the present property awners,
Mr. & Mrs. Witt, the City completed a paving, curb and gutter project in
the vicinity north of West 33 Street and east of the Lenox School. He
continued the boulevard sod appears to have been substandard, and due to
the change in homeownership, it is not known whether the former owners
requested replacement f ollowing construction. He requested a staff
review to determine whether replacement could be authorized without
direction of the Council, due to possible original bad condition of the
sod, change in ownership and/or bad maintenance.

Councilman Martin was concerned that a five-foot boulevard could not
adequately store snow plowed from Minnetonka Boulevard; he expressed
further concern that the areas with only five feet of walk and no boulevard
may cause snow to travel down adjacent banks and onto garage roofs and
walls below.
Councilman Meland asked if snow storage problems exist in areas of
similar topography al.ong Minnetonka Boulevard. The Public Works Director
explained a f ive-foot boulevard has been installed adjacent to the
majority of City sidewalks; it is also the standard for snow storage used
by public works organizations. Responding to Councilman Hanks, he said
problems with snow storage along Virginia and Wyoming Avenues are not
anticipated.
Responding to Councilman Elatrom, the City Maaager stated the walk would
be maintained by the City.

�� Responding to a question from Councilman Hanks, the Planning Director
explained that Section 15-211 of the City's Ordinance relating to the
Building Code requires that applications f or expansion and/or new con-
struction permits must be accompanied by a survey of the property; this
enables the City to determine location, elevation, setback,and building
and fire codes relative to separation of the structures, etc.
Noting that fror� the� Planning Director's statement and the content of the
staff report Mr. Hanson, 4313 Yosemite Avenue, would have been required to
produce a survey for expansion even had a special permit not been
required, Councilman Martin did not favor refunding the survey fee.
However, he held this opinion only if topographic maps were not available
at the County which could be superimposed upon half-section maps to obtain
the required information. He asked that staff determine if such maps are
available for property owner use in the future.
The Planning Director explained that in some instances, staff may have
sufficient information to make the aforementioned determinations,but not
in all. He provided examples of proposed expansions where the City
could not make the correct determination. He said an additional concern
would be th� time spent by the applicant, staff, Planning Commission and
City Council reviewing and approving a request, only to have the Department
of Natural Resources and Watershed District withhold approval due to
inadequate information. He continued that in such an instance, the City
would be required to ask the applicant for a survey and repeat the revie�
process which would require an additional month.

properties equally in other areas of the Citq. Councilman Hanks noted
the 13 single-family houses within the Excelsior Boulevard Planned Unit

app�ication to expand or rebuild.
Councilman Backes requested that staff consider amending the ordinance
for second reading to includ� single-family properties within PUD

John Hanson, 4313 Yosemite Avenue, explained his major concern was the

fee was somewhat excessive. He said several of the neighboring
property owners are planning additions, and a reduction in the fee

It was moved by Councilman Hanks, seconded by Councilman Ralles, to
authorize an appropriation of $200 for preliminary expenses.
Councilman Hanks suggested the desire of the Council would be to have an
effective publication, with the least amount of cost to the taxpayer.
Councilman Meland reported that in the spring of 1979, the Council
reviewed the possibility of establishing a human services division within
the City organization and believed the directory would be more ef f ective.
