Meadow Tree Addition, as described in Notice
of Hearing published June 6, 1979.
Herbert Davis, representing Matterhorn Development, Inc., property own�r,
presented a brief objecting to the proposed assessment fo-- the improvemen�s
to the property during 1968, 1969 and 1974, �t the time the Iand �.tas owned
by the City and the State due to its tax-delinquent status. He stated
that MSA 429.017, Subd. 4, was not applicable as it re�ates to reassessment
of improvement costs which were cancelled due to tax forfeiture> Hp
then summarized the obj ections contained within the brief and' said ti�e
assessment should be borne by the City. He further stated the improvement
is of minimal benef it to the property owner and the water facility cannot
be used .

In response to the President Pro Tem, the Planning Director explained
there would be encroachment into the rear yard, if the proposed request
is approved. He continued that should the Council grant the request, the
motion should include the approval of a rear yard variance.
Councilman �lstrom suggested continuance o� the public hearing enabJ.ing
staff to provide informaCion on the dimensians of the rear yard.
Councilman Backes referred to the minutes of the Boazd of Zoning Appeals
•....� meeting which indicated the group believed a hardship existed whereby a
five-foot setback could be permitted; the hardship was not sufficient to
allow a tilree-foot setback. He continued that the Ordinance is clear on
what constitutes a hardship; therefore, he suggested the Council may ��ish
to consider amending.the Ordinance.
' The President Pro Tem said due to current economic conditions, the City
must consider allowing persons to improve property, expand, etc., or risk
losing residents.
The Council concurred that variance requests must continue to be heard
individually.

the matter should be deferred allowing the 13oard of Zoning Appeals to review
and make recommendation on the rear yard setback.
It was moved by Councilman Elstrom to defer action until July Z, 1979,

on the property in question. There was no second to the motion.

Councilman Backes questioned whether a parking modification mandated by
the City would be under the control of Mr. Otterlei and thexefore cc�n-
stitute a violation of the lease. Responding to Councilman Elstrom. he
did not believe it appropriate to grant a v�riance for a limited time
but, ratller, the Council could grant a delay 3n the required Iandsc�ping
as recommended by the Board of Zoning Appeals.

a full term on the Human Rights Commission by the concensus of the Council.

Councilman Backes said that in February, 1979,
the Council Sign Committee concluded its review and presented its report
to the Council. He noted that staff's response to conmients received at
the May 21, 1979, public hearing were included in the Council's agenda
package. He continued the Council must determine whether or not the com-
ments should be transmitted to the speakers present at the•hearing. He
also did not believe the Council itself had an adequate opportunity to
discuss at any length the provisions within the ordinance; therefore, he
requested direction, should the Conmiittee be reactivated. He continued
another alternative would be to conduct a special meeting on the ordinance.
It was moved by Councilman Meland, seconded by Councilman Martin, that
the Sign Committee schedule a single meeting to deal with the matter;
the Committee shall determine the time and place so interested persons
present at the hearing may be informed.
