LOUIS PARK , MINNESOTA November 13 , 1979 14 Call to Order A special meeting of the City Council was called to order by Acting President Pro Tem Meland at 6 : 30 p . m . ? , Roll Call The following Councilman were present at roll4. call : Ron Backes Martha Elstrom John RallesKeith Meland .. Councilman Martin arrived at 6 : 35 p . m . w Also present were the City Manager and Director of Finance / City Clerk , & Deputy City Clerk . . 0 S Acting President Pro Tem Meland relinquished the chair to Councilman Ralles . 3 . Canvassing Election It was moved by Councilman Meland , seconded by Returns Councilman Elstrom , to waive reading and adopt I Resolution No . 6424 Resolution No . 6424 , entitled "Resolution Canvassing & E lection Returns of City General Election Held k N ovember 6 , 1979 " . .. Councilman Backes questioned the meaning of the Term " under vote " on the computer tally report . Councilman Elstrom then questioned the term " over ✓ ote " on the same tally report . In response to the questions , the City Clerk stated that " under vote " indicated the number of voters who did not ✓ ote on each office or question . He further explained that " over vote " indicated the number of voters who voted for more than one candidate for :_ e ach office , or both " yes " and " no " on the question . ..P47. Councilmen Backes and Martin questioned the total " write - in " votes for each o ffice and that the names of those individuals receiving said votes be read . The City Clerk responded by reading the totals and individual names listed -T for each such "write - in " vote . . The motion passed 5 - 0 . 4 . On \ motion of Councilman Elstrom,asecaon . LOUIS PARK , November 19 , 1979 of the City Council / Housing & Redevelopment A joint meeting 1 . Call to Order Authority was called to order by Council President Pro Tem Lyle Hanks at 7 : 18 p . m . The following Councilmen were present at roll call : 2 . Roll Call Martha Elstrom Lyle Hanks Ronald Backes John Ralles Jerrold Martin The following Commissioners were present at roll call : Joel Glotter Dudley Moylan Jane Tschida Alsopresent were the City Manager , Executive Director and City Attorney . Indemnification clause in purchase agreement for Lot 1 , 3 . Oak Park Block 1 , Oak Park Village ( International Multi-Housing , Village Inc . / Housing Authority ) . The Executive Director briefly described the background of the purchase agreement for Block 1 , Lot 1 , and explained the issue to be resolved is whether the Housing Authority or the City should be responsible for providing the indemnification . He continued that in the case of the agreement with Ben Weber , the City granted indemnification , although in earlier cases , the Authority had granted indemnification to developers . He further stated that - . sale and development of the site is of major importance to the bond payment schedule which would not be met without development of Block 1 , Lot 1 . In response to a question . from the President Pro Tem concerning the difference in the indemnification granted by the Authority for Blocks 3 , 4 , 5 amd 6 , the Executive Director stated it was a matter of degree and involved a determination of possible risk related to the various types of indemnification . The City Attorney concurred with the Executive Director and believed the intent in both indemnifications comparable . In response to a question from the President Pro Tem , the Executive Director stated 60 , 000 cubic yards of material had been excavated from Blocks 1 and 3 . Councilman Martin expressed his desire for consistency in the granting of guarantees to developers and because they had been granted in the past , said it appeared unfair to withhold indemnification for Block 1 , Lot 1 . Commissioner Moylan explained when considering developers for the site , the Authority reviewed the income mix of . future residents , whether the development would pay the bonds and that the PCA would not oppose development due to soil conditions on the northern portion of Oak Park Village . He said the Authority believed the matter was of a political nature and therefore an appointed body did not have the authority for the decision of indemnification . It was moved by Councilman Martin , seconded by Councilman Ralles , to apprpVe Agreement for Purchase and Sale of Real Estate , Lot 1 , Block 1 , Oak Park Village and indemnification shall be provided by the City . of St . Louis Park . In response to a question from President Pro Tem Hanks , the Executive Director explained that no time limit was included in the indemnification clause . -- - 366 . city Council / ( iousiug Authority minutes , November 19 , 1979 1 ( Councilman Elstrom opposed ) , The motion passed 7 - 1 Ad ournment On motion of Councilman Ralles , seconded by Councilman Martin , the meeting was adjourned at 7 : 30 p . m . by a - vote of 8 -0 . / \/e, gaitk4) .1.
