Roll Call The following Councilmen were present at roll call : Ronald Backes Martha Elstrom Rose- Mary Griak Lyle Hanks Keith Meland Jerrold Martin Irving Stern Also present were the City Manager , City Attorney and Chief of Police . PUBLIC HEARINGS 3 . Al ' s Liquor Consideration of revocation or suspension of Store , Inc . off - sale and on - sale intoxicating liquor licenses ; Al ' s Liquor Store , Inc . , as described in Notice of Hearing delivered March 20 , 1978 . The City Attorney explained the incident occurred May 6 , 1977 , involving an 18 - year - old juvenile who identified the employee of the licensee who sold him two 12 - packs of strong beer . The employee was charged with illegal sale to a minor and entered a plea of guilty on May 16 , 1977 , in Municipal Court and was convicted of selling intoxicating liquor to a minor . He said the record should include the notice of hearing , the Police Department Report and the transcript of the Municipal Court pro - ceedings . He added the purpose of the hearing is the status of the liquor license issued by the City Council ; it would be appropriate for the licensee to make a statement relating to any mitigating circumstances . Charles Griffin , 4200 Branson Avenue , Edina , stated he has been an owner of the establishment for 2 . 5 years . He explained the sale to the minor was an honest error based on mistaken identity . _ He said when hiring new clerks , the importance of checking identification is stressed ; the manage" ment had what it hoped was extensive training for employees and in this case it failed . He added that his main responsibility at the establish - ment is management of the off - sale portion . - 114 - City Council minutes , April 3 , 1978 David Payne , co - owner of the establishment , stated his primary responsibility at the establishment is managing the on- sale portion . i The Police Chief stated the management of Al ' s has participated in two liquor dealer conferences in 1977 ; also in 1977 , action was taken I } against a juvenile by the management which interceded in the sale of liquor to that juvenile . He noted the present management of the establish - I went has no other liquor license violations ; it also continues to use I age certification affidavits . There being ' no one further wishing to speak , the Mayor declared the hearing closed . It was moved by Councilman Meland , seconded by Councilman Griak , to I assess a penalty against Al ' s Liquor Store , Inc . , for the sale of an intoxicating beverage to a minor . The motion passed 7 - 0 . It was moved by Councilman Meland , seconded by Councilman Griak , to suspend the off - sale liquor license at Al ' s Liquor Store , Inc . , for ten days beginning April 4 , 1978 . 1 g g Councilmen Martin , Backes and Mayor Stern agreed that the sale of liquor to a minor is a serious violation but did not concur with the severity of a ten-day suspension due to the. license holder ' s attitude and record . The motion failed 2 - 5 ( Councilmen Griak and Meland in favor ) . It was moved by Councilman Backes , seconded by Councilman Hanks , to sus - pend the off - sale liquor license at Al ' s Liquor Store , Inc . , for two days , April 12 and 13 , 1978 . -M After discussion , the motion passed 4 - 3 ( Councilmen Meland , Elstrom and Griak opposed ) . 4 . Infinity Consideration of revocation or suspension of on- sale and Sunday - sale intoxicating liquor licenses ; Park Terrace Supper Club , Inc . , dba Infinity , as described in Notice of Hearing delivered March 20 , 1978 . The City Attorney stated the incident occurred on May 31 , 1977 , involving a juvenile 18 years of age who identified an employee of the licensee as having served him intoxicating liquor . The clerk acknowledged the sale -1 and entered a plea of guilty in Municipal Court . The City Attorney explained `Y` the record should include the notice hearing , the transcriptreports offthethe • 14 Police Department relating to the matter Municipal Court ; the only concern at the present hearing is the license `. issued by the City Council . He added it is appropriate for the licensee to make a statement relating to mitigating circumstances . - 115 - 4
