MINUTES It was moved by Councilman Meland , seconded by Councilman Thiel , to approve the minutes of the regular meeting held February 3 , 1975 with the following amendment , Item No . 11 ( e ) , ( 2c . ) delete the word no in the first line ; and the minutes of the regular meeting held February 18 , 1975 with the following amendment , Item No . 11 ( f ) to read , " The motion passed 4 - 2 ( Councilman Hanks and Mayor Fleetham opposed ; Councilman Thiel was not present for the vote ) . " The motion passed 6 - 0 . 5 . AGENDA It was moved by Councilman Griak , seconded by Councilman Thiel , to approve the agenda of March 3 , 19759 with the following addition : Item 8 ( c ) No . 10 Resolution Supporting Passage of H . F . 15 Regarding Issuance of State Licenses and Permits , 6 . There being no one further wishing to speak , the Mayor declared the hearing closed . It was moved by Councilman Thiel , seconded by Councilman Graves , to prepare a resolution granting the variance with conditions . The motion passed 6 - 0 . 7 . There being no discussion , the notice was ordered by the Mayor to be received for filing . In response to a question from Councilman Graves , the City Attorney stated that according tostatlaw , trequests for rd of variances from the Zoning Ordinance must beer Zoning Appeals for review and recommendation . LOUIS PARK RELIGIOUS , OR NONPROFIT ASSOCIATIONS ** 2 : 108 ( c ) , AND ORDINANCE CODE SECTIONS 2 :104 , 2 : 105 , 2 : 106 , 2 : 107 ( 8 ) , AMENDING SECTION 2 : 105 AND 2 : 107 BY ADDING SUBDIVISIONS Following a discussion as to whether $ 50 was a realistic license fee for granting a temporary non - intoxicating liquor license , it was moved by Councilman Griak , seconded by Councilman Meland , to waive second reading and adopt the proposed ordinance , with a daily fee for a temporary on- sale " license of $ 50 for the first time a license i " s granted and $ 25 for any other time , in the same calendar year , in which a temporary license is granted to the same organization and officers . Councilman Thiel stated that he felt that the proposed fees were excessive . It was moved by Councilman Thiel , seconded by Councilman Graves , to amend the motion to charge $ 50 for the license fee for the first time a " temporary on- sale " license is issued to an organization and $ 10 for any other time , during any other year , that this same type of license is issued . Councilman Griak questioned whether . the Council wanted to encourage this type of fund raiser . She stated that she was concerned about making it easy to sell beer for fund raising events . Following further discussion regarding the mst equitable fee to charge for a temporary on- sale license for charitable organizations , Councilman Hanks suggested that if an ordinance is adopted it could be amended at a later date if it were found rut to be workable . Councilman Meland stated that it would not be difficult for an organization to earn the $ 50 license fee with this type of fund raiser , Councilman Graves recommended that the Council not make the license fee so restrictively high that organizations cannot afford to conduct this type of fund raiser . It was moved by Councilman Hanks , seconded by Councilman Graves , to table further consideration of this item , The motion failed 3 - 3 ( Councilman Griak ) Councilman Meland and Mayor Fleetham Opposed ) . No further action Was taken on the item , 66 ot, ncil Minutes , March 3 , 1975 ( d ) SECOND READING OF ORDINANCE RELATING TO SUNDAY SALE OF LIQUOR , DEFINING CONDITIONS The City Attorney explained the difference between Alternate "A " and Alternate " B " of the proposed ordinances relating to Sunday sale of liquor . He stated that Alternate " A " amends the ordinance code to identify what type food service requirements must be met with a Sunday - sale intoxicating liquor licensee Alternate " B " assumes that the same type of food service will be carried out seven days a week and that the food requirements would apply every day and not only on Sunday . Councilman Graves recommended that the Council consider adopting Alternate " A " so that some revisions to an ordinance regulating food service every day of the week could be made to accommodate existing on sale " licensed establishments that do not presently serve food . ORDINANCE N0 , 1283 It was moved by Councilman Graves , seconded by Councilman Thiel , to waive reading and adopt Alternate A , Ordinance No . 1283 entitled " An Ordinance Relating to the Sunday Salecf Intoxicating Liquor ; Defining Conditions of Sale ; Amending the St . Louis Park Ordinance Code ; Section 2 : 1307 " . The motion passed 6 - 0 . ( e ) RESOLUTION REJECTING MINNEAPOLIS TAX STUDY AND PROVIDING FOR FURTHER INVESTIGATION OF FACTS AND CONTINGENCIES RESOLUTION N0 , 5226 It was moved by Councilman Griak , seconded by Councilman Thiel , to waive second reading and adopt Resolution No . 5226 entitled , " Resolution Regarding Minneapolis Tax Study and Providing for Further Investigation of Facts and Contingencies " . Following a discussion regarding the exact wording of the resolution , it was moved by Councilman Meland , seconded by Councilman Griak , to offer a substitute motion to waive reading and adopt the resolution excluding paragraphs 2 , 3 , and 4 , and replacing the word " rejecting " in the title with the word " regarding " . The motion passed 6 - O ( f ) FIRST READING OF ORDINANCE REGULATING CONCEALED WEAPONS It was moved by Councilman Hanks , seconded by Councilman Griak , to waive first reading and set the date for second reading March 17 , 1975 . ( 9 ) RESOLUTIONS RELATIVE TO 1975 LEGISLATIVE ACTION Councilman Graves suggested that since a study was currently being conducted of public safety pensions , the Council may wish to withhold action on the resolution requesting state legislation giving the City additional flexibility with public safety pensions . Counc request the legislators to work for the adoption of legislation which would permit the establishment of a local retirement system for elected officials or permit elected officials to buy back into existing PERA pension system ; the Council may wish to adopt this concept and then wait and see what type of bill is drafted by the legislature . Councilman Graves suggested it be left up to the discretion of the legislators if this bill should be local or state wide . Councilman Hanks requested information on city -wide needs as well as cost data before this matter is considered . (h ) REPORT RELATIVE TO CONSULTANT SERVICES - SEWER LIFT STATION It was moved by Councilman Hanks seconded by Councilman Meland , to authorize staff to interview consultants for the sewer lift stations and to make recommendations to the City Council . The motion Pasged 70 Council Minutes , March 3 , 1975 9 . 0 ) REPORT RELATIVE TO CONSULTANT SERVICES - PEDESTRIAN BRIDGES Following a lengthy discussion as to the appropriate the bridge design consultant interviews , Councilman Griak osuggested d for, ducting that staff schedule an evening for the interviews and notify the Council of the date and time . A discussion was held as to whether or not staff should make a recommendation on the selection of the consultant to the Council following the interviews . Councilman Griak stated that the City Council has the responsibility to see that the various expressed concerns of the individual Council members regarding the problems involved in Council interviewing do not occur . She further stated that the Council must act to preserve staff responsibility to make technical recommendations to the Council for the benefit of those who do not choose to attend the interviews . It was moved by Councilman Griak , seconded by Councilman Meland , to direct staff to schedule interviews for one evening ; to inform the Council of the date and time of the interviews ; and for staff to make a recommendation to the Council of the selection of a consultant . UNFINISHED BUSINESS - ( a ) TRAFFIC STUDY NO . 101 - BASSWOOD ROAD FROM FRANCE AVENUE TO CEDAR LAKE PARKWAY Mr . Irving Victor , 3908 Basswood Road , and Mr . Sidney Cohen , 3916 Basswood Road , spoke in favor of erecting some type of signing that would reduce the number of cars traveling on Basswood Road between France Avenue and Cedar Lake Parkway in the mornings . The Director of Public Works explained the existing traffic situation on Basswood Road and the staff recommendation that no additional traffic controls be erected on Basswood Road . Councilman Graves suggested that the City Council consider requesting the County to place a " No Right Turn Between 7 and 9 A . M . " sign northbound on France Avenue at Basswood Road . (b ) EXTENSION OF BUS ROUTE TO FORD ROAD ( DEFERRED FROM FEBRUARY 18 , 1975 ) It was moved by Councilman Griak , seconded by Councilman Meland , to approve extension of bus route to Ford Road . The motion passed 6 - 0 . ( g ) CONSIDERATION OF RESOLUTION PROHIBITING PARKING ON PORTION OF WOODDALE AVENUE Mr . Allen Christy , 3417 Wooddale Avenue South , and Mr . Bob Hart , representing the T . E . Ibberson Co . , 3424 Wooddale Avenue South , requested that the Council not _take any further action on installing the "No Parking " signs until some of the property owners in the area have a chance to further study the proposal . Mr , Bob Hart stated that he does not recall rec ging a notice regarding the public hearing for this scheduled paving project . It was moved by Councilman Thiel , seconded by Councilman Griak , to refer this matter to staff to report back on the alternatives for parking restrictions in approximately one month . Louis Park Crime Fund , as recommended by the City Manager . The motion passed 6 - 0 . ( b ) CONSIDERATION OF CHANGE IN COUNCIL MEETING TIME Councilman Griak stated that she prefers to change the starring time for Council meetings to 7 : 00 p . m . Following a discussion as to whether or not the Council should set a time for ending meetings , it was moved by Councilman Hanks , seconded by Councilman Graves , to continue the time for starting regular Council meetings at 8 : 00 p . m . The motion passed 4 - 2 ( Councilman Griak and Councilman Meland opposed ) . ( c ) COUNCIL PARLIAMENTARIAN DESIGNATION Councilman. Meland stated that if a member of the Council were designated as parliamentarian , it would relieve staff from making decisions on parliamentary procedure that may be political in nature . No action was taken on this item . ( d ) POSITION CLASSIFICATION PLAN - CONSULTANT SELECTION It was moved by Councilman Griak , seconded by Councilman Meland , to authorize the retention of the U . S . Civil Service Commission for the purpose of preparing a Position Classification Plan and making salary recommendations . Following a discussion as to whether cr not it would be preferable to utilize the services of a private firm , the motion was withdrawn .
