MINUTES CITY COUNCIL MEETING ST. LOUIS PARK, MINNESOTA November 3, 1975 1 Call to Order Invocation_ Award Presentation chairperson of UN Day and 3, Roll Call . A regular meeting of the City Council was called to order by Mayor Fleetham at 8:02 p.m. Invocation was given by the Reverend Duane Sarazin of the Aldersgate Methodist Church A distinguished service award was presented to Mrs Viola Dareesen for her efforts as the UNICEF fund drive. The following Councilmen were present at roll call: Seymour Druskin Rose -Mary Griak Lyle Hanks Leonard Thiel Frank Fleetham Also present were the City Manager, City Attorney, Planning Director, Director of Public Works and Acting Secretary. Councilman Graves arrived at 8:10 p.m. 4. Approval of minutes were approved by a six yea vote. On motion of Councilman Hanks, seconded by Councilman Griak, the minutes of the special and regular meetings held October 20, 1975 5. There being no one present wishing to speak, the Mayor declared the hearing closed. It was moved by Councilman Hanks, seconded by Councilman Griak, to waive reading and adopt Resolution No. 5397 entitled, "A Resolution Granting Variance in Rear Yard Setback from Section 6:064.5 of the Zoning Ordinance to Permit a Rear Yard of 8 Feet for a Single-family Home in the R-1 District." The motion carried 4 - 0 (Councilmen Druskin and Graves were not present). (b) Authorizing Transfer. Second reading of ordinance authorizing of Funds - Salaries transfer of funds. It was moved by Councilman Hanks, seconded by Councilman Griak, to waive second reading and adopt ordinance transferring funds. The motion failed 4 - 0 - requires six votes (Councilman Druskin and Graves were not present). Later in the meeting it was moved by Councilman Thiel, seconded by Council- man Graves, to waive second reading and adopt Ordinance No. 1307 entitled, "An Ordinance Authorizing the Transfers of Funds and Providing Appropria- tions for Salary Adjustments and Compensation for Year Ending Dec. 31, 1975." The motion carried 6 - 0. (c) Vacating Alley Ordinance 1308 Second reading of ordinance vacating alley 14th/16th - Maryland/Nevada. It was moved by Councilman Griak, seconded by Councilman Thiel, to waive second reading and adopt Ordinance No. 1308 entitled, "An Ordinance Vacating id 4 - 0 (Councilmen Druskin and Graves were not Alley." REPORTS OF OFFICERS, BOARDS AND COMMITTEES 9. (a) Rotary -sponsored Park Report of City Manager relative to Rotary - sponsored Park - Carroll Hurd Park. It was moved by Councilman Thiel, seconded by Councilman Hanks, to authorize Rotary to sponsor park on recently acquired land on Cedar Lake Road adjacent to the elderly housing project, and naming it Carroll Hurd Park. The motion carried 6 - 0. (b) Beatrice Wyner Special Request for special permit to permit office Permit - Resol. 5401 at 7825 Wayzata Boulevard. It was moved by Councilman Griak, seconded by Councilman Graves, to waive reading and adopt Resolution No. 5401 entitled, "A Resolution Granting Permit under Section 6:092.8 of the Zoning Ordinance to Permit an Office in the R-4 Multiple Family District for Property Located at 7825 Wayzata Boulevard." (e) MEPC American Properties Request for special permit for an Industrial Special Permit_ Development Unit at Cedar Lake Road/Vernon Ave. Resolution No 5404 It was moved by Councilman Graves, seconded by Councilman Hanks, to waive reading and adopt Resolution No. 5404 entitled, A Resolution Granting Permit Under Section 6:176.3 of the Zoning Ordinance to Provide for an Industrial Development Unit of Four Office Buildings Located in the I-2 Industrial District on Property Bounded by Gamble Drive, Vernon Avenue, Cedar Lake Road and the Burlington Northern Spur Track." The motion carried 6 - 0. (f) City Variance 3156 Nevada Ave. Request for variance to permit single family dwelling at 3156 Nevada Avenue. It was moved by Councilman Griak, seconded by Councilman Graves, to set public hearing November 17, 1975. The motion carried 6 - 0. (g) Traffic Signal Revisions Report of City Manager relative to traffic signal revisions. It was moved by Councilman Griak, seconded by Councilman Graves, to authorize preparation of necessary agreements and have them returned for review and execution. The motion carried 6 - 0. (h) Nathan Griver Variance Request for variance to permit double garage 2800 Cavell Avenue and deck at 2800 Cavell Avenue. It was moved by Councilman Griak, sThenmotion carried m6n-GrOaves, to set public hearing November 17, 1975. (i) South Cedar Trails Report of Planning Commission recommending Concept Plan approval of concept plan. _ Mr. Jim Hawks, representing the property owner, displayed a perspective drawing of the proposed building. It was moved by Councilman Graves, seconded by Councilman Griak, to approve the concept plan. (r) Traffic Study #116 - Report of load limit study - South Oak Hill, Load Limit It was moved by Councilman Griak, seconded by Councilman Graves, to authorize preparation of resolution authorizing placement of load limit signs (two -ton limit) at Pennsylvania and T.H. 7, Quebec Avenue and T.H. 7, Division Street and Texas and Cambridge Street and Texas; relocate the existing two -ton limit sign at Taft and Lake Street to Taft Avenue and North Street; and place an informational sign, "No Commercial Truck Traffic Beyond Oregon Avenue at Lake Street and Hurst Avenue. NEW BUSINESS Proclamation - Youth Appreciation Week ll.(a) Youth Appreciation Week November 10 - 16. It was moved by Councilman Thiel, seconded by Councilman Griak, to authorize execution of the proclamation. The motion carried 5 - 0 (Councilman Graves was not present). The Reverend Duane Sarazin accepted the proclamation for the Optomists Club. (b) American Education Week Proclamation-- American Education Week November 16 220 It was moved by Councilman Hanks, seconded by Councilman Thiel, t0 authorize execution of the proclamation. The motion carried 5 (Councilman Graves was not present). Dr. Robert Ramsey accepted the proclamation for the St. Louis Park Schools. (c) Meeting Schedule The Council reviewed a suggested meeting schedule for the months of November and December. The Manager noted that a number of special assessment projects were ready for hearing and should be scheduled. It was moved by Councilman Hanks, seconded by Councilman 15 Graves, that the Council hold assessment hearings on November 24, December and December 22, 1975. Staff was directed to proceed with notices and publications for such dates. The motion carried 6 - 0. (c) Central Area Development The City Manager reminded the City Council Review Committee of the meeting of this committee at 7:30 p.m., November 6, 1975. (d) Setting of Hearing Dates The City Manager explained that the Sun newspaper had changed their publication date and deadlines for publishing of legal notices causing approximately a 10 -day delay in bringing matters to the Council. He asked the Council if•they would object to a policy of permitting these hearing dates to be set administratively to avoid such delays. It was moved by Councilman Hanks, seconded by Councilman Graves, that the City Manager submit a written policy in this regard. The motion carried 6 - 0. Councilman Thiel requested that any petitioner be given an opportunity to withdraw an application if this was their desire. it was moved by Councilman Graves, seconded by Councilman Griak, t Resolution No. 5408 entitled, "Resolution to waive reading and adop Declaring Cost to be Assessed, Ordering Preparation of Proposed Public Hearing on Proposed Special Assessment Assessment, and Calling V 73-45, 74-29 and 74-30."
