LOUIS PARK, MINNESOTA April 29, 1974 CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Fleetham at 8:03 p.m. ROLL CALL The following Councilmen were present at roll call: Rose -Mary Griak Lyle Hanks Keith Meland Leonard Thiel Frank Fleetham Also present were the City Manager, City Attorney, Planning Director, Director of Public Works, City Clerk, and Acting Secretary. Councilman Druskin and Councilman Graves arrived at 8:05 p.m. INVOCATION Invocation was given by the Reverend Milton Lenz of the Aldersgate Methodist Church. AWARDS AND PRESENTATIONS RESOLUTION OF COMMENDATION - EUGENE L. MC GARY Mavor Fleetham presented Eugene McGary with a certificate of appreciation for his service to the City of St. Louis Park, and Councilman Thiel read a Resolution of Commendation adopted by the City Council April 1, 1974. RESOLUTION COMMENDING ROBERT E. MURPHY FOR HIS SERVICE TO THE CITY OF ST. LOUIS PARK Mayor Fleetham presented Mr. Murphy with a plaque commemorating his service to the City of St. Louis Park as Street Superintendent, and Councilman Griak read the following Resolution of Commendation to Mr. Murphy: RESOLUTION NO. 5049 It was moved by Councilman Griak, seconded by Councilman Thiel, to waive reading and adopt Resolution No. 5049 entitled " Resolution Commending Robert E. Murphy for his Service to the City of St. Louis Park." The motion carried 7-0. -93- Council Minutes, April 29, 1974 8. RESOLUTIONS AND ORDINANCES (cont'd) (d) FIRST READING OF ORDINANCE RELATING TO "ON SALE" LICENSES TO SELL INTOXICATING LIQUOR; AMENDING THE ST. LOUIS PARK ORDINANCE CODE TO ADD SECTION 2:3107(0) Following a brief discussion on specific definitions, it was moved by Councilman Griak, seconded by Councilman Meland, to waive first reading and set second reading May 6, 1974. Councilman Graves stated that he does not feel an ordinance of this type is necessary. The motion carried 6-1, Councilman Graves voting nay. (e) FIRST READING OF ORDINANCE AMENDING ORDINANCE PROVIDING FOR LICENSING AND INSPECTIONS OF MULTIPLE FAMILY DWELLINGS Margaret Lampe, 3924 Dakota Avenue, asked if all apartments in each building will be inspected. Also, she inquired as to the situation that if five apartments were found to be free of hazards, if the inspection could stop there rather than checking each and every unit in the complex, and if a hazard is found, who or what will control the tenant from not recreating the hazard or not removing it. The City Manager stated that initially each apartment will be checked at a time convenient to the caretaker and tenant. The majority of hazards found to date have been minor, and these are being corrected by the apartment owner. It was moved by Councilman Graves, seconded by Councilman Meland, to waive first reading of proposed ordinance and set second reading for May 6, 1974. The motion carried 7-0. (f) RESOLUTION APPROVING SECURITIES FOR COLLATERAL FROM FIRST NATIONAL BANK OF HOPKINS, HOPKINS, MINNESOTA RESOLUTION NO. 5048 It was moved by Councilman Griak, seconded by Councilman Graves, to waive reading and adopt Resolution No. 5048 entitled "Resolution Approving Securities for Collateral from First National Bank of Hopkins, Hopkins, Minnesota." The motion carried 7-0. (g) RESOLUTION AMENDING RESOLUTION LIMITING PARKING - LAKE STREET AREA RESOLUTION NO. 5050 It was moved by Councilman Griak, seconded by Councilman Meland, to waive reading and adopt Resolution No. 5050 entitled "'Resolution Amending Resolution No. 4834 as it relates to Authorizing Additional Traffic Control Signs Regulating Parking.` The motion carried 7-0. (h) RESOLUTION REPLACING STOP SIGNS - WESTWOOD HILLS DRIVE AT FRANkZIN AVENUE Following a brief discussion on the need for signs within this area, there was no action taken. REPORTS OF OFFICERS BOARDS AND COMMITTEES (cont`d) (e) MINUTES OF ENVIRONMENTAL IMPROVEMENT COMMISSION MEETING HELD MARCH 27, 1974 There being no discussion, the Minutes were ordered by the Mayor to be received for filing. (f) MINUTES OF PARKS AND RECREATION ADVISORY COMMISSION MEETING HELD APRIL 10, 1974 Councilman Griak inquired as to the status of the Minnehaha land acquisition and the Coplan property. The City Manager explained that staff is currently working on both matters and they will be brought to the Council for action soon. The Minutes were ordered by the Mayor to be received for filing. (g) MINUTES OF HOUSING AND REDEVELOPMENT AUTHORITY MEETING HELD APRIL 10, 1974 It was moved by Councilman Graves, seconded by Councilman Griak, to meet with the Housing and Redevelopment Authority at 5:30 p.m. on May 13, 1974. The motion carried 7-0. The Minutes were ordered by the Mayor to be received for filing. (h) MINUTES OF PLANNING COMMISSION MEETING HELD APRIL 17, 1974 The Minutes were ordered by the Mayor to be received for filing. (i) REPORT OF PLANNING COMMISSION RELATIVE TO ZONING ORDINANCE AMENDMENT TO PROVIDE FOR CLUSTER HOUSING Councilman Thiel complemented the Planning Commission for the thoroughness of its report. In response to a question, the Planning Director stated that these developments would require a special permit. It was moved by Councilman Thiel, seconded by Councilman Graves, to set date for public hearing for June 3, 1974. The motion carried 7-0. (j) MONTHLY FINANCIAL REPORT - MARCH 1974 Councilman Druskin requested information on income from City investments. The City Manager indidated the accounting for such interest payment and stated that he would submit a report to the Council on City investments to date. The Financial Report was ordered by the Mayor to be received for filing. (k) MINU-'ES OF COMMUNI!Y RELATIONS COMMISSION MEETING HELD APRIL 11, 1974 There being no discussion, the Minutes were ordered by the Mayor to be received for filing. -100- Council Minutes, April 29, 1974 10. UNFINISHED BUSINESS (cont'd) (b) cont'd Robert I. Lang, counsel for McNulty Company, reminded the Council that in 1965, Mr. McNulty requested this same plat but at no time did he say that he would maintain the pond. He indicated that the McNulty Company will do anything within reason to maintain the pond but will not dredge. Mayor Fleetham stated that currently the City does not maintain the ponds. Councilman Hanks stated that he does not feel the City can justify maintaining a pond that does not have public access. Following further discussion, it was moved by Councilman Thiel, seconded by Councilman Hanks, to approve the preliminary plat and that before the final plat is considered, all questions regarding pond maintenance, etc., must be resolved. The motion carried 6-1. (Councilman Druskin voting nay) The Council suggested that the residents form a homeowner's association and discuss maintenance of the pond, so -:hat th-- have some plan proposed when this matter is again considered. (c) USE OF CITY -OWNED LAND FOR GARDEN PLOTS (M. & C. NO. 74-20) Councilman Graves took the chair as President Pro Tem. A brief review and discussion of possible public held sites useable for garden plots within various wards was held. Councilman Thiel stated that several large tracts of land should be used by the Community Education program for this purpose. Councilman Griak indicated that she would like to see feasible sites used for garden sites and that every available means should be used to promote such a program. Councilman Druskin stated he favored such a program and wanted to see it implemented on an experimental basis this year. He felt that staff should be given some flexibility as to where such sites should be and that he is willing to see those sites indicated in the first ward be made available. It was moved by Councilman Hanks, that no garden plots be started this year. The motion failed for want of a second. Councilman Hanks stated he opposed plowing up open space areas for garden sites because of the obvious problems involved. Councilman Thiel indicated that the Community Education program should administer and supervise such a program, if implemented, with volunteers. After discussion, Councilman Griak moved, seconded by Councilman Druskin, that such a garden plot program be implemented under the recorded regulations and that publicity be given in the newspaper informing the citizens of this project.
