The City Attorney reminded the Council that: it was the City who took the initiative in filing suit against the Republic Creosote Company and that the Pollution Control Agency supported this action . Because no evidence could be shown of phenol in the City water supply and there was no evidence of any health problem , the Minnesota State Department of Health did not join in the law suite . He noted that the first draft of the City ' s offer to purchase the Republic Creosote property contained the stipulation that the company would be responsible for any future pollution problems . However , after assurances from the Pollution Control Agency that only minimal sealing of contaminated areas would be required rather than excavation or other strenuos rehabilitation attempts , and the assurances that no pollution or health problems existed , the City purchased the property from Republic Creosote on a " hold harmless" basis . In. response to a. question from Councilman Griak. , the City Manager noted that although the City and its consultants have been discussing the storm sewer with the MPGA for over a year , it was not until August of 1974 that the City was informed that it must obtain a permit for construction of the storm sewer, Since that time , the MPCA has not denied the permit but , rather. , has continually requested more information , The City Manager informed the Council that Mr , Lewis Barbe Director of the Water Quality Division of the MPCA , has told him that the staffs of the MPCA 288 Special Council Minutes , October 26 , 1974 and State Health Department dill be meeting on Monday morning to reach some decision regarding the permit , It was agreed that the Council Would take no further action on this matter until after the anticipated decision of the MPCA regarding the permit . U pc gain Tiee t ing s 1 . The School Task Force committee will be meeting on October 29 , 1974 and again on November 4 , 1974 to discuss its findings and recommendations on school closings . The consultant for the Metropolitan Transit Commission will be holding a meeting in the St . Louis Park City Hall on October 30 at 7 : 00 p . m . to obtain citizen input regarding the Small Vehicle Transit Study . The meeting was adjourned at 11 : 45 a . m . d?, G .
