CITY COUNCIL MEETING
ST. LOUIS PARK, MINNESOTA
September 17, 19763
1. CALL TO ORDER
A regular meeting of the City Council was called to order, in the absence
of the Mayor and President Pro Tem, by Councilman Griak at 8:00 p.m.
2.
INVOCATION
Invocation was given by the Reverend Milton Lenz of the Aldersgate
Methodist Church.
3. ROLL CALL
The following Councilmen were present at roll call:
Frank Fleetham
Richard Graves
Rose -Mary Griak
Lyle hanks
Also present were the City Manager,. Assistant City Manager, City
Attorney, Planning Director,. and Secretary.
Mayor Pucci arrived at 8:17 p.m. and assumed the chair.
A. MINUTES
On motion of Councilman Hanks, seconded by Councilman Graves, the
minutes of the regular meeting held September 4, 1973 and special
meeting held September 10, 1973, were approved by a four yea vote.
5. PUB13C HEARINGS
(a) PROPOSED PRELIMINARY PLAT OF SAHLt& ADDITION, AS
DESCRIBED IN NOTICE OF HEARING PUBLISHED SEPTEMBER 6,
1973,
Temporary Chairman Griak opened the i%earing.
There being no one present wishing to speak, the Temporary Chairman
declared the hearing closed.
It was moved by Councilman Hanks, seconded by Councilman Graves'
to approve the preliminary plat. The motion carried 4 - 0.

5, (b) PETITION TO VACATE ALLEY BY B'NAI ABRAHAM_M
TIFERETH SYNAGOGUE, AS DESCRIBED IN NOTICE OF RO-
PUBLISHED SEPTEMBER 6, 19730 HEARING
Temporary Chairman Griak opened the hearing.
Mr. Jerry Rodman was present representing the synagogue.
The Planning Director described the proposed vacation as a petition
which was not submitted at the time a permit for construction was being
considered.
There being no one present wishing to speak, the Temporary Chairman
declared the hearing closed.
It was moved by Councilman Graves, seconded by Councilman Hanks,
to waive first reading of proposed ordinance vacating alley and set
second reading September 24, 1973. The motion carried 4 - 0.
(c) PROPOSED AMENDMENT TO ZONING ORDINANCE TO ESTABLISH A
NEW USE "HOTEL -APARTMENT" BY SPECIAL PERMIT IN B-2
AND I- l DISTRICTS, AS DESCRIBED IN NOTICE OF HEARING
PUBLISHED SEPTEMBER 6, 1973.
The Temporary Chairman opened the hearing.
Mr. Dick Swanson expressed interest in the amendment as it relates
to the Burdick Grain Elevator site on Highway 100 and Highway 7.
There being no one present wishing to speak, the Temporary Chairman
declared the hearing closed,
It was moved by Councilman Graves, seconded by Councilman Hanks,
to waive first reading of the proposed ordinance and set second reading
September 24, 1973. The motion carried 4 - 0.

PETITIONS, REQUESTS, AND C OIVIMUNICA TI ONS
(a) COMMUNICATION FROM MR. KLEIN, 2844 MONTEREY PARKWAY,
RELATIVE TO FENCE LOCATION
The Mayor explained the problem of fence location over a joint driveway
being used by the adjoining property owners for thirteen years.
After some discussion, the matter was placed in the hands of the
City Attorney.

6. (b) PETITION FOR STREET MAINTENANCE WORK - 3000 BLOCK
BO ONE AVENUE
RESOLUTION NO, 4911
It was moved by Councilman Graves, seconded by Councilman
Fleetham, to waive reading and adopt Resolution No. 4911 entitled,
"Resolution Calling Public Hearing on Improvement No, 73-44
Street Maintenance. " The motion carried 4 - 0.
(c) PETITIOr', FOR PAVING; CURB AND GUTTER - 2800 BLOCK
YOSEMITE AVENUE
Councilman Fleetham explained that a street maintenance project
has been ordered for this block but that the property owners now
desire permanent paving, He also indicated that residents of the
2900 Block are petitioning for permanent paving.
Mr. Roger RadtkeA 2847 Yosemite Avenue, urged Council to
change the project from maintenance to a permanent street with
curb and gutter.
Councilman Fleetham moved to remove the 2800 block on Yosemite
Avenue from the maintenance project and remove the 2900 block
subject to petition presented no later than September 21, 1973 with
signatures of at least 51% of the property owners. Councilman
Graves seconded and the motion carried 4 - 0.
The City Manager explained that if this petition for the 2900 block
is received, the matter will be on the agenda September 24 to set
public hearings for both the 2800 and 2900 blocks of Yosemite
Avenue.
(d) IMPROVEMENT NO, 71-17 -• SIDEWALK - VERNON AVENUE
PETITION IN OPPOSITION TO THE PROJECT
Council agreed that since a hearing had been held with the
project ordered in at that time, and that since the project is
under contract. no action would be taken to order the improvement
not made.
(e) COMMUNICATION RELATIVE TO TRAFFIC ON WEST 38TH STREET
Council directed the City Manager to inform Mr. Edward E.
Cooney, 3804 Inglewood Avenue, that the committee would be
holding a public hearing on this matter.,

7, RESOLUTIONS AND ORDINANCES
(a) RESOLUTION GRANTING SPECIAL PERMIT FOR A RESIDE

It was moved by Councilman Graves, seconded by Councilman
Hanks, to defer to September 24, 1973, The motion carried 5 - 0.
(b) SECOND READING OF AN ORDINANCE RELATING TO TRAFFIC
REGULATION; AMENDING THE ST. LOUIS PARK ORDINANCE CODE,
SECTION 3;100
ORDINANCE NO, 1243
It was moved by Councilman Graves, seconded by Councilman Hanks,
to waive second reading and adopt Ordinance No. 1243 entitled, "An
Ordinance Relating to Traffic Regulation; Amending the St. Louis Park
Ordinance Code, Section 3:100. " The motion carried 4 - 0 (Mayor
Pucci was not present)
(c) RESOLUTION DESIGNATING DEPOSITORY FOR CITY FUNDS
RESOLUTION NO, 4912
It was moved by Councilman Hanks, seconded by Councilman Graves,
to waive reading and adopt Resolution No. 4912 entitled, "Resolution
Designating Depository for City Funds. " The motion carried 5 - 0.
(d) RESOLUTION ESTABLISHING THE COMMUNITY RELATIONS
COMMISSION AND DEFINING ITS DUTIES.
RESOLUTION NO. 4913
It was moved by Councilman Graves, seconded by Councilman Hanks,
to waive reading and adopt Resolution No. 4913 entitled, "A Resolution
Establishing the Community Relations Commission and Defining Its
Duties. " The motion carried 5 - 0. Councilman Hanks moved to
amend to indicate that anyone not officially appointed as a neighbor-
hood or at -large representative would be appointed to a term
expiring October 1, 1974, unless previously appointed to another
commission. The motion was seconded by Councilman Graves and
carried 5 - 0.

It was moved by Councilman Griak: seconded by Councilman Graves,
to waive reading and adopt Resolution No, 4910 entitled, "Resolution
Approving 1973 Tax Levy, Collectible in 1974 " The motion carried
5 - 0.
8. REPORTS OF OFFICERS, BOARDS, AND COMMITTEES
(a) PARKING STUDY - WEST 36TH STREET
Council directed the City Manager to request a full presentation
be made by Bather-Ringrose-Wolsfeld at 7:00 p� m, , September 24,
1973.
(b) REPORT OF PLANNING COMtv/TISSION RELATIVE TO THE LAKES
AREA PARCELS - WESTLING (CASE NO. 73-5101111RE)
It was moved by Councilman Griak, seconded by Councilman Fleetham,
to refer this matter to the Parks and Recreation Advisory Commission
for their advice and recommendation. The motion carried 5 - 0.
(c) REPORT OF PLANNING COMMISSION RELATIVE TO PARCEL OF
LAND NEAR HIGHWAY 12 (CASE NO. 731=o53 -RE)
It was moved by Councilman Griak, seconded by Councilman Hates
to release fornunicipal public use except for use as service road or
interchange for Highway 12.. The motion carried 5 - 0.

$ (d) REPORT OF HEALTH DEPARTMENT RELATIVE TO NOISE
ABATEMENT STUDY
It was moved by Councilman Fleetham, seconded by Councilman
Griak, to refer this study to the Hennepin County Board and Highway
Department for their comment to this Council. The motion carried
5 - 0.
(e) REPORT RELATIVE TO AMENDMENTS TO INDUSTRIAL ZONING
SECTIONS OF THE ST. LOUIS PARK ZONING ORDINANCE
(CASE NO. 73 -11- ZA ).
After a brief discussion, it was moved by Councilman Hanks,
seconded by Councilman Griak, to defer to October 1, 1973. The
motion carried 5 - 0.
(f) REPORT OF LAND ACQUISITION - OXFORD EXTENSION
(M&C N0. 73-40) - 6319 WEST 37TH STREET
It was moved by Councilman Griak, seconded by Councilman Graves,
to authorize purchase at a cost of no more than $16, 000. The motion
carried 5 - 0.
(g) MINUTES OF CITIZENS ADVISORY COMMITTEE MEETING HELD
AUGUST 20, 1973.
There being no discussion, the minutes were ordered by the Mayor
to be received for filing.
(h) REPORT RELATIVE TO FIRE LANES - CEDAR TRAILS
RESOLUTION NO. 4914
It was moved by Councilman Fleetham, seconded by Councilman
Griak, to waive reading and adopt Resolution No. 4914 entitled,
"Resolution Authorizing Placement of Traffic Control Signs Establish-
ing Fire Lanes. " The motion carried 5 - 0.
(i) REPORT OF TRAFFIC STUDY (#72) - AREA OF SENIOR HIGH
SCHOOL
It was moved by Councilman Fleetham, seconded by Councilman
Griak, to defer to October 99 1973• The motion carried 5 - 0.

8. (k) REPORT RELATIVE TO ACQUISITION OF EASEMENT FROM
RAILROAD ADJACENT TO OLD COMMUNITY CENTER.

with the necessary expense for the fencing in order for this land to be
utilized for the redevelopment of the old community center site.

(a) APPOINTMENTS TO BOARDS/ COMMISSIONS
Councilman Fleetham moved to appoint Mrs. Reva Gould as Council
representative to the Community Education Policy Advisory Committee.
Councilman Griak seconded and the motion carried 5 - 0.
Councilman Griak moved that those whose terms are expiring be
contacted to determine whether or not they wish to continue to
serve. Councilman Hanks seconded and the motion carried 5 - 0.
10. NEW BUSINESS
(a) PROPOSED CHANGE ORDER NO. 3- CONTRACT 1011 - BURY &
CARLSON, INC. ADDITION OF $69 316. 35. - FOUR DAY EXTENSION
OF TIME
It was moved by Councilman Fleetham. seconded by Councilman Hanks,
to authorize execution of the change order. The motion carried 4 - 0
(Councilman Graves was not present).

Councilman Hanks moved to file claims with the City Clerk for

It was moved by Councilman Hanks, seconded by Councilman Griak,
to dedicate Justad Park on October 10, 1973 at 6:30 p.m. The motion
carried 4 - 0 (Councilman Graves was not present).

12. (b) On motion of Councilman Griak, seconded by Councilman Graves,
the above payment on contract work presented by the City
Engineer was approved, and the City Manager, City Cle ,
and City Treasurer were authorized to issue a check for the amount

13. ADJOURNMENT
On motion of Councilman Graves, seconded by Councilman Fleetham,
the meeting was adjourned at 9:45 p.m. by a five yea vote.
