CITY COUNCIL, MEETING
STLOUIS PARK, MINNESOTA
August 6, 1973
i. CALL. TO ORDER
A regular meeting of the City Council was called to order by Mayor
Pucci at 8:00 p.m.
2. INVOCATION
There being no one present from the Ministerial Association, there was
no invocation.
3. ROLL CALL
The following Councilmen were present at roll call:
Frank Fleetham
Richard Graves
Lyle Hanks
Leonard Thiel
Frank Pucci
Also present were the City Manager, Assistant City Manager, City
Attorney, Planning Director, Acting Director of Public Works, and
Secretary.
Councilman Heltzer arrived at 8:20 p.m.
4. MINUTES
On motion of Councilman Hanks, seconded by Councilman Fleetham, the
ininuteg of the regular meeting held July 30, 1973, were approved by
a five yea vote with the following corrections: Page 214, Item 9(a) qw
".. moved not to enforce.. " The City Attorney stated that it would be an
illegal motion. Motion to defer to August 150 1973 was withdrawn.

It was moved by Councilman Hanks, seconded by Councilman Graves,
to waive reading and adopt proposed ordinance. After discussion
Councilman Hanks withdrew his motion and Councilman Thiel moved
to defer the second reading to August 20, 19?3• The motion was
seconded by Councilman Graves but after further discussion was
withdrawn.
ORDINANCE NO. 1234
It was moved by Councilman Hanks, seconded by Councilman Graves,
to waive second reading and adopt Ordinance No. 1234 entitled, "An
Ordinance Amending Ordinance No. 1165 Passed September 13, 1971
Entitled 'An Ordinance Prohibiting the Sale of Certain Nonreturnable
Disposable Beverage Containers, Providing for the Redemption of
Redemption of Returnable Providing Penalties for Violation of the
Provisions Thereof Adding Section 4:900' , Previously Amended by
Ordinance No. 1196. " The motion carried 5 - 0 (Councilman
Heltzer was not present).

The City Attorney answered in some detail questions posed by
Council in their discussion July 30, 19739 indicating changes made
in the draft of the ordinance as requested by Council and for pu*osos
of clarification. When asked by Councilman Fleetham he stated he
felt the ordinance to be effective to accomplish the proper Inst oto a

RESOLUTION NO, 4878
It was moved by Councilman Thiel, seconded by Councilman Hanks,
to waive reading and adopt Resolution No. 4878 entitled, "Resolution
Authorizing Placement of Signs for Traffic Control at Intersection of
West 34th Street, Decatur Lane and Minnehaha Creek. " The
motion carried 5 - 0 (Councilman Graves was not present).
(9) RESOLUTION OF APPRECIATION TO VFW FOR FOURTH OF JULY
CEREMONY AND FIREWORKS
RESOLUTION NO. 4879
It was moved by Councilman Fleetham, seconded by Councilman Thiel,
to waive reading and adopt Resolution No. 4879 entitled, "Resolution
Of Appreciation Addressed to the Veterans of Foreign Wars for the
Fourth of July Ceremony and Fireworks. " The motion carried 5 - 0

8. REPORTS OF OFFICERS, BOARDS, AND COMMITTEES
(a) PRELIMINARY REPORT OF DIRECTOR OF PUBLIC WORKS AND
ASSESSMENT REPORT WITH RESPECT TO IMPROVEMTENT NO.
65-45D, STORM SEWER
It was moved by Councilman Hanks, seconded by Councilman Thiel,
to defer to lugust 20, 1973. The motion carried 5 on 0 (Councilman
Graves was not present).
(b) REPORT OF CITY MANAGER (M&C NO. 73-34) RELATIVE TO
REVISION OF ORDINANCE REGULATING PEDDLERS, SOLICI TORS
AND TRANSIENT MERCHANTS WITHIN THE CITY
The City Manager explained the need for the adoption of this ordinance
to strengthen present ordinances.
It was moved by Councilman Heltzer, seconded by Councilman Thiele
to waive first reading of proposed ordinance and set second rending
August 20, 1973. The motion carried 5 - 0 (Councilman Graves was
not present).
(c) REPORT OF CITY MANAGER (M&C NO. 7335) RELATIVE TO
STANDBY HEATING FUEL TANKS; CITY HALL AND RECREATION
CENTER
It was moved by Councilman Thiel, seconded by Councilman Heltzeri
to authorize the City Manager to proceed with acquisition and installs•
tion with proper adjustments in the revised 1973 budget. The motion
carried 5 - 0 (Councilman Graves was not present).
(d) MINUTES OF HOUSING AND REDEVELOPMENT AUTHORITY
MEETING HELD JULY 31, 1973
There being no discussion, the minutes were ordered by the Mayor to
be received for filing.
(e) MONTHLY FINANCIAL REPORT - JUNE 1973
There being no discussion, the report was ordered by the Mayoi to
be received for filing.

9. (a) It was moved by Councilman Hanks, seconded by Councilman Heltzer,
to refect the bid and readvertise. The motion carried 5 - 0 (Council
man Graves was not present).
(b) I-394 DISCUSSION; STATUS REPORT FROM MRS. INGERSOLL
Mrs. Art Ingersoll, city representative on the I-394 Citizens
Advisory Committee, brought Council up to date on plans for
I-394, giving special emphasis to mass transit and the impact
of the plans on St. Louis Park.
(c) APPOINTMENTS TO BOARDS/COMlviISSIONS (DEFERRED FROM
JULY 30, 1973)
Councilman Fleetham asked that Robert Schwartz be nominated for
consideration of appointment to the Board of Zoning Appeals.
Action on appointments was deferred to August 20, 1973.
(d) PEDESTRIAN BRIDGE - HIGHWAY 100 AND WEST 36TH STREET
The City Manager and Acting Director of Public Works described the
proposed alternatives for locations and construction of the pedestrian
bridge.
It was moved by Councilman Hanks seconded by Councilman Heltzer, to
proceed with a consultant for designs and cost estimates. The motion
carried 5 - 0 (Councilman Graves was not present).
(e) TRAFFIC STUDY (#75) - INTERSECTION OF EXCELSIOR BOULEVARD
AND WEST 38TH STREET (REQUESTED BY COUNCIL)
It was moved by Councilman Hanks, seconded by Councilman Thiel,
to refer this matter to the Citizens Committee for study and recom•
mendation. The motion carried 5 - 0 (Councilman Graves was not
present).
(f) TRAFFIC CONTROL - YOSEMITE AVENUE
It was moved by Councilman Hanks, seconded by Councilman Fleet -
ham, that signs warning vehicular traffic of children ina area be

(a) PROPOSED CHANGE ORDER NO. 1 - CONTRACT NO. 1023 -
H. J. A. CONSTRUCTION GO. - ADD $2, 760.00
It was moved by Councilman Heltzer, seconded by Councilman Hanks,
to authorize the City Manager, to execute the proposed change order.
The motion carried 5 - 0 (Councilman Graves was not present).
(b) PARKING PROBLEM - NATCHEZ AVENUE
Councilman Fleetham said he had received a petition from residents
in the 1600 block of Natchez Avenue asking that "no parking" signs be
placed on the east side of the street.
Councilman Heltzer moved that a resolution be prepared authorizing
the installation of the signs as requested. Councilman Fleetham
seconded and the motion carried 5 -- 0 (Councilman Graves was not
present).
(�) WOODDALE AVENUE MEDIAN
The City Manager explained that a petition had been received from
citizens in the area requesting that the median not be closed.
It was moved by Councilman Thiel, seconded by Councilman
Fleetham, that a letter be sent to the petitioners inviting them to
an informational meeting on this subject. The motion carried 6 to 0s
(d) PARK CENTER BOULEVARD
Councilman Heltzer moved to reconsider the action on this matter
taken on July 30, 1973. Councilman Thiel seconded and the motion
carried 6 - 0.

Councilman Hanks moved to file claim with City Clerk for proper
action by the City Manager and City Attorney. Councilman Thiel
seconded and the motion carried 5 - 0 (Councilman Graves was not
present).

(a) VERIFIED CLAIMS
AND CONTRACT PAYMENTS
On motion of Councilman Hanks, seconded by Councilman Thiel, the
lists of verified claims prepared by the Director of Finance and
presented to the Council dated August 6, 1973 in the total amounts
of $22,364. 75 for payroll and $236,417.27 for vendors were approved#
and the City Manager, City Clerk, and City Treasurer were authorized
to issue checks covering same by a six yea vote,
(b) CONTRACT PAYMENTS
1. Final Payment, Imp. No. 67-39, Storm Sewer. Contractor,
Northdale Construction Co. Amount, $40,960.72.
RESOLUTION NO. 4881
It was moved by Councilman Hanks, seconded by Councilman Thiel,
to waive reading and adopt Resolution No. 4881 entitled, "Resolution
Accepting -Work on Storm Sewer, Improvement No. 67-39. " The
motion carried 6 - 0.

to waive reading and adopt Resolution No. 4883 entitled, "Resolution

Improvement Nos. 65-20, 68-03, 72-23, 72-269 72-29, and 72-32.'t
The motion carried 6 - 0.
On motion of Councilman Hanks, seconded by Councilman Thiel, the
following payments on contract work presented by the City Engineer
were approved, and the City Managers City Clerk and City Treasurer
were authorized to issue checks for their respective amounts by a
six yea vote.
