Mayor Pucci opened the hearing. The Acting Director of Public IIor'cs despribed the proposed project, its nature and location. Mayor Pucci opened the hearing. The City Manager gave a brief history of the project and the Acting Director of Public Workc described the proposed project. The City Assessor then explained the assessment policy for this project. There beirgno one present wishing to speak, the Mayor closed the hearing, Councilman Grial: indicated this was the first time she had observed the design for this project and wished further time to review it. • RESOLUTION NO_ WOOD Councilman Heltzer moved, seconded by Councilman Graves, to waive reading and adopt Resolution No. 4030 entitled, "Resolution Ordering Improvement, Ordering Preparation of Plans, and Authorizing Advertisement for Bids, Improvement No. 72-35, Paving, Curb and Gutter and Sidewalk Repair". The notion carried 4-1-1 (Councilman Grial: voting nay, Councilman Fleetham, abstaining and Councilman Thiel was not present) . (c) IMPROVEMENT N0. 7346, PAVING, CURB, GUTTERS AND DRIVMIAY APP%OACHES ON OXFORD STREET FROM MEADOWBROOK ROAD TO EDGEWOOD AVENUE AND EDGEIsl00D AVEC FROM OYXOr%D STREET TO CAMBRIDGE, AS DESCP�IBED IN NOTICE OF HEARING PUBLISHED 14AY 17 AND 14AY 24, 1973. Mayor Pucci opened the hearing. The Actin" Director of Public Wor?c.s explained the project and the City Assessor explained the assessment policy and the options for payment. Mr. Richard Einck, 3040-3350 Edgewood Avenue, questioned if the Trip rovement would extend to I?ooddale Avenue. The Acting Director of Public I?orlcs indicated it would stop at Edgewood Avenue. The motion was seconded by Councilman Fleetham and carried 6 - 0 (Councilman Thiel was absent) . (d) PROPOSED AMENDMENT TO OFFICIAL 14AP ON LOTS 4, 51 6, BLOCI: 2, BARRETT'S ADDITIO14 AND Oil LOTS 19-26, BLOCK 3, BARRETT'S ADDITION, AN AREA GENEMLLY LOCATED NORTH OF WEST 20TH STREET WEST OF LYNN AVENUE AND EAST OF NATCHEZ AVENUE, AS DESCRIBED IN NOTICE OF HEAD ING PUBLISHED MAY 173 1973. Mayor Pucci opened the hearing". The Planning Director described the proposed amendment to the Official Map and explained the appeal procedure to be followed in this case. 14r. Herb Davis, 6100 Excelsior Boulevard, attorney for the applicant, (PowBel) urged approval of the proposed amendment. The Mayor indicated tie had received letters from 147 resident; in the area opposing this proposed amendment. Mr. Joe Friedberg, 2617 Princeton, spokesman for the residents in the area, spoke in opposition of the proposed amendment. Mr. Max Elkin, 2700 Monterey Avenue, also spoke in opposition of the amendment. There beim; no one else wishing to spew.:, the Mayor declared the hearing closed. It was moved by Councilman Fleethan, seconded by Councilman Hanks, to continue to June 10, 1973 for a report from staff indicating cost estimates for utility extensions, public need and budget impact. It was also suggested that Council members survey this area and that the Par!%s and Recreation Commission, together with the Environmental Improvement Commission, submit recommendations. UNFINISHED BUSINESS (a) APPOINTMENTS TO BOARDS/COtiR�iISSIONS No action was taken on this matter. (b) PURCHASE OF FI:E ATTACK VEHICLE (14, & Co N0. 73-23) It was moved by Councilman Fleetham to authorize purchase, accepting bid of Pierce Ilfr. Company in amount of $3,250 and Chassis through Hennepin County for $3,274,;0 plus necessary equipment to complete fire attaclk: apparatus. The motion was seconded by Councilman Heltzer and carried 7 - 00 (c) HIGFEJAY 7 The City Engineer el:plained the proposed intersection plan which provides for an at -grade intersection for Louisiana and Highway 7. (d) WEST 36TH STREET AND HIGHWAY 100 The Planning Director informed the Council that the consultant is ready to go to final printing and that alternative 9 has been selected as the best alternative by the Planning Commission and Streets and Highway Committee. The Council did not have any statements for the consultant to consider prior to final printing. 10. NEW BUSINESS (a) TAXES ON PUBLIC IAND - PAY114ENT OF Councilman Heltzer moved, seconded by Councilman Graves to authorize payment in an amount not to exceed $600.54. The motion carried 7 - 0. (b) CITIZEN INQUIRY Mr. Floyd Johnson, 2700 Brunswich', questioned the legality of young children gathering at Texa-Ton'_:a Shopping Center, especially the Pizza Place, playingr the pinball machines and smoking. He indicated there was a ;problem in this area and that the Council should consider revocatim of any licenses involved. The Council indicated they were cognizant of a potential problem with this type of business. Councilman Heltzer suggested holding a public meeting and inviting all business merchants and property owners in this area to ascertain if there is a problem or neighborhood concern in this area. After further discussion, Councilman Heltzer indicated he would send out a questionnaire -letter to the residents in this area seeking their comments and then, if necessary, would set-up a public meetinLg. 145 Council Minutes, ik1ay 29, 1973 10.
