SPECIAL CITY COUNCIL MEETING
April 231 1973
The meeting was called to order by piayor Pucci at 6:00 p.m. The following

IV �1Robert Brooks CATV consultant' was present to review the various proposals
r
for cable franchise with the Council. A lengthy discussion was held
relative to procedures to follow in issuing a franchise, methods of selecting
a company to nerrotiate a franchise, and the scheduling of a public hearing
for the issuance of a franchise. The City Attorney indicated that the
City Council has the unrestricted right to proceed as deliberately as it
wishes in this final process and felt that the Council has proceeded
properly taking into consideration the various procedures followed to date.
Councilman Thiel indicated that he felt the intent of the public hearing
should be to select a company to negotiate a franchise for St. Louis Pari:
to ensure that the City receives the best possible franchise for its
citizenry. Mr. Brooks indicated that the Council, in selecting the
company with which it wishes to negotiate a franchise, should specify
additional items to be contained in the franchise providing that the
Federal Communication Co►:mnission's guidelines are not violated. He
indicated that the FCC is concerned with the procedure followed in the
issuance of a franchise when it considers the issuance of a certificate
for the operation of a CATV system.
Mayor Pucci indicated that he felt the Council should conduct a public
hearing at the earliest possible date and hopefully select a company with
which to negotiate a franchise. He stated that if the Council could not
negotiate satisfactorily with the company, then the Council should select
another company which would be willing to provide the equipment and programming
desired. The Council then instructed the City Manager to schedule a public
hearing at which time the three applicants and their proposals could be
discussed with possible agreement on the company with which to negotiate a
franchise for the community.
