CITY COUNCIL MEETING
ST. LOUIS PARK, MINNESOTA
April 2, 1973
1. CALL TO ORDER
A regular meeting of the City Council was called to order by Mayor
Pucci at 8 : 0 5 p.m.
2. INVOCATION
Invocation was given by The Reverend Milton Lenz of the Aldersgate
Methodist Church.
3. ROLL CALL
The following Councilmen were present at roll call:
Frank Fleetham
Rase -Mary Griak
Lyle Hanks
James Heltzer
Leonard Thiel
Frank Pucci
Also present were the City Manager, Assistant City Manager, City
Attorney, Planning Director, Acting Director of Public Works, City
Assessor, and Secretary.
Councilman Graves arrived at 8:25 p.m. Councilman Griak left the
meeting at 10:30 p.m.
4. MINUTES
On motion of Councilman Griak, seconded by Councilman Heltzer,
the minutes of the regular meetings held March 19 and March 26, 1973,
were approved by a s ix yea vote.
5. PUBLIC HEARINGS
(a) ASSESSIVL NT OF IMPROVEMENTS AS DESCRIBED IN NOTICE
OF HEARING PUBLISHED MARCH 15, 1973:
1. Improvement No. 72-06, paving, curb and gutter, and water
main, Florida Avenue and `'fest 23rd Street between cul-de-sac
and Edgewood Avenue
Mayor Pucci opened the hearing.

5. (a) The City Assessor described the proposed special assessment
area and explained the policy as it relates to this particular area.
There being no one present wishing to speak, the Mayor closed
the hearing subject to any motion to continue the hearing that
might be made during the discussion by Council.

There being no one present wishing to speak, the Mayor closed
the hearing, subject to any action taken to continue the hearing
during discussion by Council.
RESOLUTION NO, 4787
It was moved by Councilman Griak, seconded by Councilman
Hanks, to waive reading and adopt Resolution No. 4787 entitled,
"Resolution Adopting Assessment Improvement Nos. 72-04 and
72-06. " The motion carried 6 - 0. (Councilman Graves was not present).
(b) PROPOSED AMENDMENT TO SECTION 6:111, 3 OF THE Z ONING
ORDINANCE i:ELATING TO MOTOR FUEL STATIONS, AS
DESCRIBED IN NOTICE OF HEARING PUBLISHED MARCH 222

Mayor Pucci opened the hearing. �
The Planning Director described the proposed amendment to the
text of the zoning ordinance which would be an aid to stations
where remodeling is being considered but which could not comply
with the requirements of the present zoning ordinance.
Mr. Bradley Steinman, 8224 West 30-1 Street, representing
Holiday Stores, explained that they would be. acquiring a
new store on Excelsior Boulevard and phasing out the old one.
He asked that Council grant a variance in the requirements for
parking at the new location. He was told to submit a formal
application for the variance.
After discussion, it was moved by Councilman Fleetham, seconded

5. (b) by Councilman Graves, to waive first reading of the proposed
ordinance and set second reading Niay 21, 1973. The motion
carried 7 - 0.
It was moved by Councilman Fleetham that staff survey all
stations and bring a report to Council as to whether there are
major implications for any stations in the City. Councilman
Thiel seconded but said he would like inspection of three stations
using a cross-section to be selected by the staff. The motion
carried 7 - 0.
Councilman Fleetham agreed with the second and moved to
amend to set second reading April 30, 1973, Councilman Thiel
seconded and the motion carried 7 - 0.

7. RESOLUTIONS AND CRDINA.NCES
(a) SECOND READING OF ORDINANCE AMENDING MULTI -FAMILY
LICENSING REGULATIONS
The City Manager explained the comments made concerning
recommendations of the Chamber of Commerce Committee,
Councilman Heltzer said he felt the apartment licensing ordinance
should be as strict as the ordinance regulating single family
dwellings and should be self supportive to the same degree.
Councilman Griak asked if the Mayor's Committee will be
reviewing this ordinance and its effects at a later date. The
Mayor said they could be called upon to study its effectiveness
after it has been in force for some time.
ORDINANCE NO, 1215
After further discussion by Council, it was moved by Councilman
Heltzer, seconded by Councilman Griak, to waive second reading
and adopt Ordinance No. 1215 entitled, "An Ordinance Amending
Ordinance No. 1173, Entitled 'An Ordinance Regulating the
Maintenance, Occupancy and Use of Dwellings, and Premises in
the City of St. Louis Park to Protect the Public Health, Safety
and Welfare by Establishing Minimum Standards Governing Basic
Equipment and Facilities, Physical Condition, Maintenance,

7. (a) Occupancy and Use of Such Dwellings, Premises and Structures:
Providing for Administration, Enforcement and Penalties for
Violation Thereof
and Repealing Ordinance No. 1052 and
Ordinance No. 1153' By Adding a New Section Numbered and
Titled as Follows&% The motion carried 5 2, Councilmen Thiel
and Fleetham voting nay.
(b) SECOND READING OF ORDINANCE RELATING TO THE CONDUCT
OF ELECTIONS; PROVIDING A PROCEDURE FOR CANDIDATES
FOR PUBLIC OFFICE TO CONTACT RESIDENTS OF CERTAIN
APARTMENT BUILDINGS (CHANGES MADE AS DIRECTED BY
COUNCIL 3/26/73)
After discussion concerning this ordinance and legislation
being considered at the state level, it was moved by Councilman
Hanks, seconded by Councilman Thiel, to table the matter.
The motion carried A. - 2, Councilman Heltzer and Mayor Pucci
voting nay (Councilman Graves was not present).
(c) SECOND READING OF ORDINANCE AUTHORIZING• SALE BY THE
CITY OF PART OF LOT 22 AND ALL OF LOT 23, BLOCK 4,
BOULEVARD HEIGHTS SECOND ADDITION
ORDINANCE NO, 1217
It was moved by Councilman Hanks, seconded by Councilman
Griak, to waive second reading and adopt Ordinance No. 1217
entitled, "An Ordinance Authorizing Sale by the City of North
Twenty (20) Feet of Lot 22 and All of Lot 23, Block 4, Boulevard
Heights Second Addition. " The motion carried 6 - 0 (Councilman
Graves was not present).
(d) SECOND READING OF ORDINANCE AMENDING SEWER RENTAL
RATES
ORDINANCE NO. 1218
It was moved by Councilman Griak, seconded by Councilman
Heltzer, to waive second reading and adopt Ordinance No. 1218
entitled, "An Ordinance Amending the. St. Louis Park Ordinance
Code Section 1:752 Entitled 'Sewer Rental Rates.The motion
carried 6 - 0 (Councilman Graves was not present).

Mr. James Hyde, Chairman of Citizens Advisory Committee
Mr.
explained that this ordinance had been recommended breed how
concern for safety and neighborhood blight. He explai
the committee had reached its final recommendation in the
proposed ordinance.
It was moved by Councilman Thiel, seconded by Councilman Hanks,
to waive first reading of the proposed ordinance and set second reading
April 16, 1973s The motion carried 7 - 0.

AREAS
It was moved by Councilman Craves, seconded by Councilman
Hanks, to authorize preparation of ordinance and set hearing
date April 30, 1973. The motion carried 7 - 0.
(i) REPORT OF PLANNING COM1VxISSION (CASE NO. 72 -25 -ST)
RECOMMENDING ALTERNATIVE 1 (CURVILINEAR DIVERTER)
AS STREZ'T MODIFICATION AT BRUNS'.j'ICK AND 35TH STREET
It was moved by Councilman Graves, seconded by Councilman
Hanks, that street modification plans be drawn according to
Alternative 1 and that a neighborhood meeting be held. The
motion carried 6 0 (Councilman Griak was not present).
(j) REPORT CONCERNING DOLLING PLACE, WARD I, PRECINCT 5,
(REQUESTED BY COUNCILNLAN GRIAK MARCH 26, 1973)
It was moved by Councilman Craves, seconded by Councilman
Hanks, to defer to April 16, 1973, since Councilman Griak had
left the meeting. The motion carried 6 - 0.
9. UNFINISHED; BUSINESS
(a) PRELIMINARY PLANS - HIGHWAY 7 (DEFERRED FROM
MARCH 5, 1973 )
It was moved by Councilman Hanks, seconded by Councilman
Graves, to defer until comment is received from the State
Highway Depa.r`ment. The motion carried 6 - 0 (Councilman Griak
was not present).
(b) TRAFFIC SIGNA L A T J OPi'A, ING LEW OOD - MINNE TONKA
BOULEVARD (DEFERRED FROM MARCH 19, 1973)
Mr. Jim Gainsley, 2625 Inglewood, had questions concerning the
relationship of plans for the braided system at Highway 7 and
Minnetonka Boulevard to the plans at Highway 7 and Natchez
Avenue.
Mr. David Abrahamson. 2845 Inglewood Avenue, expressed
concern for the possibility of increased traffic on Inglewood.

be considering the over-all traffic and street plan for the area
rather than one traffic signal,
It was explained by staff and Council that these signals hade t
requested for some time and that Hennepin County has agreedt that
such traffic controls ale necessary and is awaiting the City
decision as to their placement.
Dr. Sheldon Sparber, 2800 Inglewood Avenue, suggested that
Council defer a decision until it is sure of its position.
Mr, Art Ingersoll, 28] 5 Joppa Avenue, representing Community
School At Fern ISill, felt the emphasis on this signal had originally
been for pedestrians and has now changed to traffic flow.
After discussion by Council, it was moved by Councilman Hanks,
seconded by Councilman Thiel, to defer the decision for sixty
days, contacting the County to ascertain if locating the signal at
Inglewood will permit control of traffic making left-hand turns;
studying the placement at Joppa Avenue intersection; and investiga-
ting the braided plan at Highway 7 and Minnetonka Boulevard and its
impact on the over-all plan. The motion carried 5 -- 2, Councilmen
Griak and Fleetham voting nay,
Councilman Hanks requested a study of traffic at 28th and Inglewood
for a four-way stop
(c) APPOINTMENTS TO BOARDS/ C ONLMISSIONS
It was moved by Councilman Heltzer, seconded by Councilman
Graves, to appoint 1iir. Larry Rapaport to the Board of Zoning
Appeals to the unexpired term of Joseph V7olfe (expires 12/31/76).
The motion carried 6 - 0 (Councilman Griak was not present).
10. NEW BUSINESS
(a) TABULATION OF BIDS •• TRACTOR MOWER
It was moved by Counci.Iman Fleetham, seconded by Councilman
Hanks, to designate Minnesota Toro as the lowest responsible bidder
and accept bid in amoun*. of $5, 875. The motion carried 6 - 0
(Councilman Griak was not present).

(b) It was moved by Councilman Thiel, seconded by Councilman Graves,
to authorize Planning Department to study this matter. The motion
carried 6 - 0 (Councilman.. Griak was not present).
(c) REQUEST OF HOUSING AND REDEVELOPMENT AUTHORITY
TO INCLUDE PROPERTY AT 4950 DEVANE Y AS ONE OF
SCATTERED SITS FOR HOUSING
Councilman Hanks moved to grant the request. Motion was
seconded by Councilman Fleetham and carried 6 - 0 (Councilman
Griak was not present),
(d) REGULATION OF CABLE TELE VISION - STATZ LEGISLATION
RESOLUTION NO, 4788
It was moved by Councilman Thiel, seconded by Councilman
Fleetham, to waive reading and adopt Resolution No. 4788 entitled,
"Resolution of Opposition to State Regulation of Cable Television. "
The motion carried 6 - 0 (Councilman Griak was not present).
(e) EXTENSION OF EMPLOYMENT (.Ni &C NO. 73-15)
It was moved by Councilman Craves, seconded by Councilman
Fleetham, to approve :he extension of employment of Elsie
Dahlstrom beyond age 65 to December 31, 1973. The motion
carried 6 - 0 (Councilman Griak was not present).
(f) AMENDMENT TO SHOPPERS'CITY SPECIAL PERMIT -
RELATIVE TO REGULATION OF GARDEN CENTER
RESOLUTION NO, 4789
It was moved by Councilman Hanks, seconded by Councilman
Graves, to waive .reading and adopt Resolution No. 4789 entitled,
"Resoluto.on .Amendi.ng Resolution_ No, 4786 Adopted March 26,
1973, Granting Permit Under ,Section 6:176. 2 of the St. Louis
Park Zoning Ordinance for Commercial E evelopment Unit,
Amending Condition No. 3. " The motion carried 6 - 0

COUNCIL CONCERNING COMMUNITY BAND ACTIVITIES
Councilman Graves moved to refer the matter of Community
Band activities to the Human Rights Commission. Councilman
Hanks seconded and the motion carried 6 - 0 (Councilman Griak

12. CLAIMS, APPROPRIA.TIG1\15, AND CONTRACT PAYMENTS
(a) VERIFIED CLAIMS
On motion of Councilman Graves, seconded by Councilman Hanks,
the lists of verified claims prepared by the Director of Finance
and presented to the Council dated April 2, 1973 in the total
amounts of $2, 739n 51 for payroll, and $157, 293. 95 for vendors
were approved, and the City Manager, City Clerk, and City
Treasurer were authorized to issue checks covering same by a
six yea vote (Councilman Griak was not present).
(b) CONTRACT PAYMENTS
1. Final Payment. Improvement No. 72-01, Bass Lake Development.
Contractor, Car? Bolander u Sons Company. Amount, $13, 317.00.
RESOLUTION NO, 4790
It was moved by Councilman Graves; seconded by Councilman
Hanks, to waive reading and adopt Resolution No. 4790 entitled,
"Resolution 1ccepting Work on Bass Lake Development Improve-
ment No. 72"01. " The motion carried 6 - 0 (Councilman Griak
was not present.
2. Partial Payment No. 3, construction of park shelters.
Contractor, Nystrom Constructors, Inc. Amount, $18, 129.26.
3. Partial Payment No. 1. clean sand from wells and repair
pumps, Contractor, Berger son- Caswell Inc. Amount, $19, 206.00
