CALL TO ORDER A regular meeting of the City Council: was called to order by Mayor Pucci at 8:15 p.m. Z. INVOCATION Invocation was given by the Reverend Duane Sarazin of the Aldersgate Methodist Church. 3. ROLL CALL The following Councilmen were present at roll call: Frank Fleetham Rose -Diary Griak Lyle Hanks James Heltzer Leonard Thiel Frank Pucci Also present were the City Manager;. Assistant to the City Manager, City Attorney, Planning Director, Acting Director of Public Works, and Secretary. Councilman Graves arrived at 8:17 p.m. and left the meeting at 10:00 p.m. 4. MINUTES On motion of Councilman Griak, seconded by Councilman Heltzer, the minutes of the regular meeting held April 2, 1973, were approved by a seven yea vote. 5. PUBLIC HEARINGS (a) APPLICATION FOR REZONING PROPERTY WEST OF DAKOTA AVENUE, SOUTH OF WEST 14TH STREET, AS DESCRIBED IN NOTICE OF HEARING PUBLISHED APRIL 5, 1973 (PLANNING C OIViIvIISSI ON REC ONtIVIE N DL' D DENIAL) Mayor Pucci opened the hearing, Mr. Craig 1j7111iams, attorney representing Park Properties, requested continuance for one month in order to complete studies 92 r CurN1 Minutes, April 16, 1973 5. (a) being done by Midwest Planning. It was moved by Councilman Thiel, seconded by Councilman Hanks, to continue the hearing to May 21, 1973, The motion carried 7 - 0. (b) APPLICATION FOR NON -INTOXICATING LIQUOR LICENSE, ON - SALE, THE PIZZA PLACE, 8.120 MINNETONKA BOULEVARD, AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MARCH 29, 1973 Mayor Pucci opened the hearing. Mr. John Buse, owner of The Pizza Place, was present explaining that he hadplans to separate the area into two parts to segregate the area in which beer would be served from the area in which beer would not be served. Councilman Thiel spoke ilt opposition to the granting of the license because no plan was available to show the division of the establish- ment and because he felt the neighborhood was not conducive to this type of license. There being no one else wishing to speak, the Mayor declared the the hearing closed. It was moved by Councilman Thiel, seconded by Councilman Griak, to deny the granting of the license, The motion carried 7 - 0• 6. (d) PETITION REQUESTING SIDEWJF LK REPAIR - 3100 BLOCK OF DAKOTA AVENUE RESOLUTION NO. 4792 It was moved by Councilman Griak, seconded by Councilman Hanks, to waive reading and adopt Resolution No. 4792 entitled, .Resolution Calling Public Hearing on Improvement No. 73-29, Sidewalk Repair."*1 The motion carried 7 - 0. (Hearing called April 30, 1973. 7. RESOLUTIONS AND ORDINANCES (a) SECOND READING OF ORDINANCE REGULATING PARKING OF CERTAIN VEHICLES Mr. Dick Fuller, 8101 17p.'est 34th Street; Ilrir. John Wells, 3327 Huntington Avenue; Mr. Ernie Lenzen, 3015 Dakota Avenue; Mr. Clayton Johnson, 1630 Jersey Avenue; Mr. D. A. Vieburg, 4220 Yosemite Avenue; Mr. Lon Urban, 3904 Xenwood Avenue; and Mr. R. J. Root, 3425 Alabama Avenue, spoke to Council concerning this matter. Some felt terminology should be clarified as it per- tains to weight of recreational vehicle and definition of motor home and mobile home. There was also opposition to restricting parking in front driveways and the parking of vehicles used in occupations and used for transportation to and from jobs. Mr. James Hyde, Chairman of the Civizens Advisory Committee, gave reasons for the proposed ordinance in promoting health, safety, better street plowing and enhancement of neighborhoods. He indicated that some of the vehicles are being used as ware- houses and some are being inhabited without proper sanitation. After considerable discussion by Council, Councilman Griak moved to defer the second reading of the ordinance for two weeks with input going to Mr. Fayde with Mr. John Wells as the citizens' representative, and that terminology of the ordinance be clarified. Councilman Thiel seconded and the motion carried 6 - 0, Councilman Heltzer abstaining. Council Minutes, April 16, 1973 79 (b) SECOND READING OF ORDINANCE REGULATING MOTOR FUEL STATIONS ORDINANCE NO. 1216 It was moved by Councilman Criak, seconded by Councilman Hanks, to waive second reading and adopt Ordinance No. 1216 " entitled, An Ordinance Amending Ordinance No. 1146 Adopted June 7, 19711 Lntitled 'An Ordinance Amending Ordinance No. 1007 Adopted October 16, 1967, Entitled, 'An Ordinance Amending Ordinance 730 Passed December 28, 1959 Entitled, 'St. Louis Park Zoning Ordinance's and, Amending the St. Louis Park Ordinance Code Section 6:142.3 Relating to Special Use Permits; and Repealing the St. Louis -Park Ordinance Code Section 6:049, 1 Subdivision 1 through 10 -Relating to Motor Service Stations', by Amending Section 6:111.3(1), Subdivision and Adding to That Section Subdivision 18 and 19. " The motion carried 6 - 0 (Council- man Graves was not present). (c) RESOLUTION; AUTHORIZING PLACEMENT OF TRAFFIC CONTROL SIGNS ESTABLISHING FIRE LANES - PARK PLACE APARTMENTS RESOLUTION NO. 4793 It was moved by Councilman Hanks, seconded by Councilman Heltzer, to waive reading and adopt Resolution No. 4793 entitled, "Resolution Authorizing Placement of Traffic Control Signs Establishing Fire Lanes. " The motion carried 6- 0 (Councilman Graves was not present). (d) RESOLUTION CALLING HEARINC - SIDEWALK UMPR OVEIViE NT VERNON AVENUE - IM.PROVEMENT NO, 71-17 REQ OLUTION NO, 4794 It was moved by Councilman Hanks, seconded by Councilman Fleetham, to waive reading and adopt Resolution No. 4794 entitled, "Resolution Calling Public Hearing on Improvement No. 71-17 Sidewalk Construction. " The motion carried 6 - 0 (Councilman Graves was not present). (e) RESOLUTION AUTHORIZING AE FOR BIDS - IMPROVEMENT NO. 72-07B RESOLUTION NO. 4795 It was moved by Councilman Hanks, seconded by Councilman 95 Council Minutes, April 16, 1973 7. (e) Fleetham, to waive reading and adopt Resolution No. 4795 entitled, "Resolution Approving Plans and Specifications and Crdering Advertisement for Bids Improvement No. 72-07B. " The motion carried 6 - 0 (Councilman Graves was not present). 8. REPORTS OF OFFICERS, BOARDS, AND COMMITTEES (a) REPORT RELATIVE TO PROPOSED CITY CHARTER REVISIONS (MPC NO. 73-16) It was moved by Councilman Hanks, seconded by Councilman Heltzer, to refer the proposed changes to the Charter Committee for study. The motion carried 6 - 0 (Councilman Graves was not present). (b) REPORT OF PLANNING COMMISSION RECOMMENDING AMEND- MENT TO ZONING ORDINANCE REGULATING FENCES (CASE NO. 72-48-Z) It was moved by Councilman Griak, seconded by Councilman Fleetham, to authorize drafting of an ordinance as recommended. The motion carried 6 - 0 (Councilman Graves was not present). (c) REPORT OF TRAFFIC STUDY (#67) - WYOMING AND WEST 28TH STREET Councilman Heltzer moved that no further consideration be given to the extension of West 28th Street to Wyoming Avenue. Council- man Hanks seconded and the motion carried 6 - 0 (Councilman Craves wassnot present). (d) REPORT RELATIVE TO SEA! R ALLOCATION CHARGE (M&C NO. 73-17) The City Attorney explained the suit that has been brought and that it binds all units of government by its outcome. Councilman Thiel moved that the City participate on a voluntary basis on the side of the defendant. Councilman Griak seconded and the motion carried 6 - 0 (Councilman Graves was mot_ present). (e) REPORT OF TRAFFIC STUDY (#66) - INTERSECTION OF INGLZWOCD AVENUE. AND WEST 28TH STREET It was moved by Councilman Hanks, seconded by Councilman Griak to authorize preparation of resolution placing stop signs on Inglewood Avenue at West 28th Street. " The motion carried 6 - 0 (Councilman Graves was not present). (k) PRELIMINARY REPORT OF DIRECTOR OF' PUBLIC WORKS AND ASSESSIv;ENT REPORT WITH RESPECT TO IMPROVEMENT NO. 73-25, PAVING, CURB AND GUTTER, FLAG AVENUE Councilman Hanks moved that the shape of the cul-de-sac on this street should be of the standard design. Councilman Griak seconded and the motion carried 5 - 0, Councilman Thiel abstaining and Councilman Graves not present). RESOLUTION NO. 4800 It was moved by Councilman Griak, seconded by Councilman Hanks, to waive reading and adopt Resolution No. 4800 entitled, "Resolution Calling Public Hearing on Improvement No. 73-25 Paving, Curb and Gutter. " The motion carried 6 - 0 (Councilman Craves was not present). " The motion carried 6 - 0 (Councilman Craves was not present), (m) MINUTZS OF PARKS AND RECREATION ADVISORY CO1V WITTEE MEETING HELD APRIL 11, 1973 There being no discussion, the minutes were ordered by the Mayor to be received for filing. Council Minutes, April 16, 1973 9, UNFINISHED BUSINESS (a) TEXA-TONKA AREA STREET MODIFICATIONS (DEFERRED FROM, MARCH 19, 1973 ) The Planning Director explained the alternatives proposed to help to resolve the traffic problem in this neighborhood. Mr. Jim Rodberg, 2910 Virginia Avenue, felt a barricade at 28th and Virginia would help to reduce traffic and suggested there be no left turn off Texas Avenue into the shopping center. Mrs, Marcia Kurvers, 2917 Texa Tonka, recommended no left turn off Texas into the shopping center and indicated she is in favor of two barricades. Mr. 1 illiam Schackman, 2820 Virginia Avenue, requested information on origin and destination studies which was given to him by the City Manager. Councilman Heltzer moved to authorize curvilinear diverter at 28th Street and Virginia Avenue in accordance with plan identified as Alternative "B". Councilman Graves seconded and the motion carried 5 - 2, Councilman Criak and Councilman Hanks voting nay. (b) PROPOSED VARIANCE FROM THE REQUIREMENTS OF SECTION 6:045.2 OF THE ZONING ORDINANCE TO ALLOW A FENCE SIX FEET IN HEIGHT INSTEAD OF THE PERIviITTED THRIZAE AND ONE-HALF FEET FOR A SIDE YARD ON A CORNER AT 6324 Vi;' ST 33RD STREFT It was moved by Councilman Hanks, seconded by Councilman Griak, to deny the variance requested. The motion carried 6 - 0 (Council- man Graves was not present). (c) APPOINTMENTS TO BOARDS/COMNiISSIONS Mayor Pucci suggested Ms. Marcia Jensen be given consideration in the future for appointment to the Police Civil Service Commission. It was moved by Councilman Hanks, seconded by Councilman Griak, to defer appointments to April 30, 1973. The motion carried 6 - 0 (Councilman Graves was not present). Green Ash, $33. 00; Norway Maple 35. 001 American Linden, $35, 00; Hackberry, $35. 00 -- #2 Grade Green Ash, $95.00; American Linden, $95.00; Sugar Maple, $110.00; Honey Locust, $110, 00; and Pin Oak, $110. 00. The motion carried 6 - 0 (Councilman Graves was not present). (b) STAFF COIvd�'.ENDATION - EXPO 173 Councilman Fleetham moved staff be commended for its work on Expo 173. Councilman Griak seconded and the motion carried 6 - 0 (Councilman Graves was not present). (c) EDUCATION CONFERENCE It was moved by Councilman Fleetham, seconded by Councilman Griak, to authorize attendance of conference at St. Cloud by any member of Council and one staff member. The motion carried 6 - 0 (Councilman Graves was not present). (d) PLANNED COMMERCIAL AND RESIDENTIAL DEVELOPMENT - ESTON,VIRGINIA Councilman Thiel requested that the Planning Department consider the concept of development at Reston, Virginia and how it may be adapted in the Republic Creosote area. MISCELLANEOUS (a) DAMAGE CLAIMS 1. Mrs. Shirley L. Zatz 2. Matthew Jerome, 4219 Duke Drive, Minnetonka It was moved by Councilman Hanks, seconded by Councilman Grimm' to file claims with City Clerk for proper action by the City Manager and City Attorney. The motion carried 6 - 0 (Councilman GraVes 100 Council Minutes, April 16, 1973 11, (a) was not present). (b) REQUEST FOR ADDITIOI�1IAL TAXI CABS - TOWN TAXI Council set date for hearing April 30, 1973 relative to certificate of convenience for L-�,.:Licabs, (c) VACATION OF PO .'`'ION OF STZ1✓'ET -ALLEN CI-IRISTY It was moved by Councilman Thiel., seconded by Councilman Hanks, to set date f.o-.m hearing on vacation of portion of street on April 30, 1973. The motion carried 6 on 0 (Councilman Graves was not present), (d) BENCH an COUNCIL :1HAN.T.3r'RS The City Manager explained that the Hennepin County administrator had written a. letter requesting that the judges bench be raised. It was suggested by Council that the City Manager obtain quotations to have this work done. 12. CLAIMS, APPROPRIATTONS, AND CCNTRACT PAYMENTS (a) VERIFIED CLAIMS On motion of Councilman Hanks, seconded by Councilman Griak, the lists of verified claims prepared by the Director of Finance and presented to the Council dated April 16, 1973 in the total amounts of $2, 223, 98 for payroll, and $59, 900c 60 for vendors were approved, and the City Marager City Clerk, and City Treasurer were authorized to issue checks covering same by a six yea vote, removing $12. 00 payment to Lyle Hanks 13.
