CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Pucci at 8:02 p.m. 2. INVOCATION Since there was no one present from the Ministerial Association, no invocation was given. 3. ROLL CALL The following Councilmen were present at roll call: Frank Fleetham Richard Graves Rose -Mary Griak Lyle Hanks James Heltzer Frank Pucci Also present were the City Manager, Assistant City Manager, City Attorney, Planning Director, City Engineer, Supervisor of Building and Zoning, and Secretary. 4. MINUTES On motion of Councilman Fleetham, seconded by Councilman Heltzer, the minutes of the regular meeting held February February 5, 1973, were approved by a six yea vote with the following amendment: Item 12(a), Page 39, paragraph 5, "Councilman Griak withdrew her motion, feeling she had made her point... " 5. PUBLIC HEARINGS None 6. PETITIONS, REQUESTS, AND COMMUNICATIONS (a) REQUEST OF STATE OF MINNESOTA DEPARTMENT OF MILITARY AFFAIRS OFFICE OF THE ADJUTANT GENERAL TO ESTABLISH A ST. LOUIS PARK NATIONAL GUARD UNIT It was moved by Councilman Graves, seconded by Councilman Fleetham, to refer this matter to the Citizens Advisory Committee and Planning 41 Council Minutes, February 120 1973 6. (a) Commission for study and recommendation. Councilman Heltzer voting nay. The motion carried 5 i i 7. RESOLUTIONS AND ORDINANCES (a) RESOLUTIONS REQUESTING STATE LEGISLATION AS FOLLOWS: ipalities the Local option to Eliminate Department 1. Allowing Munic Heads in Police and Fire Departments from Civil Service Premium 1 2. Amending Requirements for State -Aid Fire Insurance and Me;nbership Requirements for Police and Fire Pension Fund Boards, 3. Amending the State Law on Veterans' Preference and Privileges of Municipalities in Salary Payments to Employees Involved in Military Reserve Training. It was moved by Councilman Fleetham, seconded by Councilman Graves, to defer to February 20, 1973. The motion carried 6 - 0. (b) RESOLUTION AUTHORIZING PLACEMENT OF SIGNS ESTABLISHING PARKING RESTRICTIONS IN FRONT OF 6900 WEST LAKE STREET (AUTHORIZED BY COUNCIL FEBRUARY 5, 1973 ) RESOLUTION NO. 4761 It was moved by Councilman Hanks, seconded by Councilman Fleetham, to waive reading and adopt Resolution No. 4761 entitled, "Resolution Authorizing Placement of Traffic Control Signs Regulating Parking." The motion carried 6 -- 0� (c) FIRST READING 0 F PROPOSED ORDINANCE AMENDING SECTION 2:1670.29 AND SECTION 2;1670, 37 OF THE ST. LOUIS PARK ORDINANCE CODE REGULATING SWIMMING POOLS (M&C NO. 73-04) It was moved by Councilman Graves, seconded by Councilman Fleetham, to ,Tvaive first reading of proposed ordinance and set second reading February 20, 1973. The motion carried 6 - 0. (d) RESOLUTION AUTHORIZING THE RELEASE OF SECURITIES AND APPROVAL OF SUBSTITUTED SECURITIES OF MARQUETTE NATIONAL BANK OF MINNEAPOLIS 42 i' Council MlO tes, February 12, 1973 7. (d) RESOLUTION NO, 4762 It was moved by Councilman Griak, seconded by Councilman Fleetham, to waive reading and adopt Resolution No. 4762 entitled, "Resolution Authorizing the Release of Securities and Approval of Substituted of Marquette National Bank of Minneapolis, Minnesota. it The motion carried 6 - 0. 8. REPORTS OF OFFICERS, BOARDS, AND COMMITTEES (a) REPORT OF PLANNING COMMISSION (CASE NO. 73-6-T) REC OMME LADING CONCURRENCE WITH STATEMENT OF PLANNING DEPARTMENT REGARDING SHORT RANGE TRANSIT IMPROVEMENT PROGRAM FOR I-394 CORRIDOR The Planning Director described the transit route recommended by the Planning Commission. It was moved by Councilman Griak, seconded by Councilman Heltzer, to concur with Planning Commission recommendation, with particular concern that goals (Route 4) be carried out. The motion carried 6 - 0. (b) REPORT OF TRAFFIC STUDY (#63) - STREETS V71TH HIGH VOLUME TRAFFIC (REQUESTED BY COUNCIL) After discussion concerning effects of closing of streets to through traffic, Councilman Graves moved to defer further action until minutes of Task Force Sub -committee are available. Councilman Hanks seconded and the motion carried 6 - 0. 9. UNFINISHED BUSINESS (a) MULTI -FAMILY LICENSING - REPORT OF STUDY COMMITTEE (DEFERRED FROM JANUARY 29, 1973 ) After discussion concerning problems of getting notices to apartment dwellers and the feasibility of holding a public hearing, Councilman Griak moved to set date for first reading of the amended ordinance March 5, 1973. Councilman Heltzer seconded and the motion carried 5 - 1, Councilman Fleetham voting nay because he felt there should be a public hearing. (b) LAND TRANSFER (EXCHANGE)- GEORGE'S IN THE PARK (DEFERRED FROM JANUARY 29 AND FEBRUARY 5, 1973) It was moved by Councilman Graves, 43 seconded by Councilman Hanks, Council Minutes, February 125 1973 90 b to defer to February 20, 1973. The motion carried 6 - 0. c REDETERMINATION OF WARD BOUNDARIES AS REQUIRD BY SECTION 2.03 OF THE CITY CHARTER (DEFERRED FROM JANUARY 29 AND FEBRUARY 5, 1973) After discussion concerning the alternatives presented, Councilman "F". Councilman Graves seconded Heltzer moved to accept Alternate the motion,, Since Alternate "F" moves Councilman Fletetham from his ward, Councilman Griak moved to amend Alternate F by moving the portion near railroad tracks into Ward 1. Counci.lm o and it and Graves accepted this amendment to the original moHeltzert carried 4 - 2, Councilmen Hanks and Fleetham voting nay. (d) APPOINTMENTS TO BOARDS/ COMMISSIONS (ONE VACANCY HUMAN RIGHTS COMMISSION,ONE EACH EXPIRED TERM ON POLICE CIVIL SERVICE AND HOUSING AND REDEVELOPMENT AUTHORITY) It was moved by Councilman Graves, seconded by Councilman Griak, to defer to February 20, 1973. The motion carried 6 - 0. (e) APPOINTMENT TO POLLUTION CONTROL AGENCY ' t It was moved by Councilman Graves, seconded by Councilman Griak, to communicate to the Governor the Council's support of Steven Gadler for reappointment to the Minnesota Pollution Control Agency. The motion carried 6 - 0. (f) ADMITTANCE OF CANDIDATES TO APARTMENT BUILDINGS RESOLUTION NO, 4763 It was moved by Councilman Heltzer, seconded by Councilman Graves, to waive reading and adopt Resolution No. 4763 entitled, "Resolution in Support of Legislative Bill Requiring Admittance of Candidates �'*hile Campaigning for Election. " The motion carried 6 - 0. I 10. NEW BUSINESS None 11, MISCELLANEOUS (a) DAMAGE CLAIMS 1.
