LOUIS PARK, MINNESOTA October 2, 1973 i I, CALL TO ORDER A special meeting of the City Council was called to order at 3:10 In the absence of the Mayor and President Pro Tera, Councilman Griak.mo assumed the presiding chairman. 2, INVOCATION 3. 4. 111one ROLL CALL The following Councilmen were present at roll call: Frank Fleetham Richard Graves Rose -Mary Griak Lyle Hanks Also present were the* City Manager, Assistant City Manager, City Attorney, Director of Public Works, City Assessor and Actino Secretary. PUBLIC HEARINGS (a) ASSESSNNENT, I11PROVEMENT NO. 72-1217 PAVING, CURB AND GUTTER, SIDEWALK, MUNICIPAL PARKING AND LIGHTING, TAKE STREET FROM WOODDALE TO WALKER, ALLEY NORTH OF LAKE STREET FROM DAKOTA TO IDAHO; IDAHO AND GEORGIA FROM TAKE STREET TO ALLEY NORTH OF LAKE STREET, AS DESCRIBED IN NOTICE OF HEAPING PUBLISHED SEPTEMBER 13, 1973. Chairman Griak opened the hearing. The Director of Public Works described the improvement and the City Assessor explained the assessment policy. Dr. I. Posnick, 3400 Dakota Avenue (representing Park Enterprise) stated _ that he felt he had adequate parking and the additional parking in the alley parking lot was of no benefit. Dr. Posnick indicated he had paid for some alley improvements in the past and that others were should pay for such improvements. using the parking lot and thus He also protested his assessment stating he had already been assessed for 209.5 feet (previous assessment for Dakota Avenue) . The City Manager explained the parking restrictions had been placed as a result of meetings of the property owners in the area, 2001 Special Council Minutes, October 2, 1973 4 . (a) 11r. Jeff London (London Sales), 6528 West Lake Street, indicated he did not feel that his property benefited by the amount of the assessment but had no objections for the street assessment or the side street/lot assessment. He was concerned about the parking lot/alley, in the back of his property and felt he did not receive sufficient benefit to warrant the amount of assessment, Mr. London felt the City should bear majority of this project cost because of this area and City benefit. Miss Mary Daly, 6422-24 Lake Street, spoke in opposition of the assessment and felt there was no space for loading on Georgia and that the flow of traffic should be reversed. She also indicated she had existing on-site pa,:king and should not have to pay as much for the alley/lot assessment as others because of this existing parking. The City Attorney indicated that a recent Supreme Court decision required the City to assess on potential -use basis and not necessarily on the existing use. Mr. Ken Wolfe (Associated Lithographers), 6500 Lake Street, felt State Aid Funds (MSA) should be used, as in other areas, for this project. He also indicated the City should investigate the feasibility of selling this property back to the abutting property owners in order for them to privately police and control and maintain. There being no one else wishing to speak, the Chairman declared the hearing closed. RESOLUTION N0, 4926 It was moved by Councilman Hanks, seconded by Councilman Graves, to waive reading and adopt Resolution No. 4926 entitled, "Resolution J Adopting Assessment Improvement No. 72-1211, reducing the assessment from $60.3£ to $45.00 per front foot fo:: the alley/lot parking. In addition, the Council requested the measurement of Dr. Posnick's property be made and that the assessment be adjusted accordingly /)„ with credit given for any sidewalk,, curb and guttering previously assessed. The Director of Public Works described the improvement and the City Assessor explained the assessment policy. Mrs. Sara Charney, 3905 Alabama Avenue, objected to the indicating she had no direct benefit because water still front of her residence. 2002 assessment exists in Special Council Minutes, October 2, 1973 4. (b) Mr. Herbert Mars, 3817 Brunswick ' connected to a storm sewer 11lndzcated that he had already been and should not be assessed, There no closedbtheghearine else present wishing to speak, Chairman G hearing, rialc RESOLUTION N0, 4927 It was moved by Councilman hanlcs seconded by Councilman Graves, to waive reading and .adopt Resolution No. 4927 entitled, "Resolute Adopting Assessment Improvement No. 63-0311. The motion carried 4-0. The Manager advised the Council that he would tool: into Mrs. Charney's situation and see what could be done and that Mr. Marx's assessment would be checked to determine its accuracy. 5. RESOLUTION OF COMMENDATION - CAPTAIN JAMES DAHL RESOLUTION N0, 4923 Councilman Graves moved to waive reading and adopt Resolution No. 4923 entitled, "Resolution of Appreciation". The motion was seconded by Councilman Fleetham and carried unanimously. 6.
