INVOCATION Invocation was given by The Reverend Duane Sarazin of the Aldersgate Methodist Church. 3. ROLL CALL The following Councilmen were present at roll call: Frank Fleetham Rose -Mary Griak Lyle Hanks James Heltze r Leonard Thiel Frank Pucci Also present were the City Manager, Assistant City Manager, City Attorney, Planning Director, Director of Public Works, and Secretary. i 4, MINUTES On motion of Councilman Griak, seconded by Councilman Heltzer, the minutes of the regular meeting held October 9, 1973, were approved by a six yea 'vote. j 5. PUBLIC HEARINGS (a) AMENDMENT TO COMPREHENSIVE PLAN AND PROPOSED REZONING OF PROPERTY IN AREA OF AL'S LIQUOR STORE, AS DESCRIBED IN NOTICE OF HEARING AND CONTINUED FROM MAY 14, JUNE 18, JULY 30, AND SEPTE1v!BER 4, 1973 (CASE NOS. 72 -49 -CP AND 72-34-Z). (a) It was moved by Councilman Hanks, seconded by Councilman Thiel, to authorize proclamation be signed by the Mayor. The motion carried 6-0. (b) APPLICATION OF PARK' TERRACE SUPPER CLUB, INC. DBA DUFF'S IN THE PARK FOR TRANSFER OF CAPITAL STOCK Councilman Griak moved to set date for public hearing October 29, 1973. Councilman Hanks seconded and the motion carried 6 - 0. (c) REQUEST BY COUNCILMAN HELTZER RELATIVE TO RESOLUTION DISAPPROVING MEADOWBROOK ViOMEN'S CLINIC AND SUPPORTING MEMORIAL RESOLUTION PASSED BY MINNESOTA STATE LEGISLATURE ASKING CONSTITUTIONAL AMENDMENT Councilman Heltzer introduced a resolution expressing concern for human life and expressing objection to abortions being performed at the Meadowbrook Clinic. He brought this at the request of 1, 300 persons protesting the clinic, some as members of the Minnesota Cxtizena. Concerned for Life, Inc. Mr. John Angel, 4358 Coolidge Avenue, presented petitions in opposition to the abortion clinic and expressed his personal opposition. The Mayor explained that the Council can take no action to remove the clinic since it is a legal operation, conforming to all zoning ordinances and existing ordinances and statutes. Mr. Robert McCoy, 549 Turnpike Road, administrator of the Meadowbrook Clinic, spoke in favor of the operation of the clinic and cited statistics of a poll taken by Congressman Frenzel showing 7376 favoring free choice of abortion. Mr. Harry Rose, 2653 Xenwood Avenue, challenged statistics mentioned by Mr. McCoy as not being representative of the citizens of St. Louis Park. Mrs. Margaret Lampe, 3924 Dakota Avenue; Mrs. Pat Mennenger, 3274 Xenwood Avenue; and Mrs. Nancy Koster, 5001 West 40th Street; spoke in opposition to the clinic. Mrs. Tinka Messinger, 2620 Glenhurst Place, favored free choice in such matters. RESOLUTION NO, 4936 It was moved by Councilman Heltzer, 292 seconded by Councilman Thiel, council Minutes, October 15, 1973 to waive reading and adopt Resolution 6. (c) No. 4936 entitled "Resolut Expressing Concern for Human Life. it ion Councilman Hanks stated that he was voting as an individual on this resolution, not as a representative of the second ward since to do s would necessitate public meetings and discussions. Councilman o Fleetham indicated that he was voting for the resolution on a personal basis and that his vote should not be construed or intended to neces- sarily express the views of the residents of St. Louis Park. Council- men Thiel and Heltzer, and Mayor Pucci concurred with the idea that their votes would indicate their personal view of the matter. Vote on the motion carried 5 - 1, Councilman Griak voting nay because any vote would not alter the situation and that it would not be too valid to have Council address themselves to this unless the citizens wish to poll the Council on their personal views. She explained that she was not an advocate of abortion but felt it should be an individual choice between patient and doctor. Councilman Heltzer moved to direct staff to send the resolution and vote to the congressional delegation. Councilman Thiel seconded and the motion carried 6 - 0. 7. RESOLUTIONS AND ORDINANCES (a) RESOLUTION AMENDING RESOLUTION NO. 4720 ADOPTING POSITION CLASSIFICATION ASSIGNMENT TABLE EFFECTIVE JANUARY 1, 19739 RESOLUTION NO. 4937 It was moved by Councilman Heltzer, seconded by Councilman Griak, to waive reading and adopt Resolution No. 4937 entitled, "Resolution Amending Resolution No. 4720 Adopting. Position Classification Assign- ment Table Effective January 1, 1973. " The motion carried 6 now 0. (b) PROPOSED ORDINANCE AMENDING THE FOLLOWING SECTIONS OF THE ST. LOUIS PARK ORDINANCE CODE RELATIVE TO THE POSITION CLASSIFICATION PLAN, COMPENSATION PLAN, BASIC PERSONNEL POLICY AND CONDITIONS OF CITY EMPLOYMENT: SECTION 1:308 COMPENSATION AND SECTION L316 SICK LEAVE, INJURY ON DUTY PAY AND SEVERANCE PAY• ORDINANCE NO. 1248 It was moved by Councilman Griak, seconded by Council mEmergency to waive readingand adopt Ordinance No. 1248 entitled, An Emer g 293 Council Minutes, October 15, 1973 7. (b) Ordinance Amending the Following Sections of the St. Louis Park Ordinance Code Relative to the Position Classification Plan, Compensa- tion Plan, Basic Personnel Policy and Conditions of City Employment: Section 1:308 Compensation and Section 1:316 Sick Leave, Injury on Duty Pay and Severance Pay. " The motion carried 6 - 0. (c) RESOLUTION APPROVING PRELIMINARY DLA NS FOR PEDESTRIAN BRIDGE AT WEST 36TH STREET AND T. H. 100. RESOLUTION NO. 4938 It was moved by Councilman Fleetham, seconded by Councilman Hanks, to waive reading and adopt Resolution No. 4938 entitled, "Resolution Approving Preliminary Plans for Pedestrian Bridge at West 36th and T. H. 100. " authorizing retention of design engineer. Carried 6 - 0. 8. REPORTS OF OFFICERS, BOARDS, AND COMMITTEES (a) REPORT OF DIRECTOR OF PUBLIC WORKS RELATIVE TO FLAG AVENUE AND FRANKLIN AVENUE WATER STATION, RESERVOIR, AND TREATMENT PLANT, IMPROVEMENT NO. 72-04B. It was moved by Councilman Thiel, authorize advertisement for bids. seconded by Councilman Griak, to The motion carried 6 - 0. (b) REPORT OF TRAFFIC STUDY (#77) - GLENHURST AND INGLEWOOD AVENUES FROM HIGHWAY 7 TO WEST 31ST STREET AND WEST 31ST STREET FROM FRANCE AVENUE TO INGLEWOOD AVENUE. Councilman Hanks moved to authorize resolution placing a year-round weight restriction on Inglewood Avenue from T. H. 7 to West 31 st Street and on West 31st Street from France Avenue to Inglewood Avenue of four tons per axle. Councilman Griak seconded and the motion carried 6 - 0. (c) MINUTES OF PLANNING COMMISSION MEETING HELD OCTOBER 39 1973. There being no objection, the minutes were ordered by the Mayor to be received for filing. (d) REPORT OF PLANNING COMMISSION RELATIVE TO RESTAURANT STUDY. Councilman Thiel complimented staff for their report and moved that necessary ordinances be prepared and brought for consideration at a special meeting of the Council, indicating his preference that special permit provisions not be a major portion of the ordinance. UNFINISHED BUSINESS (a) SENIOR CITIZEN HOUSING (SECOND READING TABLED AUGUST ? 1972)o It was moved by Councilman Griak, seconded by Councilman Thiel, to remove this matter from the table. The motion carried 6 - 0. After discussion concerning possible changes in usage in the future resulting in inadequate parking, Councilman Griak moved that provision be made in the ordinance to stipulate that any change in usage be referred to the Council. Councilman Heltzer seconded but no vote was taken on the motion. The City Attorney explained that the proposed ordinance would be violated if there were any change in usage. .After further discussion, Councilman Fleetham suggested that Mr. Joel Glotter, chairman of the Housing and Redevelopment Authority be invited to a meeting to discuss this matter with the City Council. Councilman Hanks moved to defer the matter to October 29, 1973 with consideration being given to require 350 square feet of open space and .3 parking space per unit. Councilman Thiel seconded and the motion carried 6 - 0. (b) APPOINTMENTS TO BOARDS/COMMISSIONS (COMMUNITY RELATI ON5) Councilman Hanks moved to appoint H. Stewart Mann, Cedarhurst - Blackstone area; Mary Schwebel, to replace Jim Schwebel, at -large, and Louise Hokenson, Aquila area. NEW BUSINESS (a) TABULATION OF BIDS - PROJECTS 73-01 AND 73-02, LIFT STATIONS AT 31ST STIREET AND DAKOTA AVENUE AND AT WEBSTER AVENUE AND HIGHWAY NO. 7. It was moved by Councilman Griak, seconded by Councilman Thiel, to designate Northern Contracting Co. as lowest responsible bidder in sum of $38,775, 47 and authorize award of contract. The motion carried 6 - 0. (b) HONORABLE, MENTION AWARD BY STATE TO HUMAN RIGHTS COMMISSION Councilman _Heltzer asked that the Human Rights Commission and staff be commended for an award for the Affirmative Action Program♦. 11. MISCELLANEOUS (a) DAMAGE CLAIMS L Bert Kollins, 2660 Yosemite Avenue Councilman Thiel moved to file claim .with City Clerk for proper action by the City Manager and -City Attorney. The motion was seconded by Councilman Griak and carried unanimously.. {b) FIRE UNION LOCAL 993 -- CONTRACT RATIFICATION Councilman Hanks moved to ratify the contract with Local 993. Councilman Griak seconded and the motion carried unanimously. (c) METRO LEAGUE MEETING NOVEMBER 8, 1973 Councilman Pleetham moved to authorize attendance of any council m -ember at Metro League meeting November 8, 1973.
