LOUIS PAP,K, MINNESOTA September 25, 1972 of the City Council was called to order by Mayor Pucci The following Councilmen were present Franit F leetham Richard Graves Rose4lary Grialc Lyle Hanks Leonard Thiel. Fran'.: Pucci at roll call: Also present were the City Manager, Assistant Planning Director, Director of Public Worlcs, Secretary, Councilman Heltzer arrived at 8:05 p,m. INVOCATION City Manager, City Attorney, City Assessor and Acting There being no one present from the Ministerial Association there was no invocation. MI NUTES On motion of Councilman Griak, seconded by Councilman Thiel, the minutes of the regular meeting held September 11, 1972 and minutes of special meeting held September 12, 1972 were approved by a six yea vote. PUBLIC HEARINGS (a) IMPROVEMENT NO. 72-14, STORM SEYER, IN DrAINAGE AREA BOUNDED IN GENERAL BY MINNETONKA BOULEVARD ON THE NORTH TRUNK HIG191AY 100 ON THE WEST, CHICAGO, MILWAUKEE RAIUTAY ON THE SOUTH, AND INGLEWOOD AVENUE ON THE EAST, AS DESCRIBED IN NOTICE OF HEARING PUBLISHED AUGUST 24 AND AUGUST 31, 1972. Mayor Pucci opened the hearing. The Director of Public Works described the proposed improvement and the City Assessor explained the assessment policy. Mrs, Charles Swanson, 3031 Salem Avenue, by property owners in the area objecting and paving improvements, 301 F 5 presented a petition signed to both the storm sewer,, Council Minutes, September 25, 1972 5. (a) tir. Thorwald Nessheim, 3120 Salem Avenue, and R. C. Gendreau 3057 Ottawa, indicated they had flooding problems and spoi;e in favor of the improvement. Mr. E. F. Kadlec, 3133 Salem Avenue and Paul Olson, 3124 Lynn, spoke in opposition, Councilman Thiel gave the background on the indicated this improvement was a portion of system in the City, storm sewer program and the over-all storm sewer Mr. John O'Rourke, 3149 Salem, questioned what percentage of cost would come out of general fund monies. Mayor Pucci indicated that appro:;imately two-thirds of the total cost would come from general funds. Mr. Eder, 7612 Minnetonka Boulevard, spoke in opposition of storm sewers, but indicated an interest in permanent street paving, Mr. Ron Bailey, 3111 Toledo, felt more consideration should be given to Tors. Swanson's petition and the work: she had done in obtaining the signatures, There being no one else wishing to speak, the Mayor declared the hearing closed, Councilman Hanks indicated that construction costs were rapidly rising and he felt other property owners throughout the City should not have to continue to subsidize those areas from their twA contributions which do not have needed storm sexier facilities, Councilman Fleetham stated that sidewalks, driveways, streets, etc, all conttibute to water conditions and that this project was just one of the total storm drainage plan. He further indicated it would relieve the water ponding condition in Carpenter Park which is used by the entire community for leisure activities. Mayor Pucci closed the hearing. RESOLUTION NO. 4644 It was moved by Councilman Thiel, seconded by Councilman Hanks, to waive reading and adopt Resolution No. 4644 entitled,"R solution Authorizing Ordering Improvement, Ordering Preparation of Plans, and Advertisement for Bids, Improvement No. 72-14, Storm Sewer". Mayor Pucci opened the hearing. Council Minutes, September 259 1972 5, (b) There being no one wishing to speak, MayO1 Pucci closed the hearing, Councilman Thiel moved to defer this co�°ect until the storm sewer construction was nearly complete or completed (approximately nine months or one year). Councilman Graves seconded. Councilman Hanks indicated he would like to have placed in the motion that the improvement shall be assessed under the "old it wasassessment rateof $0.00 per front foot. After foulddlualify under the old by the Council that this project Q assessment policy if the paving project was ordered in at the next hearing which should be scheduled after the storm sewer construction work is completed in the street area affected. The motion carried 7 - 0. The Mayor declared a fifteen minute recess. The meeting was resumed at 9:25 p.m. 5. AND Dr%IVEG#IAY APPROACHES, IN AREA BOUNDED IN GENERAL BY 23TH STREET ON THE NORTH, LOUISIANA AVENUE ON THE EAST, TO AND INCLUDING 34TH STREET ON THE SOUTH AND TEy►AS AVENUE ON THE WEST, AS DESCRIBED IN NOTICE Or HEARING PUBLISHED SEPTEIiBER 1 AND SEPTEMBER 14, 1972. Mayor Pucci opened the hearing. Mr. Nathan Stuebetro, 2337 Pennsylvania, felt he should not be assessed for the project because of the poor workmanship involved in the improvement, The block wort; was poor thus causing a water problem in front of driveway. Mr. James Hinshaw, 5105 6T . 20th Street; Mr. John Larson, 3044 Quebec; J. J. Dewyze, 3025 Rhode Island; Carl A. Kraft, 2331 Quebec; Willard Swerdlich., 2340 Sumter; P.ichard Loftus, 2900 Louisiana Avenue; K. M. Huiras, 2025 Sumter Avenue; J. M. Lovlein, 3141 Maryland Avenue; L. D. Pratt, 2354 Louisiana Avenue; Barbara George, 3101 Oregon; had questions and complaints concerning the construction and the assessment of the project. Questions were promptly answered by staff and Council or appointments :Wade to meet with citizens within the next few days to handle the various questions and complaints. Mayor Pucci closed the hearincy. The motion was seconded by Councilman Griak and carried 7 - 0. UNFINISHED BUSINESS (a) SALE OF PROPERTY - 26TH AND NATCHEZ (DEFERRED FROM SEPTEMBER 11, 1912) Dr. Irvine* Herman, 2605 Natchez Avenue indicated his interest in buying the land from the City. After discussion by the Council, Councilman Fleetham moved to sell this land to Dr. Herman at value of special assessment, plus $1.00. The motion was seconded by Councilman Thiel and failed 3- 4 with Councilmen Fleetham, Thiel and Graves voting yea. Councilman Graves moved, szconded by Councilman Thiel, that the City retain ownership of this land. The motion carried 6 - 1 with Councilman Thiel voting nay. Councilman Fleetham moved to direct the proper persons be notified that this land is no longer for sale by the City. The motion was seconded by Councilman Graves and carried 5 - 2 with Councilmen Thiel and Hanks voting nay, 305 council 11I30,nutes, September 25, 1972 10, NE61 BUSINESS 11. 12. 13. (a) STATEMENT OF CITIZENS ADVISORY C0101ITTEE ON THE CAPITAL IMPROVEnENTS PROGRAM 1972-1976 Councilman Grialc suggested the Council hold a meeting with the Citizens Advisory Committee to discuss this subject no later than December 4th. (b) REQUEST FOR REPORT Councilman Fleetham status on the blocks Brunswick: Avenue, 11ISCELLANEOUS (a) DAMAGE CLAIMS indicated he would like a report on engineering of 2600 through 2900 Kentucky and 2900 1. Mrs. Robert Hamlin, 3030 Rhode Island It was moved by Councilman Griak to file claim with the City Clerk; for proper action by the City manager and City Attorney. Motion seconded by Councilman Graves and carried 7 - 0.
