GALL TO ORDER A special meeting of the City Council was called to order by Mayor Pucci at 8:00 Pomo Z, ROLL CALL The following Councilmen were present at roll call: Frank Fleetham Rose -Mary Griak Lyle Hanks James Heltzer Leonard Thiel Frank Pucci Also present were the City Manager, Assistant City Manager, City Attorney, Director of Public Works $ City Assessor, and Secretary. Councilman Craves arrived at 8:25 p.m. and Councilman Heltzer left the meeting at 9:45 p. m. L ASSESSME NT HEARINGS (a) IMPROVEMENT NO. 7I4ol0, PAVING, CURB AND GUTTER, DECATUR LANE AND WEST 34TH STREET FROM MINNEHAHA CREEK TO FLAG AVENUE Mayor Pucci opened the hearing. There being no one present wishing to speak, the Mayor declared the hearing closed. The City Manager explained the background of the project and the method of assessment and the City Assessor explained the icy and the options for payment* assessment pol Mr. Earl Johnson, 2841 Quentin Avenue, questioned cost for seal coating recently applied. Mrs. Patricia Luedtke, 2853 Quentin Avenue, stated she had damage to steps and driveway during the construction. Beverly Thompson, 2603 Quentin Avenue and Mr. Don Naaktgeborer,- 5025 West 28th Street, protested their assessments. Mrs. L. E. Tysk, 2835 Toledo Avenue, objected to assessment for water service to vacant lot. Mr. Roger Israel, 2822 Salem Avenue, felt assessment to short blocks for side streets was unfair and said he would be happy to share the costs to make the assessment more equitable. There being no one else wishing to speak, the Mayor declared the hearing closed. There was considerable discussion concerning the feasibility of adjusting the assessment for short block parcels. RESOLUTION NO, 4634 It was moved by Councilman Heltzer, seconded by Councilman Graves, to waive reading and adopt Resolution No. 4634 entitled, "Resolution Adopting Assessment Improvement Nos. 69-25r 71.05, and 71-10, " deferring action for two weeks on short block parcel6• The motion carried 7 - 0. ce Councilman Fleetham moved to hold assessment for water serve on lot adjacent to 2835 Toledo Avenue until a building is construct Councilman Heltzer seconded and the motion carried 7 - 0. 283 lid soptembev Rr ESpLUTIONS (a) RESOLUTION APPROVING HE NNE PIN COUNTY HIGhIWA INSTALLATION OF PARKING RESTRICTION SIGNS Y DEPA.r RESOLUTION NO, 4635 It was moved by Councilman Hanks, seconded by Councilman Fleetham, to waive reading and adopt Resolution No. 4635 entitled. "Resolution Approving Hennepin County Highway Department Installation of Parking Restriction Signs. " The motion carried unanimously. ComMUNICATION FROM CITY MANAGER (a) The City Manager explained that he had approval from HUD for grant at Dakota Park. It was moved by Councilman Heltzer, seconded by Councilman Fleetham, to go ahead with construction of park shelter at that park. The motion carried 7 - 0. 69 UNFINISHED BUSINESS (a) APPLICATION FOR SUNDAY SALES LICENSE - KOOGAN'S LEANING POST It was moved by Councilman Graves, seconded by Councilman Heltzer, to remove from the table the matter of application of on sale Sunday Sales license of Koogan's Leaning Post. The mots. . carried 7 , 0. Mr. Edward Cohen, attorney representing the applicant, stated that he had spoken with the attorney of the trustee of the property and that she was present at this time. Councilman Hanks reiterated his position that he would not vote for this until the setbacks are going to go in. Mrs. Elly Phillips, trustee of Lilac Way, felt there was no relationship between the issuance of the license and the property setback requirements. The City Manager reviewed the background of the attempts to bring this development into compliance with the ordinance.
