" 5. PUBLIC HEARING. (a) The Mayor opened the hearing. The Planning Director explained the proposed amendment to the Comprehensive Plan, going into some detail concerning access, possible future development and present zoning in the area and adjacent areas. Mr. Richard Neslund, 1160 heritage Lane, Wayzata, owner of a large portion of the property, expressed concern as to the economics of having the area projected as low density. He felt that the area as it relates to adjacent properties and access should be developed with at least eleven units per acre. He also stated that, since the developer will have to come in with a planned unit development, Council would exercise such control as to make any amendment to the Comprehensive Plan unnecessary. After discussion concerning future plans for Highways 7, 18 and West 3bth Street and the need for townhouse development in the area, Council- man Thiel moved to defer the matter until the highway plans can be more clearly defined. Councilman Graves seconded and the motion carried 7 - 0. (b) PROPOSED AMENDMENT TO COMPREHENSIVE PLAN - AREA BOUNDED BY MINNETONKA BOULEVARD, TEXAS AVENUE, HIGhWAY 7, AND DAKOTA AVENUE, AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MAY 181 1972 (CASE NO. 71 -42 -CP) The Mayor opened the hearing. The Planning Director explained the proposed amendment, showing plans projected for the area. Mr. David Rachner, 1643 Tex -.s Avenue, had questions concerning HUD requirements which were properly answered by the City Manager. Mr. Guzzi, 3501 Rhode Island, representing the Oak Hill Neighbor- hood Association, asked about future plans for industries bordering the Republic Creosote area. Councilman Heltzer told him the present proposal does not include these businesses. Mr. Guzzi asked that this matter be deferred until after an association meeting on June 13. Councilman Heltzer moved to continue -hearing until June 20, 1972, contacting the schools as to any ideas they have developed on future concepts for this area. Councilman Graves seconded and the motion carried 7 - 0. (�) PROPOSED AMENDMENT TO COMPREHENSIVE PLAN - AREA BOUNDED BY HIGHWAY 12, I-iIGHWAY 100, BURLINGTON 145 Council Minutes junP 5. The Flanning Director described the proposed amendment to the Comprehensive Plan. Mr. Bob Ehrenberg was present representing one of the property owners in the area, Grace Freidheim. He ti.ad no objection but expressed concern for keeping this land industrial and requested deferment until the alignment of Cedar Lake Road is established. There being no one else present wishing to speak, the Mayor closed the hearing. RESOLUTION NO. 4526 It was moved by Councilman Graves, seconded by Councilman Hanks, to waive reading and adopt Resolution No. 4526 entitled, "Resolution Amending the Comprehensive Municipal Plan of the City of St. Louis Park in Accordance with Minnesota Statutes 462. 355. " r The motion carried 7 - 0. Councilman Fleetham moved staff be directed to work out alignment of County Road 16 from Highway 100 west to Edgewood Avenue. Councilman Heltzer seconded and the motion carried 6 - 1, Councilman Griak voting nay. Councilman Heltzer moved to reconsider in order to get feelings of the ward councilman. Councilman Graves seconded and the motion carried unanimously. Councilman Griak indicated she would not support anything until she knew the plans for the area. Vote on the original motion carried 4 - 3, Councilmen Graves and Griak and Mayor Pucci voting nay, to{ (d) INTERPRETATION OF SECTION 6:023. 20 OF THE ST. LOUIS PARK ZONING ORDINANCE, AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MAY 18, 1972 (CASE NO. 72-12-I) The Mayor opened the hearing. r Mr. Thomas Griffiths, Victoria, Minnesota, owner of the lot at 40th & Natchez, was present urging that he be permitted an inter- pretation of Section 6:023. 20 of the Zoning Ordinance that would 146 council minutes, June 5, 1972 permit his building a house with an attached garage. 5 (d) There being no one else present wishing to speak, the liiayor closed the hearing. Councilman Hanks moved to g.:ant appeal and authorize staff to study ordinance for possible amendment. The City Manager and City Attorney indicated that proper procedure would be to have IVir. Griffiths apply for a variance, with proper notice given to adjacent property owners. Councilman Thiel moved to set hearing June 19 for proposed variance, waiving the fee. Councilman Graves seconded and the motion carried 7 - 0. (e) PROPOSED VARIANCE FROM SECTION 6:074.5 OF THE ZONING ORDINANCE, LOTS 289 29, and 30, BLOCK 1, WOODDALE PARK, AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MAY 25, 1972 (CASE NO. 72 -17 -VAR.) The IVlayor opened the hearing, Mr. Ralph Ledin, 4200 Ottawa Avenue, said he felt the lots should be 75 feet wide and that he would not like to have the property divided to permit two small dwellings. Councilman Hanks and the Planning Director explained the zoning and lot size required. Since there now exist two 40 ft. and one 25 ft. lot, *two houses could be legally built on the sites, leaving the 25 ft. lot vacant. The division and combination would provide larger lots and better land utilization, There being no one else present wishing to speak, the Mayor declared the hearing. closed. RESOLUTION NO. 4527 It was moved by Councilman Fleethwrn, seconded by Councilman Griak, to waive reading and adopt Resolution No. 4527 entitled, "Resolution Granting Variance in Lot Width and Area from the Requirements of Section 6:074, 5 of the St. Louis Park Zoning Ordinance. REIERSGORD RELATIVE TO IMPROVEMENT NO, 72-22 PAVING OF LOUISIANA CIRCLE 147 INS Council Minutes, June 5, i < 6. (b) Councilman Hanks said he felt the letter of objection should have been presented at the tMi le of the public hearing. The City Manager explained that bids had been taken for the proj ts ect. Councilman Griayk moved to file the communication. Councilman Hanks seconded and the motion carried 6 - 1, Councilman Heltzer voting nay. (b) COMMUNICATION CONCERNING TRAFFIC SITUATIONS - BOONE, XYLON AND ZINRAN Councilman Graves .rao-red to place on a future Council agenda with study from Traffic Engineer, Counri.iman Hanks seconded and the motion carried 7 ow (c) BLEACHERS IN BALL PARES Councilman Heltzer stated that he had been approached concerning the need for bleachers at the ballileld at Gorham and First Street Northwest and moved to appropriate $750 for the purpose of installing two sections of bleachers. Councilman Graves seconded. Mr. Frank of the Pony Colt League was present *urging* the request be granted and expressing his interest in the baseball program as a whole. Concern was expressed by Councilmen Hanks, Griak and Thiel concerning this action would indicate Council was trying to take over the League ball program or showing favoritism to a particular group There was also concern expressed relative to bypassing the Parks and Recreation Commission and Baseball Coordinating Committee. Councilman Thiel felt there should be a meeting with the Coordinating Committee, Councilman Heltzer felt he would like to discuss any of these needs at budget time. " The motion carried 7 - 0. (b) FIRST READING OF PROPOSED ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLITION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, PERMITS, FIRE ZONES, AND MAINTENANCE OF BUILDINGS OR STRUCTURES IN THE CITY OF ST. Mr. David Rachner, 1643 Texas Avenue, questioned the acceptance of the State Building Code. The City Manager explains d that the City has no alternative and also explained the provision of appeal at the request of Iver. Rachner. It was moved by Councilman Fleetham, seconded by Councilman Graves, to waive first reading of proposed ordinance and set second reading June 19, 1972. The motion carried unanimously. (c) RESOLUTION SUPPORTING THE GIVE AND TAKE HELP CENTER RESOLUTION NO. 4528 It was moved by Councilman Graves, seconded by Councilman Heltzer, to waive reading and adopt Resolution No. 4528 entitled, "Resolution Supporting the Give and Take Help Center. " The motion carried 7 - 0. " The motion carried 7 - 0. It was explained that the resolution was sent to him merely to inform him that the matter was on the Council agenda and that an order would follow giving him a reasonable amount of time to comply. RESOLUTION NO. 4534 It was moved by Councilman Griaks seconded by Councilman Heltzer, to waive reading and adopt Resolution No. 4534 entitled, "Resolution and Order For Removal of Substandard Dwelling at 6109 West 14th Street as a Hazardous Building. " The motion carried 7 - 0. UNFINISHED BUSINESS (a) TRAFFIC STUDY (#40) - WESTWOOD HILLS DRIVZ FROM TEXAS AVENUE TO FRANKLIN AVENUE (DEFERRED FROM MAY 30, 1972) Mr. Alan Sherr, 8155 Westwood Hills Drive was present requesting stop signs as recommended and in addition stop signs on Franklin Avenue and Westwood Hills Drive and Curve at each intersection. Councilman Heltzer moved to authorize preparation of resolution authorizing stop signs as staff recommended on Westwood Hills Drive at Franklin Avenue and two-way signs at both intersections of Westwood Hills Drive and Westwood Hills Curve. Councilman Graves seconded and the motion carried 6 - 1, Councilman F leetham voting nay. (b) APPOINTMENTS TO BOARDS/ C OMMISSIONS - HUMAN RIGHTS AND PLANNING Councilman Griak moved to appoint Mr. George G. Swenson to fill the to rix of Dewey Boelte r and Mr. Steven A. Smith to fill the term of Mr. Rufus Webster. Councilman Hanks seconded and the motion carried 7 - 0. Councilman Graves moved to defer the Planning Commission appointment. Councilman Heltzer seconded and the motion carried ? - 0. Councilman Hanks moved to discuss at the time of this appointment whether youth on commissions should be a high school student.
