CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Pucci at 8:02 p.m. 2. INVOCATION Invocation was given by Rev. Methodist Church. 3. ROLL CALL Bennett Brudevold of the Aldersgate The following Councilmen were present at roll call: Frank Fleetham Rose -Mary Griak Lyle Hanks James Heltzer Frank Pucci Also present were the Acting City Manager, Assistant to the City Manager) City Attorney, Planning Director, Assistant City Assessor, Director of Public Works, and Secretary. Councilman Graves arrived at 8:20 p.m. 4. MINUTES On motion of Councilman Fleetham, seconded by Councilman Griak, the minutes of the regular meeting held May 1, 1972, and special meetings held April 24 and May 8, 1972, were approved by a five yea vote, with the amendment that on Page 108 Item 10(c) there be a motion to defer. 5. PUBLIC HEARINGS (a) PROPOSED AMENDMENT TO THE ZONING ORDINANCE TO INCLUDE HOUSING FOR THE ELDERLY AS A NEW RESIDENTIAL USE Mayor Pucci opened the hearing. Mr. Don Hagen, M. B. Hagen Realty, Hopkins, Minnesota, expressed interest in the ordinance and a desire to construct a building in St. Louis Park for elderly and moderate income. He felt the ordinance should be broadened to include private developers building for profitable purposes. 112 Council Minutes, May 15, 1972 5, (a) Mr. Neil Woodington, Remington Enterprises of Edina, said he could not find much fault with the ordinance, but felt it should be broadened to include profit-making developers, He indicated that Remington Enterprises was primarily interested in housing for the elderly. The Planning Director explained the intent of the ordinance was to create a new land use category providing a different type of living than an apartment but would not be a nursing home. He said the housing is intended for low , not moderate, income. After discussion concerning size requirements, density, and parking requirements, Councilman Griak moved to continue to July 179 1972. Councilman Graves seconded and the motion carried with six yeas. Councilman Griak moved that staff be requested to alter the ordinance to include profit making developers and moderate income housing. Councilman Graves seconded and the motion carried 6 - 0. (b) IMPROVEMENT NO, 72-06, PAVING, CURB AND GUTTER, FLORIDA AVENUE AND WEST 23RD STREET BETWEEN CUL-DE-SAC AND EDGEWOOD AVENUE, AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MAY 4 AND MAY 11, 1972 Mayor Pucci opened the hearing„ There being no one present wishing to speak to this matter, Mayor Pucci declared the hearing closed, RESOLUTION NO. 4501 It was rr16V- ed by Councilman Ha..iks, seconded by Councilman *Griak, to waive reading and adopt Resolution No: 4501 entitled, "Resolution Ordering Improvement and Ordering Preparation of Plans Improve- ment No. 72-06, Paving and Curb and Gutter. " The motion carried 6 - 0. (c) IMPROVEMENT NO. 72-11, PAVING, CURB AND GUTTER, 39TH STREET FROM HIGHWAY 100 FRONTAGE ROAD TO PRINCETON AVENUE; 38TH STREET FROM NATCHEZ AVENUE TO PRINCETON AVENUE, AND NATCHEZ AND OTTAWA AVENUES NORTH OF 38TH STREET, AS- DESCRIBED IN NOTICE OF HEARING PUBLISHED MAY 4 AND MAY 110 1972 Mayor Pucci opened the hearing. RESOLUTION NO. 4503 It was moved by Councilman Fleetham, seconded by Councilman Graves, to waive reading and adopt Resolution No. 4503 entitled, "Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No. 72-11 Paving and Curb and Gutter, " excluding Ottawa Avenue north of West 38th Street. The motion carried 6 - 0. Mr. Pickett indicated a desire to retain the stop sign on Ottawa Avenue. He was told that there were presently no plans for its removal. (d) PROPOSED PRELIMINARY PLAT OF DALQUIST INDUSTRIAL PARK, AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MA 41 1972 Mayor Pucci opened the hearing. The Planner Director described the proposed platting of the propert T located in the southea� t quadrant of Highway 7 and Highway 100. He said she applicant is filing a planned unit development for the area vrith the approach to be to coordinate all future development in the area. Mr. Mark Dalquist, one of the property owners, displayed a rendering of the proposed development, There being no one else present wishing to speak, the Mayor closed the hearing. It was moved by Councilman Graves, seconded by Councilman Griak, to approve preliminary plat. The motion carried 6 - 0. 114 Council Minutes, May 15, 197E 5. (e) IMPROVEIViENT NO. 71-03B, SIDEWALK, NORTH SIDE OF MINNETONKA BOULEVARD FROM TEXAS AVENUE TO VIRGINIA AVENUE, AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MAY 4 AND MAY 11, 1972 Mayor Pucci opened the hearing. It was moved by Councilman Graves, seconded by Councilman Fleetham, to continue the hearing to May 30, 1972. The motion carried 6 - 0. 6. PETITIONS, REQUESTS, AND COMMUNICATIONS (a) NOTICE OF INTENT TO CONDUCT BINGO GAME EVERY FRIDAY NIGHT, COMMENCING JULY 7, 1972s BY FRANK LUNDBERG AMERICAN LEGION POST ##282 There being no objection, the notice was ordered by the Mayor to be received for filing. 7. RESOLUTIONS AND ORDINANCES (a) RESOLUTION PLACING FOUR-WAY STOP SIGN AT INTERSECTION OF VALLACHER AND NATCHEZ AVENUES RES bLUTION NO. 4504 It was moved by Councilman Hanks seconded by Councilman Graves, to waive reading and adopt Resolution No. 4504 entitled, "Resolution Authorizing Placement of Stop Signs for Traffic Control at Intersection of Vallacher Avenue and Natchez Avenue. " The motion carried 6 - 0. (b) RESOLUTION AMENDING RESOLUTION NO, 4436,INTIK TS FRANK PUCCI AS ALTERNATE REPRESENTATIVE TO BASSECREEK FLOOD CONTROL COMMISSION RESOLUTION NO. 4505 It was moved by Councilman Griak, seconded by Councilman Graves, to waive reading and adopt Resolution No. 4505 entitled "Resolution Appointing Alternate Commissioner to Represent the City of St. Louis Park on the Board of the Bassetts Creek Flood Control Commission and Repealing that Portion of Resolution No, 4436 Naming Frank Fleetham Alternate Commissioner. (d) RESOLUTION ADJUSTING SPECIAL ASSESSMENT, IMPROVE- MENT NO. 67-33 RESOLUTION NO. 4506 It was moved by Councilman GrIak, seconded by Councilman Fleetham, to waive reading and adopt Resolution No. 4506 entitled, "Resolution Adjusting Special Assessment. (e) RESOLUTION APPROV7.NG PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS IMPROVEMENT NO. 72-22 RESOLUTION NO. 4507 It was moved by Councilman Feetham,, seconded by Councilman Graves, to waive. reading and adopt Resolution No. 4507 entitled, "Resolution Approving Plans and Specifications and Ordering Advertisement for Bids Improvement No, 72-22. " The motion carried 6 . C. 8. REPORTS OF OFFICERS; BOARDS, AND COMMITTEES (a) REPORT OF PLA14NING COMMiISSION RECOMMENDING APPROVAL OF ALTERNAT:: #12 AREA PLAN, COUNTY ROAD 18, WEST .6TH STREET (CASE NO. 69-61••CP) It was moved by Councilman Griak, seconded by Councilman Graves, to set hearing June 5, 1972. The motion carried 6 - 0. Council decided to meet at 6:30 p.m., May 30, 1972, to view these areas. (c) REPORT OF PLANNING COMMISSION RECOMMENDING APPROVAL OF AMENDIVIENT TO THE COviPREHENSIVE PLAN FOR THE AREA BOUNDED BY HIGHWAY 12, HIGHWAY 100, BURLINGTON NORTHERN RAILROAD AND THE MN&S RAILROAD (CASE NO. 72 -5 -CP) It was moved by Councilman Gr. iak, seconded by Councilman Graves, to set hearing June 5, 1972. The motion carried 6 - 0. It was moved by Councilman Graves that the area designated for industrial use be studied as to its appropriateness. Councilman Griak seconded and the motion carried 6 - 0. (k) MONTHLY FINANCIAL REPORT - MARCH 1972 There being no discussion, the report was ordered by the Mayor to be received for filing. 1 REPORT OF COUNCIL COMMITTEE RELATIVE TO AGREE ENT () ON APPOINTMENT TO PARKS AND RECREATION ADVISORY 20/72i COIViMISSION (REFERRED TO COMMITTEE BY COUNCIL Councilman Hanks explained that except for minor changes s that the ates o£ payments and number of reports, the mayor change committee agreed that the Council shall have f.,v*I members on the Commission and the School Board three instead of four. They are to be appointed by the Council with recommendation from the School District for the three designated as school representatives. said the school is willing to allow the membership to remain as presently composed, until a vacancy occurs„ It was moved by Councilman Hanks, seconded by Councilman Graves, to authorize exerutior of the agreement Councilman Griak stated that if this agreement is accepted she would like to have the School Board made aware of the current make-up of the Commission and where they come frctaa in St. Louis Park, as well as their backgrounds. Recommendations from them should consider geographical location. Councilman Heltzer expressed concern that the School Districts designees be recommended on the ba.vis of political patronage. It was Councilman Hanks' feeling that cooperation and good relation- ships between the two bodies is necessary to continue to carry on a beneficial program. Councilman Fleetham moved to defer this matter to May 30, 1972• cilman Councilman Graves seconded and the motion carried 4 - 2, Coull Council. (m) PRELIMINARY REPORT OF DIRECTOR OF PUBLIC WORKS AND ASSESSMENT REPORT WITH RESPECT TO IMPROVEMENT NO, 72-10, PAVING AND CURB AND GUTTER RESOLUTION NO. 4508 It was moved by Councilman Graves, seconded by Councilman Griak, to waive reading and adopt Resolution No. 4508 entitled, "Resolution Calling Pub lic Hearing Improvement No, 72-10 Paving and Curb and Gutter. " The motion carried 6 - 0. Hearing was set May 30, 1972. (n) ANNUAL FINANCIAL REPORT OF THE CIT f FOR 1971 It was moved by Councilman Griak, seconded by Councilman Fleetham, to accept and direct publication of summary as required by Section 6. 14 of the Charter, The motion carried 6 -- 0. 9. UNFINISHED BUSINESS (a) REPORT OF CITY MANAGER (M&C NO. 72-17) HOUSING INSPECTION PROGRAM (REFERRED TO CITIZENS ADVISORY COMMITTEE, HOUSING AND REDEVELOPMENT AUTHORIT Y AND BUILDING CONSTRUCTION CODES ADVISORY COMMITTEE MARCH 6, 1972) Councilman Griak indicated she would like to have staff go over the comments of the boards /commissions and relate them specifically to Council in the area where guide lines have been altered to accept those recommendations. Councilman Fleetham moved to defer to May 22, 1972, 8.o00 p. m. Councilman Graves seconded and the motion carried 6 - 0. Mr. Bob Hardy, 3000 Alabama Avenue, said that the Building Construction Codes Advisory Commission went over the plumbing, heating, and electrical sections of this and decided to have another meeting but the meeting was called off and he suggested that the report be sent back and corrected. The Acting City Manager explained that this had been considered by the Building Construction Codes Advisory Commission on April 4, 1972, that they did consider changing the code but this had nothing to do with the housing inspection program. (b) REPORT CONCERNING RESPONSIBILITY FOR REPAIR OF WATER SERVICE LINES (REQUESTED APRIL 17, 1972) 119 Council Minutes, May 15, 1972 9. (b) Councilman Heltzer said according to the report there seems to be no way the City can assume this financial responsibility. Upon hearing no further discussion, the Mayor ordered the report to be received for filing, (c) REQUEST OF FARMER SEED .!SND NURSERY COMPANY FOR SPECIAL PERMIT (CASE NO. 0r 1-53-5. P.) FOR OUTDOOR SALES OF HORTICULTURAL PRODUCTS (DEFERRED FROM APRIL 17, 1972) Mr. Bob Ehrenberg, representing Farmers Seed and Nursery, stated that everything had been done except the striping and that contract has been let' RESOLUTION NO, 4509 It was moved by Councilman Fleetham, seconded by Councilman Hanks, to waive reading and adopt Resolution No. 4509 entitled, "Resolution Granting Permit Under Section 6:122. 6 of the St. Louis Park Zoning Ordinance for Outdoor Sales and Display of Horticultural Products at 4631 Excelsior Boulevard, Farmer Seed and Nursery Co. " The motion carried 6 - 0. (d) TRAVEL AUTHORIZATION Councilman Fleetham expressed strong objection to Mayor or Councilmen traveling without proper authorization, mentioning particularily a trip planned by the Mayor to Chicago for a CATV convention, Mr„ Ben Norgren, 1312 Melrose Avenue, challenged Councilman Fleetham" s reason for objecting to this trip. Mr. Raymond Friedl, 2713 Louisiana Avenue, suggested that information concerning travel by Council ar 3 department heads be printed in the St. Louis Park Sun. Council voiced no objection to this suggestion. 10. NEW BUSINESS (a) APPOINTMENT TO PLANNING CONAWISSION AND HOUSING AND REDEVELOPMENT AUTHORITY It was moved by Councilman Griak, seconded by Councilman Hanks, to defer to May 22, 1972. Schwendeman) 1446 Kentucky Avenue It was moved by Councilman Graves, seconded by Councilman Fleetham, to file claims with City Clerk for proper action by the City Manager and City Attorney. The motion carried 6 - 0. 129 CLAIMS. APPROPRIATIONS, AND CONTRACT PAYMENTS (a) VERIFIED CLANViS On motion of Councilman Hanks, seconded by Councilman Graves, Council Minutes, May 15, 1972 12. (a) the lists of verified claims prepared by the Director of Finance and presented to the Council dated May 15, 1972 in the total amounts of $4, 822. 29 for payroll, and $97, 762. 95 for vendors were approved, and the City Manager, City Clerk, and City Treasurer were authorized to issue checks eovering same by a six yea vote. 13, ADJQURNLAENT On motion of Councilman Hanks, seconded by Councilman Griak, the meeting was adjourned at 11:15 p.m. by a six yea vote.
