CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Pucci at 8 : 14 p . m . 2 . INVOCATION There being no one present from the Ministerial Association , there was no invocation . 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Rose - Mary Griak Lyle Hanks James Heltzer Leonard Thiel Frank Puc c i Also present were the City Manager , Assistant City Manager , City Attorney , Planning Director , Director of Public Works , City Assessor , and Secretary. Councilman Graves arrived at 8 : 50 pm , 4 . MINUTES On motion of Councilman Heltzer , seconded by Councilman Hanks , the minutes of the regular meeting held March 20 , 1972 , were approved by a six yea vote , adding to Item 9 ( a ) . . " Councilman Fleetham seconded the motion. " 5 . PUBLIC HEARINGS ( a ) PROPOSED STORM SEWER , IMPROVEMENT NO. 68 - 03 , IN AREA BOUNDED IN GENERAL BY THE MINNEAPOLIS , NORTHFIELD , AND SOUTHERN RAILWAY ON THE WEST ; EXCELSIOR BOULEVARD ON THE SOUTH ; TRUNK HIGHWAY 100 ON THE EAST ; AND WEST 37TH STREET ON THE NORTH , AS DESCRIBED IN NOTICE OF - HEARING PUBLISHED MARCH 23 AND MARCH 30 , 1972 j Mayor Pucci opened the hearing . , a 70 Council Minutes $ April 3 , 1972 5 . ( a ) The City Manager , City Assessor , and Director of Public Works explained the engineering of the proposed project , described the area to be served and the assessment policy. Elmer Pearson , 3932 Xenwood ; E . L. Mahrer , 3933 Yosemite , William Reis , 3941 Zarthan ; and Douglas Anderson , 3932 Webster , had questions concerning the proposed project which were answered by the staff. Mr . Bob Matzke , 3870 Alabama Avenue , urged that if the project is approved special attention be given to the timing of the project in order that there be as little inconvenience to the nursing home as possible , particularily to access for ambulance service . Duane Johnson , 5806 Goodrich , felt there is no water problem . The Llrector of Public Works explained that a relief line is being constructed to take the water into the natural watershed . There being no one else wishing to speak , Mayor Pucci declared the hearing closed. RESOLUTION NO, 4468 It was moved by Councilman Hanks , seconded by Councilman Thiel , to waive reading and adopt Resolution No , 4468 entitled , " Resolution Ordering Improvement and Ordering Preparation of Plans Improve - ment No , 68 - 03 . " The motion carried 7 - 0 . (b ) PROPOSED STORY SEWER , IMPROVEMENT NO. 72 - 239 IN AREA BOUNDED IN GENERAL BY MINNEHAHA CREEK ON THE SOUTH, EDGEWOOD AVENUE ON THE EAST ; CHICAGO, MILWAUKEE , ST . PAUL A-ND PACIFIC RAILWAY ON THE NORTH ; AND MEADOWBROOK ROAD ON THE WEST , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MARCH 23 AND MARCH 309 1972 Mayor Pucci opened the hearing . Mrs . Mattie Peterson , chairman of the Environmental Improvement Commission, expressed concern of the commission as it relates to possible h.armful run - off into Minnehaha Creek. There being no one else present wishing to speak , Mayor Pucci declared the hearing closed . RESOLUTION NO. 4469 It was moved by Councilman Thiel , seconded by Councilman Griak , to waive reading and adopt Resolution No . 4469 entitled , " Resolution 71 Council Minutes , April 1972 5 . b Ordering Improvement and Ordering Preparation of Plans " Councilman Griak amending to request Improvement No . 72 _ 23y i that this proposed storm sewer construction be sent he motion o the earn mental Improvement Commission for its review . carried 7 - 0 . Councilman Heltzer requested that a resolution be prepared setting a Council policy that all storm sewer projects be rev by the Environmental Improvement Commission . ( c ) PROPOSED SANITARY SEWER , IMPROVEMENT NO. 65AST OF FRANCE AVENUE FROM WEST 24TH STREET TO USHED 25 FEET NORTH , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MARCH 9 AND MARCH 16 , 1972 Mayor Pucci opened the hearing . Mr . Ben G . Kurenitz , 2337 France Avenue , spoke in favor of the proposed sanitary sewer construction , since it has become a matter of extreme urgency. Property owner , Ned J . Trugman , Beverly Hills , California , filed a letter opposing the proposed improvement because of its causing ' a financial burden . There being no one else present wishing to be heard , Mayor Pucci declared the hearing closed . RESOLUTION NO. 4470 It was moved by Councilman Griak , seconded by Councilman Fleetham , to waive reading and adopt Resolution No . 4470 entitled , " Resolution Ordering Improvement and Ordering Preparation of Plans Improvement No . 65 - 20 . " The motion carried 7 - 0 . (d ) PROPOSED NEIGHBORHOOD DEVELOPMENT PROGRAM FOR THE AREA BOUNDED IN GENERAL BY WEST 32ND STREET , GORHAM AVENUE , FIRST STREET NORTHWEST , REPUBLIC AVENUE , HIGHWAY NO, 79 AND PENNSYLVANIA AVENUE , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED MARCH 239 1972 Mayor Pucci opened the hearing . It was moved by Councilman Thiel , seconded by Councilman Hanks ' to continue to April 17 , 1972 , authorizing staff to prepare necessary resolution. The motion carried 7 - 0 . 72 9L Council Minutes , April 3 , 1972 6 , PETITIONS , REQ UES TS , AND COMM UNICA TIONS ( a ) REQUEST OF PLANNING COMMISSION FOR COUNCIL TO AUTHORIZE PLANNING DEPARTMENT TO STUDY REQUIRING PERMITS IN RB ( RESIDENTIAL BUSINESS FOR M O TI DEVELOPMENT L FFAMIAMILY SPECIAL It was moved by Councilman Graves , seconded by Councilman Heltzer , to authorize the study. The motion carried 7 - 0 . 7 . RESOLUTIONS AND ORDINANCES ( a ) RESOLUTION AUTHORIZING STOP SIGNS , 28TH STREET AND SALEM AVENUE ( REQUESTED MARCH 20 , 1972 ) RESOLUTION NO, 4471 It was moved by Councilman Griak , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 4471 entitled , " Resolution Authorizing Placement of Stop Signs and Repealing that Portion of Resolution No . 1572 Authorizing Placement of Yield Signs for Traffic Control at Intersection of West 28th Street and Salem Avenue . " The motion carried 7 - 0 . (b ) RESOLUTION OF INTENT TO ENTER INTO A JOINT POWERS AGREEMENT TO FORM A MUNICIPAL INFORIViATION SYSTEM (M & C NO . 72 - 07 ) RESOLUTION NO, 4472 It was moved by Councilman Fleetham , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 4472 entitled , " Resolution of Intent to Enter Into a Joint Powers Agreement to Form a Municipal Information System " The motion carried 7 - 0 . ( c ) RESOLUTION DESIGNATING STATE AID FUNDS - LOUISIANA AVENUE RESOLUTION NO. 4473 It was moved by Councilman Heltzer , seconded by Councilman Graves , to waive reading and adopt Resolution No . 4473 entitled , " Appropriation of Municipal State Aid Street Funds to City Project No . 62 - 27 (SAP 63 - 276 - 10 ) . " The motion carried 7 - 0 . (d ) RESOLUTION DESIGNATING HENNEPIN COUNTY LIBRARY VOTER REGISTRATION CENTER 73 WF Council Minutes , April 3 , 1972 RESOLUTION NO . 4474 , 7 . (d ) ' It was moved by Councilman Griak , seconded by Councilman Thiel , to waive reading and adopt Resolution No . 4474 entitled , " Resolution Authorizing the Commissioner of Registration to Establish Additional Voter Registration Center . " The motion carried 7 - 0 . 8 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES ( a ) REPORT OF PLANNING COMMISSION RECOMMENDING UNFAVORAB7 . UPON THE REQUEST OF BERNARD HOROVITZ ( CASE NO. 68 - 19 - Z , ) TO REZONE PROPERTY AT 4212 MINNETONKA BOULEVARD FRO&: B - 1 TO B - 2 It was moved by Councilman Heltzer , seconded by Councilman Thiel , to set date for hearing if applicant desires a hearing . The motion carried 7 - 0 . (b ) REPORT OF CITY MANAGER (M & C NO . 72 - 06 ) RELATIVE TO ACQUISITION OF PROPERTY - 3810 PRINCETON Councilman Griak moved to authorize purchase at price of $ 26 , 000 and relocation at cost of $4 , 000 . Councilman Graves seconded and the motion carried 7 - 0 . ( c ) REPORT OF PLANNING COMMISSION RECOMMENDING FAVORABLY UPON THE REQUEST OF MICHAEL J . JENNINGS ( CASE NO. ? 2 - 3 - S . P . ) FOR SPECIAL PERMIT UNDER SECTION 6 : 122 . 11 OF THE ZONING ORDINANCE TO ALLOW A DRIVE - IN RESTAURANT AT 4600 EXCELSIOR BOULEVARD Councilman Heltzer moved to defer 30 days to be considered with report on Model Block , Councilman Hanks seconded and the motion carried 7 - 0 . (f ) REPORT OF TRAFFIC STUDY ( # 37 ) - INTERSECTION OF WEST 16TH STREET AND ZARTHAN AVENUE ( REQUESTED BY COUNCILMAN GRIAK ) It was moved by Councilman Griak , seconded by Councilman Thiel , to authorize preparation of resolution placing stop sign on West 16th Street at intersection of Zarthan Avenue . The motion carried 7 - 0 . ( g ) MINUTES OF CITIZENS ADVISORY COMMITTEE MEETING HELD MARCH 9 , 1972 There being no discussion , the minutes were ordered by the Mayor to be received for filing . (h ) REPORT OF TRAFFIC STUDY ( # 33 ) - SOUTH FRONTAGE ROAD TRUNK HIGHWAY 12 FROM COLORADO AVENUE TO FLORIDA AVENUE It was moved by Councilman Thiel , seconded by Councilman Heltzer , to authorize preparation of resolution authorizing no parking on north side of Trunk Highway 12 frontage road from Colorado Avenue to Florida Avenue . Councilman Griak felt people in adjacent business - es should be contacted prior to such action . Councilman Heltzer withdrew his second and Councilman Thiel moved to table . Councilman Griak seconded and the motion carried 7 - 0 . (i ) MINUTES OF PLANNING COMMISSION MEETING HELD MARCH 15 , 1972 There being no discussion, the minutes were ordered by the Mayor to be received for filing . (k ) REPORT OF TRAFFIC STUDY ( 038 ) - ZARTHAN AVENUE BETWEEN MINNETONKA BOULEVARD AND LAKE STREET Coupcilman Graves moved to defer to April 17 , 1972 . Councilman Heltzer seconded and the motion carried 7 - 0 . 75 Council Minutes , April 3 , 1972 9 . UNFINISHED BUSINESS (a ) rr ADDITION TO NURSING HOME , 6019 WEST 39TH STRS EP . REQUESTED BY FRANK BARNES - CASE NO. 65 1 ( TABLED MAY 24 , 1965 ) It was moved by Councilman Fleetham , seconded by Councilman Heltzer , to remove this matter from the table . The motion carried 7 - 0 . The Planning Director explained that the applicant is no longer the owner and , therefore , had no interest in this permit. It was moved by Councilman Fleetham , seconded by Councilman Heltzer , to deny the special permit . The motion carried 7 - 0 . (b ) PLACEMENT OF RAILROAD CAR IN JORVIG PARK ( DN HANKS D FROM MARCH 6 , 1972 AT REQUEST OF COUNCILMAN ) It was moved by Councilman Hanks to table this matter . The motion was seconded by Councilman Thiel and carried 7 - 0 . ( c ) EMPLOYMENT OF CONSULTING ENGINEER FOR PAVING PROJECTS (M & C NO. 72 - 08 ) *,�/ 77� s 7 -Z �0 It was moved by Councilman Heltzer , seconded by Councilman Graves , to authorize contract for engineering services of Kirkham M3*Lchael Architects and Engineers . The motion carried 6 - 1 , Councilman Fleetham voting nay. Councilman Fleetham reported that he and Councilmen Graves and Thiel had met with people in 2700 , 2800 , and 2900 blocks of Alabama Avenue and moved that " no parking " signs be placed in alley between 27th and 28th Streets , Alabama and Birchwood Park; that staff prepare resolution to petition state to reduce speed on Alabama Avenue ; that there be increased police patrol and speed checks on Alabama Avenue ; that staff work with apartment and townhouse owners to spread traffic ; and that staff work with neighbor ' hood community toward a long term safer Alabama Avenue . Council - man Heltzer said he felt that there should be a staff analysis and report on these matters to be sure they solve more problems than they create . Councilman Thiel moved that there be extra surveillance by police on Alabama in these blocks . Councilman Graves seconded and the motion carried 7 - 0 . Councilman Thiel moved no parkinB � � signs be placed in alley between 27th and 28th Streets , Alabama and Birchwood Park, Councilman Fleetham seconded and the motion carried 7 - 0 . 76 Council Minutes , April 3 , 1972 90 (d ) EMPLOYMENT OF CONSULTING ENGINEER FOR WATER WELL AND TREATMENT PLANT ( M & C NO. 72 - 09 ) It was moved by Councilman Fleetham , seconded by Councilman Thiel , to authorize engineering services contract of Orr - Schelen - Mayeron. The motion carried 7 - 0 . (e ) REQUEST FOR VARIANCE ( CASE NO. 71 - 8O - VAR , ) IN PARKING REQUIREMENTS , PIZZA HOUSE Councilman Hanks asked for parking reports two weeks from now to find out what is available to the applicant . It was moved by Councilman Hanks , seconded by Councilman Graves , to defer to April 17 , 1972 . The motion carried 7 - 0 . (f ) PUBLIC SAFETY STUDY Councilman Graves moved to have meeting with public safety depart - ments relative to organizational study on April 24 . Councilman Heltzer seconded but the motion was defeated 3 - 4 , Councilmen Fleetham , Griak , Hanks , and Thiel voting nay . Councilman Heltzer moved that Council meet with employees concerning the study of Ernst and Ernst concerning public safety organization upon the settlement of salary negotiations . Councilman Hanks seconded and the motion carried 5 - 2 , Councilmen Fleetham and Thiel voting nay , since they felt they would like to have the report from the City Manager before such a meeting with employees . ( g ) STREET ASSESSMENT POLICY Councilman Thiel moved that t1he discussion of assessment of streets be discussed April 10 following the joint meetings . Councilman Hanks seconded and the motion carried 7 - 0 . 10 . NEW BUSINESS ( a ) TABULATION OF BIDS - TRACTOR BACKHOE AND FRONT END LOADER It was moved by Councilman Griak , seconded by Councilman Thiel , to designate Long Lake Ford Company as the lowest responsible bidder in amount of $ 6 , 8649 57 . The motion carried 7 - 0 . (b ) TABULATION OF BIDS - STREET SWEEPERS It was moved by Councilman Fleetham , seconded by Councilman 77 Council Minutes , April 3 , 1972 10 . (b ) Griak , to designate Hayden - Murphy Equipment Company as the 3 ' lowest responsible bidder in amount of $ 24 , 700 . 00 . The motion i carried 7 - 0 . (c ) PROPOSED CHANGE ORDER - NORTHLAND SUPPLY CO. - WELLS 1 AND 2 It was moved by Councilman Griak , seconded by Councilman Fleetham , to authorize City Manager to execute Change Order in amount of $ 8 , 000 . 00 The motion carried 7 - 0 . (d ) APPOINTMENTS TO BOARDS / COMMISSIONS Councilman Heltzer moved to appoint Everett Janssen to replace Howard Segal on the Environmental Improvement Commission. Councilman Griak seconded and the motion carried 7 - 0 . Council - man Fleetham moved to appoint Clarence Moe to fill the unexpired term of J . N . Hove (term expires 6 / l / 73 ) on the Human Rights Commission , Councilman Hanks seconded and the motion carried 7 - 0 . Councilman Hanks moved to authorize Rotary Club to appoint ex - officio member to the Environmental Improvement Commission. Councilman Heltzer seconded and the motion carried 7 - 0 . 11 . Brasket , 3360 Alabama Avenue Councilman Graves moved to file claims with City Clerk for proper action by the City Manager and City Attorney . Councilman Hanks seconded and the motion carried 7 - 0 . (b ) CONTRACT , ENGINEERING - MEADOWBROOK AND OXFORD BRIDGE Councilman Heltzer moved to authorize execution of contract with Robert E . Erickson Engineering Company, Councilman Griak seconded and the motion carried 7 - 0 . 12 . CLAIMS , APPROPRIATIONS , AND CONTRACT PAYMENTS ( a ) VERIFIED CLAIMS 78 Council Minutes , April 3 , 1972- . 12 . ( a ) On motoon of Councilman Heltzer , seconded by Councilman Hanks , the lists of verified claims prepared by the Director of Finance and presented to the Council dated April 3 1972 in the total amounts of $ 3 , 413 . 12 for payroll and $ 88 , 288 . 75 for vendors were approved , and the City Manager , City Clerk , and City Treasurer were authorized to issue checks covering same by a seven yea vote . (b ) PAYMENT TO REILLY TAR & CHEMICAL It was moved by Councilman Heltzer , seconded by Councilman Thiel , to authorize continued negotiations with Republic Creosote and enter into an agreement to purchase , and approving payment of earnest money in amount of $ 5 , 000 . The motion carried 7 - 0 . 13 . ADJOURNMENT On motion of Councilman Graves , seconded by Councilman Griak , the meeting was adjourned at 10 : 40 p . m . by a seven yea vote . Frank J .
