CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Pucci at 8 : 10 P . m . 2 . INVOCATION Since there was no one present from the Ministerial Association , no invocation was given . 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Richard Graves Rose - Mary Griak Leonard Thiel Frank Pucci Also present were the City Manager , Assistant City Manager , City Attorney , Planning Director , Director of Public Works , Director of Parks and Recreation , Supervisor of Building and Zoning , and Secretary . Councilman Heltzer arrived at 8 : 15 p . m . and Councilman Hanks at 9 : 15 P & m . 4 . MINUTES On motion of Councilman Fleetham , seconded by Councilman Thiel , the minutes of the special meetings held February 28 , 1972 , were approved by a five yea vote . 5 . PUBLIC HEARINGS ( a ) PROPOSED VACATION OF PORTION OF ALLEY LE ( 16 FOOT ALLEY IN BLOCK 260 NORTH OF LOTS 18 TO 24 INCLUSIVE AND THE 16 FOOIT ALLEY NORTH OF LOT 13 , BLOCK 75 - ALL IN REARRANGE - MENT OF ST , LOUIS PARK ) , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED FEBRUARY 240 1972 Mayor Pucci opened the hearing . There being no one present wishing to speak to this matter , Mayor ' Pucci declared the hearing closed . f 53 i Council Minutes , March 6 , 1972 5 . ( a ) It was moved by Councilman Fleetham , seconded by Councilman r � Graves , to waive first reading of proposed ordinance vacating portion of alley and set second reading March 20 , 1972 . The ` < motion carried 5 - 0 . ( Councilmen Hanks and Heltzer were not present ) . 6 . PETITIONS , REQUESTS , AND COMMUNICATIONS ( a ) REQUEST FROM BLACKSTONE IMPROVEMENT ASSOCIATION Mr . Alfred , Relph , 1617 Blackstone Avenue , was present as chairman of the Blackstone Improvement Association . He explained that the association has two plans , one for general clean up and one for streets , lighting , etc . ( President Pro Tem assumed the chair during the discussion of this matter and until its completion . ) He presented a list of several matters of concern of the association and requested the cooperation of Council and staff to ensure their being carried out to a satisfactory completion. Councilman Griak moved that the list of matters of concern be referred to staff for action and that a time table be set as to when this can be accomplished . Councilman Graves seconded and the motion carried 5 - 0 . ( Councilman Hanks and Mayor Pucci were not present ) . Councilman Griak requested that a study be made of the traffic problem at 16th Street and Zarthan Avenue and that a recommendation be made for its solution . 7 . RESOLUTIONS AND ORDINANCES ( a ) SECOND READING OF PROPOSED ORDINANCE AUTHORIZING SALE OF CITY GARAGE PROPERTY ORDINANCE NO, 1179 It was moved by Councilman Graves , seconded by Councilman Fleetham , to waive second reading and adopt Ordinance No . 1179 entitled , "An Ordinance Authorizing Sale by the City of the Old City Garage Property Located in St . Louis Park . " The motion carried 6 - 0 * ( Councilman Hanks was not present ) . 54 Council Minutes , March 6 , 1972 7 . (b ) SECOND READING OF PROPOSED ORDINANCE VACATING PORTION OF ALLEY IN AREA OF WEST 16TH STREET AND NEVADA A VIN UE ORDINANCE NO. 1180 It was moved by Councilman Fleetham , seconded by Councilman Graves , to waive second read _ ng and adopt Ordinance No . 1180 entitled , "An Ordinance Vacating Alley . " The motion carried 6 - 0 . ( Councilman Hanks was not present ) . ( c ) RESOLUTION GRANTING BUILDING PERMIT WITHIN OFFICIAL MAP AREA - 28TH AND LYNN (AUTHORIZED FEBRUARY 28 , 1972 ) The City Manager explained that under the appeals procedure the applicant may apply for a building permit after a six months period . RESOLUTION NO, 4456 It was moved by Councilman Griak , seconded by Councilman Thiel , j to waive reading and adopt Resolution No . 4456 entitled , " Resolution Granting Building Permit Within Official Map Area . " The motion carried 6 - 0 . ( Councilman Hanks was not present ) . (d ) FIRST READING OF PROPOSED ORDINANCE REGULATING LITTER STORAGE ( REQUESTED BY COUNCIL ) Councilman Heltzer moved to refer to Citizens Advisory Committee for their advice and recommendation . Councilman Graves seconded and the motion carried 6 - 0 . ( Councilman Hanks was not present ) . ( e ) FIRST READING OF PROPOSED ORDINANCE AMENDING ST . LOUIS PARK CODE SECTION 3 : 100 ENTITLED " ADOPTION OF STATE HIGHWAY TRAFFIC REGULATION AND DRIVERS LICENSE ACTS " I It was moved by Councilman Fleetham , seconded by Councilman Heltzer , to waive first reading of proposed ordinance and set second reading March 20 , 1972 . The motion carried 6 - 0 . ( Councilman Hanks was not present ) . 8 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES ( a ) PRELIMINARY REPORT OF DIRECTOR OF PUBLIC WORKS AND ASSESSING REPORT , IMPROVEMENT NO. 65 - 20 , SANITARY SEWER , EAST OF FRANCE FROM WEST 24TH STREET TO 125 FEET NORTH 55 7 f Council Minutes , March 6 , 1972 8 . ( a ) RESOLUTION NO. 4457 J seconded by Councilman It was moved by Councilman Fleetham , Graves , to waive reading and adopt Resolution No . 4457 entitled , , ' " Resolution Calling Public Hearing on Improvement No . 65 - 20 . " The motion carried 6 - 0 . ( Councilman Hanks was not present ) . ' Hearing was set April 3 , 1972 • b ) REPORT OF CITY MANAGER ( M & C NO. 72 - 05 ) RELATIVE TO � i ( i SIDEWALK CONSTRUCTION PROGRAM The Assistant City Manager and City Engineer explained with use of maps and overlays the proposed sidewalk construction schools programs . Walking areas were considered around park , churches , to bus routes , commercial service and other public areas . The program as proposed would require about ten years of construc - tion . Councilman Heltzer expressed concern for sidewalks in heavy traffic areas . Councilman Fleetham suggested that on' heavily traveled streets sidewalks be set back five feet to eliminate snow being plowed onto them from the streets . Councilman Thiel felt that sidewalks are needed in many areas from a safety stand - point . 1 i Mr . Alfred Relph reminded Council that he has been awaiting a determination on construction of sidewalks near Eliot School , Mr . Clarence Moe ; 4305 West 38th Street , felt no sidewalk 11 construction program should be undertaken unless there is also a program for keeping them clean . It was moved by Councilman Graves , seconded by Councilman Griak , to refer this program to the Planning Commission and Citizens Advisory Committee for study and recommendation . The motion carried 6 - 0 . ( Councilman Hanks was not present ) . ( c ) REPORT OF MAYOR ' S CITIZENS COMMITTEE RELATIVE TO HOUSING INSPECTION ORDINANCE Councilman Thiel suggested that a spokesman meet with the committees to which this matter might be referred so that they can have an exchange of ideas . It was moved by Councilman Fleetham , seconded by Councilman Graves , to refer the reports to the Citizens Advisory Committee , Housing and Redevelopment Authority and Building Construction Codes Advisory Committee for their advice and recommendation* 56 Council Minutes , March 6 , 1972 8 . ( c ) The motion carried 6 - 0 , ( Councilman Hanks was not present ) . J ( d ) REPORT OF CITY MANAGER RELATIVE TO PLACEMENT OF RAILROAD CAR � N JORVIG PARK Councilman Graves moved to authorize placement of the railroad car . Councilman Fleetham seconded suggesting that there be sufficient space provided for .31dewalk . The motion carried 6 - 1 , Councilman Hanks voting nay because of concern expressed by citizens in the area . Councilman Heltzer moved to reconsider . The motion was seconded by Councilman Thiel and carried 6 - 1 , Councilman Griak voting nay , Councilman Hanks explained that he would like to meet with people in the area and get their ideas and hear their concerns . The City Manager explained that staff is opposed to the use because of the amount of land that would be used , cost of maintenance of the f acility if it is going to be open to the public , that it make the area more active than passive and cause vandalism to the depot , and that it would raise insurance liability costs to the city . Councilman Griak asked that the Planning Commission and Parks and Recreation Commission be sent information as to the staff ' s recommendations Councilman Graves withdrew his original motion and moved to defer until April 3 , 19721, Councilman Thiel seconded and the motion carried 7 - 0 „ ( e ) REPORT SUGGESTING NAMING OF PARKS ( REQUESTED BY COUNCIL ) Councilman Fleeth2= Said t'iar re s i dent � in the vicinity of 16th Street and Natchez Avenje would like the park at that location named " Cedarhurst . " It was moved by Councilman Graves , seconded by Councilm .1a Thiel , to refer to Parks and Recreation Advisory Commission for their advice and recommendations , The motion carried 7 - 0 . 9 . UNFINISHED BUSINESS ( a ) APPOINTMENT TO CITIZENS ADVISORY COMMITTEE It was moved by Councilman Griak , seconded by Councilman Graves , to defer this appointment to March 20 , 1972 . The motion carried 7 - 0 . 57 Council Minutes , March 6 , 1972 9 . (b ) REMOVAL OF STOP SIGN - 16TH STREET AND COLORADO AVENUE ( REQUESTED BY COUNCILMAN GRIAK FEBRUARY 28 , � 11 , I 1972 ) I � Mr . Erick Zalitis , 1409 Colorado Avenue , urged removal of stop sign in winter months or installation of folding stop sign P g that could be utilized so that no stop would be required when the street is slippery . The Director of Public Works explained that the folding stop sign is not legal . Councilman Thiel felt that temporary removal of the sign would be I ly upon it . He felt that the sign safety hazard since children re should be removed , the street maintained with the use of salt / sand , or the grade of the street be changed . i i Councilman Griak moved that the stop sign remain and that the staff r take special consideration to sanding the area , and that if this is not satisfactory that the stop sign be removed during the winter i 100 months . Councilman Thiel seconded and the motion carried 6 - O . ( Councilman Hanks was not present ) . ( c ) DISCUSSION OF PARK IMPROVEMENT PRIORITIES - 1972 The Director of Parks and Recreation explained the proposed park improvement program for 1972 . Mr . Bob Hard 3000 Alabama Avenue , suggested that the rink ` y � gg that is in park on Alabama Avenue be flooded in the future . Councilman Thiel suggested that this might be a good area to develop for sliding . Councilman Heltzer asked for a clear analysis as to what monies are going to be used for drainage and which for Parks and Recreation on the Bass Lake improvement . He felt that Bass Lake is storm sewer basin and only secondarily a recreation area . Councilman Thiel urged that plans be made to dredge Wolfe Lake before the area is landscaped . He also indicated that he is in favor of metering the lighting of the tennis courts in Carpenter Park . Councilman Heltzer moved to delete the shelter building propoSed for Carpenter Park. Councilman Graves seconded and the motion was defeated 4 - 21 Councilmen Fleetham Hanks Griak and Mayor Pucci voting nay . ( Councilman Graves was not present Jor the vote ) • Councilman Griak explained that she would like to support the 58 Council Minutes , March 6 , 1972 90 (c ) program as presented and could find no fault with the emphasis that is placed . Councilmen Heltzer and Thiel urged economy in the building of shelters in the parks . Councilman Heltzer expressed concern that more traffic would be generated at the park at 27th Street and Dakota Avenue when the athletic field is lighted . Councilman Hanks said he hoped that this park vrould continue to be a children ' s play area and indicated that khe -re future need fol a Babe Ruth field . Councilman Heltzer inquired into the possibility of the development of a vest pocket playgaouund at 29th and Sumter . Councilman Griak moved to accept recommendations for 1972 Park Improvement Program and that additional emphasis be given the areas that were raised - - parking on Dakota at 27th , Wolfe Lake area , and lighting Fern Hill . Councilman Heltzer seconded and the motion carried 7 - 0 . 10 . NEW BUSINESS ( a ) JOINT AGREEMENT WITH CITY OF MINNETONKA - WATER AND SEWER ( M & C NO. 72 - 04 ) It was moved by Councilman Hanks , seconded by Councilman Graves , to approve and authorize execution of the proposed agreement . The motion carried 7 - 0 . (b ) LIGHTING WESTMORELAND Councilman Griak said questions have been raised about lighting in the Westmoreland area and asked to have staff furnish her with an estimate for possible assessments per home for the decorative giving . nem the option of Northern States underground lighting , Power or decorative lighting ( c ) CAUTION SIGNS - QUEBEC AND MINNETONKA Councilman Heltzer requested that " caution " signs be installed at on of Quebec Avenue on Minnetonka the approach to the intersecti Boulevard . (d ) PARKING PROBLEM - HIGHWAY 7 AND WOODDALE Councilman Heltzer called attention to serious parking problems in the area of Highway 7 and Wooddale Avenue and requested a study of this area . The City Manager explained that this study was deleted from the budget under parking consultant ' s studies . 59 Council Minutes , March 61. 1972 Councilman Heltzer moved to ask Planning Department to study 10 . (d ) Co and traffic . Councilman Graves that area problem of parking seconded and the motion carried 7 - 0 . 11 . MISCELLANEOUS i ( a ) DAMAGE CLAIMS L. Ernest E . Forde , 9610 West 16th Street It was moved by Councilman Fleetham , seconded by Councilman act Hanks , to file claim with City Clerk for proper ion by the City I g Mana er and City Attorney . The motion carried 7 - 0 . CONTRACT PAYMENTS APPROPRIATIONS , AND 12 . CLAIMS , I i ( a ) VERIFIED CLAIMS Councilman Fleetham , seconded by .Councilman On motion of i Graves , the list of verified claims presented by the Director of r Finance and presented to the Council dated March 6 , 1972 in the total amount of $ 88 , 608 . 34 for vendors was approved , and the City Manager , City Clerk , and City Treasurer were authorized to issue checks covering same by a seven yea vote . (b ) CONTRACT PAYMENT i 1 Final Payment , Paving , Curb , and Gutter , Improvement Nos . i 68 - 12 and 70 - 08 , Contractor , Co S . McCrossan , Ince I i Amount , $ 32 , 854 , 73 . RESOLUTION NO . 4458 It was moved by Councilman craves , seconded by Councilman Hanks , to waive reading and adopt Resolution No . 4458 entitled , " Resolution Accepting Work on Grading , Base , Concrete Curb and Cutter , and Bituminous Surfacing Improvement Nos . 68 - 12 ; and 70 - 08 .
