CALL TO ORDER A regular meetingof the City Cr. uncil was called to order by Mayor Pucci at 8 : 25 p . m . 2 . INVOCATION None 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Richard Graves Rose -Mary Griak Lyle Hanks James Heltzer Leonard Thiel Frank Pucci Also present were the City Manager , Assistant City Manager , City Attorney , Planning Director , Director of Public Works , Asst . City Engineer , Public Health Sanitarian and Acting Secretary . Councilman Heltzer .left the meeting at 9 : 10 p . m . 4 . MINUTES On motion of Councilman Heltzer , seconded by Councilman Griak , the minutes of the regular meeting held January 31 , 1972 were approved by a 7 yea vote . 5 . PUBLIC HEARINGS (a ) PROPOSED VARIANCE FROM SECTION 6 : 144 . 6 OF THE ST , LOUIS PARK ZONING ORDINANCE TO PERMIT A REAR YARD OF 0 FEET INSTEAD OF THE REQUIRED 10 FEET FOR PROPERTY LOCATED IN THE I - 1 DISTRICT AT 3119 LYNN AVENUE REQUESTED BY ALTON M . JOHNSON , AS DESCRIBED IN NOTICE OF HEARING j PUBLISHED JANUARY 13 , 1972 Mayor Pucci opened the hearing . Mr . Alton Johnson , the applicant , was present urging approval of the variance . There being no one else present wishing to speak , Mayor Pucci declared the hearing closed . 32 Council Minutes , February 7 , 1972 ' • ( a ) RESOLUTION N0 , 4441 It was moved by Councilman Grialc , seconded by Councilman Graves , to waive reading and adopt Resolution No . 4441 entitled , " Resolution Granting Variance of Ten Feet from the Requirements of Secuion 6 : 144 . 6 of the St . Louis Park Zoning Ordinance " . The motion carried 7 - 0 . Councilman Griak moved to authorize staff to prepare resolution establishing fire lanes on the south side of the building and between the main entrance and loading dock . The motion was seconded by Councilman Graves and carried 74 . (b ) PROPOSED FEZONING OF PROPERTY ON AIM SOUTH OF EAST OXFORD STREET ( THE NEW THOr.OUGHFARE AT THE NORTH END OF BASS LAKE ) FROM R- 3 , TWO FAMILY RESIDENCE DISTRICT TO I - 1 , INDUSTRIAL DISTRICT , REQUESTED BY THE CHICAGO , MILWAUKEE , ST . PAUL AND PACIFIC RAILROAD COMPANY (CONTINUED FROM JANUARY 3 , 1972 ) There being no one present wishing to speak , the Mayor declared the hearing closed . Councilman. Heltzer asked the staff if the applicant had been in contact with the City . The City Manage.- and City Attorney replied there has been no communication with the applicant other than the letter which the Council received copies . It was moved by Councilman Graves , seconded by Councilman Heltzer , that the request for rezoninC be denied . The motion carried 7 - 0 . ( c ) APPLICATION FOR. ON - SALE NON- INTOXICATING LIQUOR LICENSE , TEXA TONKA LANES Mayor Pucci opened the hearing . Mr . Arthur Mac's , attorney representing the applicant , was present urging approval of the license . Both the attorney and applicant , Mr . Orrin Ostlund , felt the license was necessary in order to keep pace with the surrounding similar establishments . There being no one else present wishing to speak , Mayor Pucci declared the hearing closed . Councilman Heltzer moved to table this request in order that the applicant confer with the City staff to resolve a number of questions apparently outstanding in this request including control of loitering and redesign of the facilities . LUNDER R090S351; OF THE OMNIBUS CRIME CONTROL AND RESOLUTION N0 . 4442 It was moved by Councilman Thiel , seconded by Councilman Griak , to waive reading and adopt Resolution No . 4442 entitled , "Resolution Authorizinry Filing of Application for Grant under Provisions of the Omnibus C_ ime Control and Safe Streets Act of 1968 (P . L . 90 - 351 ) . " The motion carriea 6 - 0 (Councilman Heltzer was not present ) . ( c ) RESOLUTION AUTHORIZING TRAFFIC CONTROL SIGNS PROHIBITING LEFT TURNS FROM 4 : 00 TO 6 : 00 P . M . AT INTERSECTIONS OF FRANCE AVENUE AND WEST 37TH2 38TH AND 39TH STREETS RESOLUTION NO , 4443 It was moved by Councilman Hants , seconded by Councilman Graves , to waive reading and adopt Resolution No . 4443 entitled " Resolution Authorizing Placement of Signs for Traffic Control at Intersections of France Avenue and 37th , 38th and 39th Streets " . The motion carried 6 - 0 (Councilman Heltzer was not present ) . (d ) FIRST READING OF PROPOSED ORDINANCE REGULATING THE DESIGN AND CONSTRUCTION OF SWIMMING POOLS ; ADOPTING MINNESOTA REGULATION MW 115 RELATING TO PUBLIC SWIMMING POOLS ; ADOPTING THE AMERICAN PUBLIC HEALTH ASSOCIATION REGULATIONS FOR THE DESIGN AND CONSTRUCTION OF PRIVATE RESIDENTIAL SWIMMING POOLS ; REQUIRING LICENSES FOR PUBLIC SWI11MING POOLS ; PROVIDING FOR INSPECTIONS • AND PROVIDING PENALTIES FOR VIOIATIOPIS OF THE PROVISIONS TH14REOF BY ADDING SECTIONS 2 : 1670 ' 1 THROUGH 2 : 1670 . 47 . It was moved by Councilman Fleetham to amend Section 2 : 1670 . 05 34 Council Minutes , February 7 , 1972 7 . (d ) License Fees , of the proposed ordinance by subdividing and changing what will be now Subdivision ( a ) to read " The license fee for a public swimming pool ( s ) o_peratin , on a year - round basis shall be $ 100 . 00 for all such facilities at each location" and by adding Subdivision ( b ) to read "The license fee for a public swimming pool ( s ) operat . . ng on a seasonal basis shall be $ 50 . 00 for all such facilities at each location . The motion was seconded by Councilman Thir� l and carried 6 - 0 ( Councilman Heltzer was not p ;- esent ) . Councilman Thiel moved , seconded by Councilman Graves , to waive first reading and set second reading February 28 , 1972 . The motion carried 6 - 0 ( Councilman Heltzer was not present ) . 8 . REPORTS OF OFFICERS , BOARDS AND CONHITTEES ( a ) REPORT OF ACCIDENTS I11 AREA OF FLAG AVENUE AND CEDAR LAKE ROAD ( REQUESTED BY COUNCIL 1 / 31 / 72 ) After discussion of the possibility of providing sidewalks in the area , the report was ordered by the Mayor to be received for filing . (b ) REPORT OF TRAFFIC STUDY (# 31 ) AT INTERSECTION OF JERSEY AVENUE AND WEST 29TH STREET RESOLUTION N0 , 4444 It was moved by Councilman Heltzer , seconded by Councilman Griak , to waive rea ding and adopt Resolution No . 4444 entitled , " Resolution Authorizing Placement of Stop Signs for Traffic Control at Intersection of Jersey Avenue and I-] est 29th Street " . The motion carried 6 - 0 . President Pro - tem chaired meeting for this item . Mayor Pucci was not present . ( c ) REPORT OF TRAFFIC STUDY (# 32 ) AT INTERSECTION OF WEST 23RD STREET AND SUPITEP. AVENUE Councilman Griak moved , seconded by Councilman Graves to defer this matter until February 28 , 1972 . The motion carried 6 - 0 (Councilman Heltzer was not present ) . 9 . UNFINISHED BUSINESS ' ( a ) REQUEST TO OPEN DEDICATED ALLEY - 40TH LANE (DEFERRED FROM JANUARY 17 , 1972 ) o After considerable discussion , it was felt by the Council that the City should continue its practice of requiring a petition of the abutting and affected property owners of at least 35 % before a public hearing would be held . Councilman Hanks moved , seconded by Councilman Fleetham , that the staff communicate with the petitioner informing him of the Council ' s feelings on this matter . The motion carried 6 - 0 ( Councilman Heltzer was not present ) . 35 f Council Minutes , February 7 , 1972 OPOSED HOUSING INSPECTION GUIDELINES (REQUESTED BY COUNCIL � 9 . (b ) PR JANUARy 10 , 1972 ) * Councilman Fleetham , seconded by Councilman Graves , It was moved by Advisory Committee , Housing and to accept and refer to Citizens Redevelopment Authority , and the Mayor ' s Citizens Study Committee . ( Councilman Heltzer was not present ) , The motion was carried 6 - 0 ( c ) TABULATION OF BIDS FOR STREET WORK SUPPLIES (PREVIOUSLY REJECTED AND READVERTISED ) Councilman Thiel moved to designate Richards Oil Company as the lowest responsible bidder in amount of $ 13 , 133 . 80 for the RC - 800 and $ 6 , 860 . 00 for the MC - 30 or I•IC ^ 70 , and authorize Thmotion was yor and City Manager to execute the necessary contract * e seconded by Councilman Fleetham and carried 5 - 0 ( Councilmen Hanks and Heltzer were not present ) . 10 . NEW BUSINESS ( a ) TABULATION OF BIDS - IMPROVEMENT NOS . 71 - 07 AND 71 - 08 - SANITARY SEWER LIFT STATIONS It was moved by Councilman Graves , seconded by Councilman Fleetham to accept Lametti and Sons as the lowest responsible bidder in amount of $ 307 , 396 . 00 and authorize Mayor and City Manager to execute the necessary contract . The motion carried 6 - 0 (Councilman Heltzer was not present ) . (b ) NEIGHBORHOOD DEVELOPMENT PROGRAM RESOLUTION 110 , 4445 Councilman Thiel moved , seconded by Councilman Griak , to waive reading and adopt Resolution No . 4445 entitled "Resolution Supporting Neighborhood Development Program" . Motion carried 6 - 0 (Councilman Heltzer X% as not present ) . ( c ) SPECIAL BENEFIT TAX FUND RESOLUTION N0 , 4446 It was moved by Councilman Thiel , seconded by Councilman Griat , to waive reading and adopt Resolution No . 4446 entitled "Resolution Supporting Use of the Special Benefit Tax Fund " . Motion carried 6 - 0 (Councilman Heltzer was not present ) . ( d ) APPOINTMENTS TO BOARDS / COMMISSIONS It was moved by Councilman Fleetham seconded by Councilman Th1el ' to reappoint Duane Sewall to a full term on the Fire Civil $ ervic ` Commission . The motion carried 4 - 0 - 2 (Councilman Graves and Mayor Pucci abstained and Councilman Heltzer was not present ) ' 36 Council Minutes , February 7 , 1972 11 . MISCELLANEOUS ( a ) DAMAGE CLAIMS 1 . Mrs . Helen Overlin and Mrs . Willetva Hartman , 4116 Aldrich Avenue South , Minneapolis , Minnesota Councilman Fleetham moved to file claim with City Clerk for proper action by the City Manager and City Attorney . Councilman Griak seconded and the notion carried 6 - 0 (Councilman Heltzer was riot present ) . 12 , CLAIMS , APPROPRIATIONS AND CONTRACT PAYMENTS ( a ) VERIFIED CLAIMS On motion of Councilman Thiel , seconded by Councilman Graves , the list of verified claims prepared by the Director of Finance and presented to the Council dated February 7 , 1972 in the total amount of $ 102 , 807 . 17 for vendors was approved , and the City Manager , City Clerk and City Treasurer were authorized to issue checks covering same by a 6 yea vote . (b ) CONTRACT PAYMENT 1 . Martial Payment No . 12 Arena / Pool . Contractor , Axel Newman Heating and Plumbing . Amount , $ 29 , 722 . 27 . On motion of Councilman Fleetham , seconded by Councilman Graves , the above payment on contract work presented by the City Engineer was approved , and the City Manager , City Clerk and City Treasurer were authorized to issue checks for their respective amounts by a 6 yea vote . 13 . ADJOURNMENT On motion of Councilman Graves , seconded by Councilman Griak , the meeting was adjourned at 10 : 00 p . m . by a 6 yea vote . v Frank J .
