CALL TO ORDER A regular meeting of the City Council was called to order by Mayor Pucci at 8 : 08 p . m . 2 . INVOCATION Invocation was given by Rev . Ellis Graber of the Union Congregational Church . 3 . ROLL CALL The following Councilmen were present at roll call : Frank Fleetham Rose - Mary Griak Lyle Hanks James Heltze r Leonard Thiel Frank Pucci Also present were the City Manager , Assistant City Manager , City Attorney , Planning Director , Director of Public Works , Director of Public Health , and Secretary. Mayor Pucci left his chair at 9 : 35 p . m . and resumed it at 9 : 50 p . m . , with President Pro Tem Thiel chairing the meeting in his absence . 4 : MINUTES On motion of Councilman Hanks , s econded by Councilman Heltzer , the minutes of the regular meeting held February 7 , 1972 and special meetings held February 7 and 14 , 1972 , were approved by a six yea vote . 5 . PUBLIC HEARINGS (a ) PETITION OF POW BEL CONSTRUCTION CORPORATION FOR AUTHORIZATION FOR BUILDING PERMIT TO CONSTRUCT A SINGLE FAMILY HOME ON LOT 4 , AND THE NORTH ONE - HALF OF LOT 5 , BLOCK 2 , BARRETT ' S ADDITION WHICH LANDS ARE DESIGNATED FOR PROPOSED FUTURE PUBLIC USE , AS DES - CRIBED IN NOTICE OF HEARING PUBLISHED JANUARY 131 1972 ( 2800 LYNN AVENUE ) - CONTINUED FROM JANUARY 31 , 1972 ., Mr . Herb Davis , representing the applicant , stated that his client 44 Council Minutes , February 28 , 1972 5 . ( a ) would be willing to convey the property to the city at the price established by the city as the market value and have the city undertake tax payments at the time of adoption of the map . There being no one else present wishing to speak concerning this matter , the Mayor declared the hearing closed . It was moved by Councilman Twel , seconded by Councilman Hanks , to authorize staff to prepare the necessary resolution making the findings to permit building on this property. Mr . Davis was informed that his applicant would be required to request separate permits for other lots in the area . Vote on the motion carried 6 - 0 . (b ) PROPOSED VACATION OF THE SOUTH 105 . 05 FEET OF THE NORTH - SOUTH ALLEY LOCATED NORTH OF WEST 16TH STREET AND WEST OF NEVADA AVENUE BOUNDED BY LOTS 73 THROUGH 782 RICHMOND ADDIZION , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED FEBRUARY 17 , 1972 Mayor Pucci opened the hearing . Mr . Oo Halvorson , 7440 West 16th Street , urged approval of the vacation in order that he may construct a garage on his presently owned land . There being no one else present wishing to speak to this matter , the Mayor declared the hearing closed , It wa .s moved by Councilman Heltzer , seconded by Councilman Thiel , to waive first reading of proposed ordinance vacating portion of alley and set second reading March 6 , 19721 retaining utility easements , (c ) PROPOSED PRELIMINARY PLAT AND FINAL PLAT - WESTERN COURT ADDITION , NORTHWEST CORNER OF MINNETONKA BOULEVARD AND JOPPA AVENUE , AS DESCRIBED IN NOTICE OF HEARING PUBLISHED FEBRUARY 17 , 1972 ( PLANNING COMMISSION RECOMMENDS DENIAL ) Mayor Pucci opened the hearingo Mr . Allen Cunningham , attorney , represented the applicant , stating that the purpose of the platting is to have the north portion of the property so that it can be sold to the owner of the property to the north. 45 Council Minutes , February 28 , 1972 5 , (c ) There being no one else present wishing to speak , the Mayor closed the hearing . Councilman Thiel moved to deny , indicating that it was ling that this is valuable property and a fine location an that tere hh seconded should be a plan for the entire area . Councilman F and the motion carried 6 - 0 . I 6 . PETITIONS , REQUESTS , AND COMMUNICATIONS ( a ) NOTICE OF INTENT TO CONDUCT BINGO GAME - FERN HILL SCHOOL PTA - APRIL 16 , 1972 There being no opposition , the President Pro Tem ordered the notice of intent to be received for filing . (b ) REQUEST OF PLANNING COMMISSION TO AUTHORIZE UPDATING OF MODEL BLOCK STUDY It was moved by Councilman Hanks , seconded by Councilman Griak , to refer to Planning Staff and Commission for updating of the study. The motion carried 5 - 0 , (Mayor Pucci was not present ) . 7 . RESOLUTIONS AND ORDINANCES ( a ) SECOND READING OF PROPOSED ORDINANCE REGULATING THE DESIGN AND CONSTRUCTION OF SWIMMING POOLS , ADDING SECTIONS 2 : 1670 . 01 THROUGH 2 : 1670 . 47 ORDINANCE NO, 1178 It was moved by Councilman Heltzer , seconded by Councilman Thiel , to waive second reading and at, - opt Ordinance No . 1178 entitled , " An Ordinance Regulating the Design and Construction of Swimming Pools : Adopting Minnesota Regulation MHD 115 Relating to Public Swimming Pools ; Adopting the American Public Health Association Regulations for the Design and Construction of Private Residential Swimming Pools ; Providing for Inspections ; and Providing Penalties for Violations of the Provisions Thereof by Adding Section 2 : 1670 , 01 Through 6 : 1670 . 47 . " The motion carried 6 - 0 . (b ) RESOLUTIONS AUTHORIZING THE CITY MANAGER TO FILE APPLICATIONS FOR FEDERAL GRANTS TO ACQUIRE OPEN SPACE LAND 46 Council Minutes , February 28 , 1972 7 . (b ) RESOLUTION NO. 4448 It was moved by Councilman Heltzer , seconded by Councilman Hanks , to waive reading and adopt Resolution No . 4448 entitled , " Resolution Authorizing the City Manager to File an Application for a Federal Grant to Acquire Open Space Land ( Plan "A ' ! ). " The motion carried 5 - 0 . (Mayor Pucci was not present ) . RESOLUTION NO, 4449 It was moved by Councilman Heltzer , seconded by Councilman Hanks , to waive reading and adopt Resolution No . 4449 entitled , " Resolution Authorizing the City Manager to File an Application for a Federal Grant to Acquire Open Space Land ( Plan " B " ). " The motion carried 5 - 0 . (Mayor Pucci was not present ) . RESOLUTION NO, 4450 It was moved by Councilman Heltzer , seconded by Councilman Hanks , to waive reading and adopt Resolution No . 4450 entitled , " Resolution Authorizing the City Manager to File an Application for a Federal Grant to Acquire Open Space Land ( Plan " C " ) . " The motion carried 5 - 0 . (Mayor Pucci was not present ) . (c ) RESOLUTION AUTHORIZING JOINT POWERS AGREEMENT - MINNEHAHA CREEK RESOLUTION NO. 4451 It was moved by Councilman Heltzer , seconded by Councilman Griak , to waive reading and adopt Resolution No . 4451 entitled , " Resolution Authorizing Cooperative Agreement for Preparation of a Coordinated Land and Water Management Flan for the Development and Maintenance of Minnehaha Creek. " The motion carried 5 - 0 . (Mayor Pucci was not present ) . 8 . REPORTS OF OFFICERS , BOARDS , AND COMMITTEES ( a ) REPORT OF LARRY DECKER RELATIVE TO COMMUNITY EDUCATION Dr . Larry Decker , Community Education Coordinator , presented a report of the activities , , past , present , and future , of the community education program . The first three sites selected were Aquila , Brookside , and Fern Hill . The statistics cited indicated that many citizens are involved , both registrants for classes and volunteers working with the program . 47 wn Council lyjinutes , February 282 1972 8 . ( a ) Mr . Al Rogalla , 5725 West Lake Street , had questions concerning fees and attendance at courses which were properly answered by Dr . Decker and Mayor Pucci . (b ) REPORT OF PLANNING COMMISSION ( CASE NO. 70 - 58 — S . Pe ) RECOMMENDING APPROVAL , WITH CONDITIONS , UPON THE REQUEST OF DORA SUE RUBEL FOR SPECIAL PERMIT UNDER PROVISIONS OF SECTION 6 : 0 ' 2 OF THE ZONING ORDINANCE TO AMEND SPECIAL PERMIT TO ALLOW EGRESS OVER EXISTING DRIVEWAY AT 3127 SOUTH HIGHWAY 100 RESOLUTION NO. 4452 It was moved by Councilman Fleetham , seconded by Councilman Heltzer , to waive reading and adopt Resolution No . 4452 entitled , " Resolution Granting Permit Under Section 6 : 092 of the St . Louis Park Zoning Ordinance for Allowing Egress over Existing Driveway , " amending Condition " c " to read , " The driveway shall be one - way east bound to Salem Avenue and a stop sign and ' do not enter ' sign shall MOMM be placed at the west line of the sidewalk at the intersection of the driveway and the sidewalk . " The motion carried 6 - 0 . (c ) MINUTES OF HUMAN RIGHTS COMMISSION MEETING HELD JANUARY 19 , 1972 Councilman Heltzer requested that Council be supplied with copies of cover letters and portion of minutes regarding guide lines for commissions . There being no further discussion , the minutes were ordered by the President Pro Tem to be received for filing . UNFINISHED BUSINESS ( a ) TRAFFIC STUDY ( # 32 ) - WEST 23RD STREET AND SUMTER AVENUE ( DEFERRED FROM FEBRUARY 7 , 1972 ) Mr . Sheldon Azine , 2301 Rhode Island , felt that in addition to the stop sign recommended on Sumer Avenue , there should be one on Rhode Island Avenue . He also was in favor of relocating the bus stop . Mr . Howard bine , 2300 Rhode Island , was in agreement with Mr . The motion carried 6 - 0 . (c ) APPOINTMENTS TO BOARDS / COMMISSIONS F It was moved by Councilman Fleetham , seconded by Councilman Heltzer , to appoint Daniel Boehle and Mrs . Karen Michaels to the Planning Commission , replacing Mrs Mark Rodman and Dr . Eugene Scherling (terms expiring 12 / 31 / 72 ) 9 and Mr . David Fox to the Environmental Improvement Commission . The motion carried 6 - 0 . (d ) SALE OF CENTRAL GARAGE PROPERTY (Ni & C NO. 72 - 03 ) It was moved by Councilman Tniel , seconded by Councilman Hanks , to waive first reading of proposed ordinance authorizing sale by the City of the old City Garage property and set second reading March 6 , 1972 , The motion carried 6 - 0 . RESOLUTION NO, 4455 It was moved by Councilman Thiel , seconded by C ouncilman Hcs , to waive reading and adopt Resolution No . 4455 entitled , " Resoluti° e Designating Placement of Proceeds from Sale of Real Property in th Municipal Building Fund . " The motion carried 6 - 0 . 50 Council Minutes , February 28 , 1972 10 . NEW BUSINESS (a ) TABULATION OF BIDS - PHASE I - BASS LAKE DEVELOPMENT It was moved by Councilman Fleetham , seconded by Councilman Heltzer , to accept Carl Bolander & Sons as lowest responsible bidde r and authorize execution of contract in amount of $ 22 , 900 . The m , .jtion carried 6 - 0 . (b) TEMPORARY REMOVAL OF STOP SIGN Councilman Griak asked that a resolution be prepared for Council consideration to temporarily remove a stop sign at 16th Street and Colorado Avenue during the winter months , (c ) BLACKSTONE IMPROVEMENT AREA Councilman Griak presented a resolution from neighbors in the Blackstone Improvement area to be transmitted to the Planning Commission requesting that the Comprehensive Plan be changed to keep the neighborhood residential and that it be serviced as a residential neighborhood . 1L MISCELLANEOUS ( a ) DAMAGE CLAIMS 1 . Councilman Griak seconded and the motion carried 6 - 0 . 12 . CLAIMS , APPROPRIATIONS , AND CONTRACT PAYMENTS ( a ) VERIFIED CLAIMS On motion of Councilman Thiel , seconded by Councilman Griak , the lists of verified claims prepared by the Director of Finance and presented to the Council dated February 28 , 1972 in the total amounts of $ 13 , 892 . 27 for payroll , and $ 154 , 142 . 60 for vendors were approved , and the City Manager , City Clerk , and City Treasurer were authorized to issue checks covering same by a six yea vote . 51 ve 4 Council Minutes $ F ebruary 28 , 1972 12 , (b ) CONTRACT PAYMENTS On motion of Councilman Thiel , seconded by Councilman Heltzer , the following payments on contract work presented by the Director of Public Works were approved , and the City Manager , City Clerk , and City Treasurer were authorized to issue checks covering their respective amounts by a six yea vote , 1 .
